This response is in reference to a compliant that was submitted on 11/4/2014, ID # ***, regarding *** ***Mr*** moved into *** ***, a brand new luxury community, on 8/27/His apartment is a top floor, open concept style apartmentMr*** made several walk
through of his new apartment before signing a lease and taking keysAt no time during his walk through did he note to the office staff and kind of “noise” issuesWe also can not 100% make a claim an apartment is going to be “noise free”, with this being a multi-unit dwellingUnfortunately, a general amount of noise is expected when living in suchDuring each visit he had small complaints about touch ups needed in the apartment that were handled prior to move inAfter Mr*** was living here for several weeks, he began complaining about a dripping from a pipe in his apartmentAgain, we are an open concept style so pipes and ducts are exposedMaintenance techs were dispatched, including a supervisor and noted the “drip” was coming from water dripping into a condenser pan (completely normal)They made several attempts to silence the noise with steel wool in the pipes, but could not completely eliminate a soundFollowing the drip noise, Mr*** made a complaint to the office of his refrigerator running loudlyWe immediately swapped the appliance out with another (brand new) unit from a vacant apartmentMr*** noted this appliance was louder than the firstSince we are a new building, this item was covered by warranty and the service techs were alerted to the issue, on the new applianceOn several occasions *** *** came out and reviewed the compliant of the noisy refrigeratorEach time the techs noted absolutely nothing wrong with the refrigeratorI spoke with Mr*** and attempted to correct the issue by allowing him to enter other vacants and select one he approvedPrior to this happening, I personally spoke with a supervisor at *** *** and as a courtesy, they agreed to replace the appliance, although nothing was found defective. The final issue and one specifically noted, was the HVAC units located on the roof of the buildingMr*** again made a compliant, and techs were dispatched*** *** *** ***, the original installers, came out and installed “cushions” to the condensing units above his apartmentAfter speaking with a supervisor at ***, they noted nothing else could done to make these units less “noisy”All was working as designed and we had a “sensitive hearing homeowner”It was at this time Mr*** requested to be released from his leaseAfter several email exchanges and phone calls between myself, our VP of Operations, and Principals; we allowed the release with Mr***’s medical provider’s statement advising so and notice to vacateAt this time Mr*** has been released, termination fee of $waived, no concessions have been charged back (months free rent was given at move in), and deposit has been refundedEvery reasonable attempt was made to satisfy Mr*** while he was living at *** ***; no manipulative or unethical business practices were used.
