Consumer sent the following email and attached letter.Hi [redacted] -I have re-read MrK [redacted] 's most recent response stating "I am responding to the accusation that [redacted] makes regarding our "fraudulent" sales practice Neither the Revdex.com or were at the home during this so called transgression."MrK [redacted] has shown no remorse for the situation that occured, but has instead taken the position of becoming rather defiant His above statement implies that since neither the Revdex.com or himself were at my home during this so called transgression, perhaps it didn't even happen, or maybe I'm lying about the whole thing I find it disbelieving and very disapponting that this man has stooped to this level He's obviously run out of excuses and innuendos, and chose to hit me where it really hurtsTherefore, it's time to turn this over to your arbitrator, as it's become evident there will be no reasoning with MrK [redacted] .I am attaching my final document/comments related to my complaint and ask that you include it in the paperwork you turn over to your arbitrator for review The document is self-explanatory.Thank you for your time, quick responses and patience you have shown working with meHappy Valentine's Day*:) happyConsumer letter attached, but has also been copied and pasted below by Revdex.com staff 2/16/16.February 14, 2016Revdex.comReference: ID [redacted] This is to confirm I am continuing to pursue my complaint, ID [redacted] , against Window Systems, and now request that an arbitrator take my information/request under consideration and rule on it in accordance with the standards set forth by the Revdex.com.I repeat my requests as follows:(A) A legal document from Window Systems giving me a Lifetime Warranty on the Weather King French Doors I purchased from them in August, (installed by their installer October, 2015) This document must also contain wording stating this Lifetime Warranty will be transferrable should Window Systems be sold and there be a change of ownership It must also specify that Window Systems would be responsible for legal costs should it be necessary to take legal action against them for not being willing to honor their responsibility (The importance of the transferrable clause is that per a video on the Window Systems’web site, Frank K [redacted] Jr(President), states his father, Frank K [redacted] Sr (Owner), “is in his 80’s”, so depending on when this video was made, he could possibly be in his 90’s by now Should anything happen to “Sr.”, there would be a change of ownership of the company.)The definition of “French Doors” is all the components of the door units as they were delivered to my home by the Window Systems’ installer, in their original cartons This includes the factory-installed brass hardware locking units on the right side, top and bottom, of the semi-permanent swidoor The bottom unit secures the door in the threshold, and the top into the framing Upon the Window Systems rep, Rick G [redacted] telling me I could paint them any color I chose and also could purchase my own hardware, I did paint the doors myself and the Window Systems’ installer installed the hardware I am not asking that the malfunction of any door hardware that was purchased by me (Keyed Door Entry Sets) be covered under this warranty, nor am I asking that my painting be.(B) The amount of $ I paid in excess of $for the purchase of the Weather King French Doors from Window Systems vshad I purchased them from a Home Improvement Center I based my decision to purchase the doors from Window Systems based on their rep, Rick G [redacted] telling me the Window Systems/Weather King French doors had a Lifetime Warranty on them To me, this lifetime warranty was worth the extra money I am asking for this amount of $based on what I lost on going with Window Systems vsa Home Improvement Center I am also asking for this amount of $because this money is an unearned profit for both Window Systems and the commission their rep, Rick G [redacted] enjoyed at my expense No company or individual is entitled to profits obtained from deceitful sales tactics p2Please note, I am not requesting compensation for the immense emotional stress the actions of Window Systems has put upon me.Via a registered letter to both Frank K [redacted] Sr(Owner), and Frank K [redacted] Jr, (President), I made an effort to work with Window Systems but my correspondence sent to them on October27, 2015, was ignored. After reading the comments Frank K [redacted] Jrhas sent to the Revdex.com, the issue of the legal Lifetime Warranty document has now become even more important Based on the reluctance to rectify the mistake(?) made by Window Systems, should a problem arise with the doors, odds are very high it will end up in the courts The above legal document and compensation I am asking for is a direct result of their sales rep, Rick G***, giving me fraudulent information when he told me the Weather King doors had a Lifetime Warranty on them When approached, after it was too late, he said, “I really didn’t know because it’s a fairly new line” I have proof that they’ve carried this line for over years When I asked Rick G [redacted] if there was a Lifetime Warranty on the Window King doors he said YES What he should have said was “I really don’t know because it’s a fairly new line, but I will check on it and let you know” In spite of his admitted “not knowing”, he made the conscious decision to say YES in an attempt to secure my business This was not a mistake He not only told me once that there was a Lifetime Warranty on the Weather King doors, but a second time, on the day of installation, prior to me making my final payment Again, this was not a mistake but the answer he chose to give me He also did not bring a copy of the Weather King Warranty as he said he would I now understand why he didn’t want me to see it there was no Lifetime Warranty. At your request, I am prepared to submit to you a sworn document stating all the information I have given you on this complaint is honest and true I would welcome the opportunity to submit a truthful description/review to the Revdex.com, for publication, of my experience with Window Systems Based on my review, the public could evaluate if they chose to do, or not to do, business with this company The people in our community deserve to be treated honestly and fairly by the businesses we depend on to service us I am not out to be a trouble-maker or money maker I worked years at my company that has been in business for over years We earned the respect of our customers because we treated them fairly Having lived through all of this, it blows my mind to think MrK [redacted] Jr, the President of Window Systems, would take the attitude of showing no remorse, or willingness to take responsibility for the situation created by his sales rep, Rick G*** I am left with many “suspicions” about this company As stated, I am not withdrawing my complaint against Window Systems and ask that the Revdex.com now assign an arbitrator to resolve this issue Should you need additional information or clarification, please contact me Thank you.Respectfully, [redacted]

they had to order has arrived

Business sent the following response. ***,Per our conversation yesterday, I am responding to the accusation that *** ***makes regarding our "fraudulent" sales practice Neither the Revdex.com or were at the home during this so called transgression.Let me say there was absolutely no "fraud" whatsoever The product that was sold, was in fact the product that was deliveredIt was the product that was installed By her own volition, Ms*** has told Rick that she loves the installed job.As a practicing sales rep for our company as well, I will admit to not knowing every product's details and warranties The same applies to our sales staff at times. At the point where Ms*** requested a written document for a lifetime warranty, we provided such Without any clamor It was done.In her statement, it appears that she is dissatisfied with the fact she wants us to warranty "her"painting of the door as well We will not do that.Let me know if this addresses your request.Sincerely,Frank K***, JrWindow Systems

