We had work done 2 weeks after moving back in we wanted warranty and the contractor says no.
It is over $17,000.00
We have requested by email fax text and call.
We have sent a demand letter.
We have have had a lawyer send a demand letter.
We went to mediation case management- they refuse all warranty and any payment.
We have booked trial but this is the step before trial and we want to settle prior to court.
They dont want to come to our home and frankly we dont want them in our home. ***. So we got a few quotes from contractors and that is what we got the warranty price based on. At this point we hjust want them to pay us out and we will hire someone.
FACT- We were given the brochure- ***. On page 3 it states that they warranty all their work
and all their sub contractors work for 2 years. We should have warranty. Pretty cut and dry claim. Otherwise what they are giving to us is False advertising. Warranty is warranty. We have a legit concern and they should fix it it was within days-weeks that we reported to them
They have not even come to our home to look at it- simply are not fixing.
The rest of the claim has no issue, Our issue is they need to fix the damage
We did a walk thru and we signed off that the work was complete so that insurance could pay them.
Days later we moved back into the home.
Shortly after moving back into the home we noticed the issues. We asked for warranty- we asked them to be fixed. We sent demand letter.
They are refusing to give warranty.
There reasons are....
The flooring because we gave them 5 quotes of local contractors in Humboldt that they do not have to warranty. BUT.... they are the one who hired them. We even have a screenshot of us asking them who was hired and they told us. It is their sub contractor even if we supplied them with 5 quotes of contractors- they picked - they hired
As well as their brochure states they give warranty to all their subcontractors.
The Counter top. We wanted them to order and gave them samples of counter 2 weeks after the claim. They never ordered the material. Again we asked them again if the sample ok- no reply then just priro which was months later if the counteres would be ready we were told that there supplier will not have time to make rounded edge like we had to get us in back in the home. We were living in the hotel for a long time. We knew the rounded what we agreed upon costed alot more but we agreed to square edge. Yes we agreed to going with square edge. They are the contractor they should know if there is any issues. Now everytime we turn on the dishwasher the adhesive lets loose. They should know that- they said they are not giving us warranty because we agreed to square edge- they are contractors they should no better- we have not been able to use the dishwasher for two years.

We just want our warranty and the sub contractors to be paid.
This person has initiated legal action on this matter. We will not be commenting further.

We understand that we have taken legal action but only have done so after ServiceMaster told us in writing they were not willing to discuss any settlement and for further action to contact their lawyer. We wanted to settle this out of court. We are still trying to negotiate out of court and settle. We attended mediation in hope to settle. As per mediation and forms it says we are encouraged to continue to try to work together. We would like to continue to work together to resolve this matter. We understand that the only things that will be discussed in the court are the direct issues on our complaint. As per that we are just stating that on the booklet-document we were provided we have in writing that ServiceMaster warranties all their work and subcontractors work for two years. As soon as we moved back to the home and noticed the issues we immediately contacted them. We would like to work together and resolve this issue. We would like to have this resolved in a speedy matter so it does not not cause any other issues. We are trying everything to resolve this issue including settling prior to court. We do not understand why we would not have warranty when mentioning the issues shortly after moving back into the home after the work was complete, when it directly states it in the brochure. We are willing to discuss and welcome any explanation to understand any reasoning. We will also stick to the points on the legal document. We just want our home fixed under warranty and things made right. We do not understand why we would be denied warranty when this is something that was provided to us on day one in the brochure we were given. We welcome and explanation or communication with a reason why. We sincerely want to work together and settle this matter and hopefully work together to resolve and drop all legal and other claims. Please note we are trying to settle. We have not received an explanation why we are denied warranty or an explanation. We are eager to resolve and work together and welcome the mediation to settle.