Business sent the following response:In response to your most recent email, Window Systems "adamantly" denies any type of fraudulent sales practice In my years of sales, I have made errors either describing the products or warrantiesThis has never been done by design or any nefarious causeThis is likely the exact same situation she is speaking of Ms*** notes "If Window Systems is making errors, they should look at how they are doing business in the future" Let me say, we derive over 50% of our revenues from referrals AND previous customers This is NOT by accidentWe work hard at providing quality products and sound installations to our customers They recognize these efforts and come back for more workWe are willing (and have) provided on company letterhead, signed by Frank K***, Sra lifetime warranty on the door.To this date there have been no manufacturer problems"If" and when something would arise, we will address it professionally. We will not provide Ms*** with any financial compensation, just because she feels like being rewarded We installed a quality job, we will stand behind as we agreed to in the written letter. As I may be of help in this matter, please don't hesitate to contact me.Sincerely,Frank SK***, JrWindow Systems

Business response taken over the phone by Revdex.com staff 11/30/15. This is taken care of, the consumer is set for next Monday Dec. 7th.

Business response taken over the phone by Revdex.com staff MT 1/7/16. They were out...

there on 11/24, they changed out 8 pieces of glass which was the customers original service request.  While they were there the consumer pointed out that there were 6 more that were needed, which were not included in original request.  They went out again on 12/1 to address a question that she had about why the glass looked different.  They honored the warranty at no charge, but they had to use a different supplier than what was used in 2001.  They ordered 6 more pieces of glass for her, which they are waiting to receive. With the holiday shut down of the suppliers it pushed things back.  They should receive the glass shipment next week, week of January 11th.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Regards,
[redacted] Consumer included the following statement. See attached.Letter has been copied and pasted below by Revdex.com staff 2/3/16.In response to Mr. K[redacted]’s comments
to you, II am not withdrawing my complaint against Window
Systems. First, he indicated the October 21, 2015 letter to me was
signed by Mr. K[redacted] Sr. and Rick G[redacted]. Not that it matters, but
the unofficial letter was NOT signed by Rick G[redacted] also. He also
indicated he saw no reason the letter needed to be notarized. Being
a business man he would be aware that a legal document must be
notarized, and all details spelled out, including his/Window System’s
responsibility for legal costs should it go to court. If his
intentions are honorable, he should be happy to submit this document
to me, in legal form.
Next he referred to me painting the
doors and purchasing my own hardware. This is absolutely correct.
When discussing the purchase of the doors, and hesitating when
discovering the limited paint choices, Rick G[redacted] informed me I could
paint the doors any color I chose, and purchase the hardware of my
choice myself, and the Window Systems’ installer would install the
hardware when he installed the doors, which he did. When Rick G[redacted]
told me I could paint the doors and buy my own hardware, he did not
inform me this would affect the warranty.
Surprisingly, Mr.
K[redacted] made no mention of Window Systems getting my business because
of the fraudulent information given me by his sales rep, Rick G[redacted].
Again, Rick G[redacted] told me (twice) there was a Lifetime Warranty on
the Weather King doors. Upon receiving the Weather King warranty
after installation, (which was withheld by Rick G[redacted] until after
installation) it was not a Lifetime Warranty. I was livid.
I called Rick G[redacted] asking him why he lied to me and his excuse was
“I really didn’t know because it is a fairly new line”.
Why wasn’t he honest with me and tell me he didn’t know
instead of giving me fraudulent information to make the sale? Had
he been, we would not be having this conversation –and yes, I would
have taken my business elsewhere.
This whole issue is a result of
devious, deceptive sales tactics on the part of the Window System’s
sales rep., Rick G[redacted]. For Mr. Frank Kinzcel/Window Systems to
refuse me satisfactory restitution based on my complaint, they are
not living up to the standards set forth by the Revdex.com.Again, I am not withdrawing my
complaint as I am a victim of a deceitful sales tactic as admitted by
the Sales Representative of Window Systems, Rick G[redacted].
Respectfully,[redacted]

Revdex.com:

Business responded to the complaint. On October 21, 2015, a letter was sent that was signed by Frank K[redacted], Sr and Rick G[redacted] stating that Window Systems would in fact provide the lifetime warranty that Mrs. [redacted] was requesting.   We do not see any reason that the letter needed to be...

notarized.  It is on Window Systems letterhead and was signed by a principal of the company.  Let it be noted that Mrs. [redacted] painted the door herself AND provided the hardware.  We do not intend on warranting her paint or the hardware that was purchased elsewhere. As I can be of help in putting this issue to rest, please feel free to contact me. Sincerely, Frank S. K[redacted], Jr.PresidentWindow Systems

Consumer update taken over the phone by Revdex.com staff 11/24/15. She said the company was currently there, but they didn't have all of the windows. They still need to order them. This has been going on for 3 years.

Company responded by phone 8/31/16-[redacted]Mr. Frank from the company states that they were able to reach a resolution with the consumer and that the matter has been resolved.
