ServPro of Greenwood was hired for restoration from my house fire of 7 March 2019. They didn't properly clean the house. They were supposed to be finished last Monday. Then it was Thursday (no one showed up to my house on Tuesday or Wednesday. Then it was to be finished Friday. They still did not clean everything and place everything back :LIKE IT NEVER HAPPENED" which they advertise on their business card. I went to the office on Monday and my wife and I spoke to the owner T. Barron B. I brought him a DVD (pictures of things that was wrong, more than 200 pictures). He asked me to give them one more chance to fix the problem. I did. They came back today 1 May and it is still not fixed. They lost the antenna to my DISH hopper ( I had to buy a new one), they hid the damages to my coffee table by stacking papers and other items on it. They threw packing wrapping paper behind our love seat. Today they finally mopped the house. I filed a complaint with the Corporate Office on 26 April 2019 and have not heard back from them. ServPro advertise that your house will be like it never happened. When I asked them to restore my house to the exact condition it was they refused. They hung pictures in the wrong locations and wrong room, they put furniture back in the wrong room. They refuse to put the albums, DVDs and CDs back in the alphabetical order that it was originally in. The owner told me it would take his company 3 days to do this. Since he has 3 workers who are supposed to be working 8 hours per day, there is no way it would take 72 man power hours to do this. It should take less than 8 hours total. I will be asking my insurance company to withhold payments to this company until my house is restored to what it was before the fire. We have found plates and other kitchen stuff in our bedroom closets. They simply put stuff wherever they wanted to verses in it proper place. The items that they threw away in the kitchen and dining room, they lost their documentation of these items. Other in back yard.

I spoke to my insurance company and they said since ServPro lost some of my items (officials equipment or threw them away and since ServPro damaged my German coffee table, they are responsible for reimbursing me for these items. They also threw away or lost the antenna for the dish hopper. I had to replace this antenna before the hopper would work. ServPro should also be responsible for reimbursing me for this item.

Regional ServPro is trying to mediate a settlement between ServPro of Greenwood and myself. Until this mediation is complete, the case needs to remain open. Hopefully we can come to a mutual agreement.

We have tried to reach an agreeable settlement of this dispute with the customer. Some of the items that the customer is disputing are beyond the realm of our services. When we pack out a home for cleaning, we charge for packing and replacing items in their approximate location. For example: we replace books/videos back on the bookshelf. We do not alphabetize the items. Another example is that we replace medications in medicine cabinet but we do not put them in the precise location that the customer had them. This is above and beyond the realm of services that we offer or charge for. Servpro corporate has reviewed this case and agrees that we performed the services that were charged for.
We have made every effort to settle this matter with the customer. There have been multiple visits to his home, and phone calls with him trying our best to come to a reasonable conclusion. We agreed to settle for half the amount that we were owed, and the insurance company paid directly to him for our services that were performed. In my opinion this settlement is beyond fair. The customer came to sign the agreement but would not sign after he learned that he could not continue to slander our name if he agreed to this. At this point we stand by our offer and will not change the wording in our agreement. We will wait for the customer to get back to our attorney. We believe that we have made every effort to reach a reasonable agreement and ask that this case be closed.

I am rejecting this business answer for he following reasons:

1. I was willing to accept a settlement offer but I REFUSED to sign away my rights of free speech. The two provisions that they wanted included in our settlement agreement were:

A. I could never say anything negative about ServPro. I told their attorney that if someone asked me if I would simple tell them the truth that Servpro did a terrible job and they lost and damaged
several items of mine.

B. They wanted me to sign if I ever said anything bad about ServPro that I would agree to pay ServPro attorney fees in taking legal action against me. I told them if they wanted to settle this dispute, all they had to do was remove these two paragraphs and I would sign the agreement and we would be done. I had the cashier check that (this how they requested to be paid) with me made out to ServPro.

2. ServPro has been telling me for the last 5 weeks that they were going to send their repairman out to see if the damages that they did to my German coffee table, German Shrunk and German punch bowl set could be repaired. They have NEVER sent anyone out to see if these items can be repaired.

3. I spoke to a repairman yesterday and he told me that he would be unable to repair these items back to their original condition. I spoke to another repairman today and he also informed me that he would be unable to repair and restore these items to their original condition.

4. Since ServPro refuses to send their repairman out to see if he can repair and restore these items to their original condition, I am going to hire a Certified Professional Appraiser (her fees I am told start at $250.00 and can run more than $650.00) to see what the replacement costs for these damaged items will be. I feel ServPro should be responsible for any fees that she charges me. I am told that she will do research and then provide a professionally written report which also includes her credentials. I will send the copy of this report to ServPro.

5. All that I am asking for is to be reimbursed for my missing items and have my damaged items repaired. Any damaged item that can't be repaired I want full replacement cost.

6. ServPro didn't need to involve an attorney for a settlement agreement, we could simply have written out a simple agreement that this was PAYMENT IN FULL and had it notarized and been done with this.

7. I was giving ServPro a huge break with my generous settlement offer by not having them repair all of the items that they damaged and I was not being reimbursed for all of the items that they either lost or threw away and didn't include these items in their inventory list.

8. ServPro attorney told me that they had 90 days from 1 May 2019 to file a mechanic lien on my property. Based on this, my only settlement offer now if for ServPro to repair every item that they damaged, pay for every item that they either lost or threw away and didn't include on the inventory list that they sent to my insurance company and to reimburse me for the cost to hire the Certified Professional Appraiser and to receive full replacement cost for any item that was damaged and can't be repaired. For the missing items, they can either pay me for the missing items or they can purchase the missing items and give them to me. I have also contacted a Professional Cleaning Service and they will charge me $273.00 to clean the house the way ServPro was supposed to do (ServPro never even bothered to mop my house until after they had put everything back into my house, they never mopped under anything and never properly cleaned my house) but they are charging me for cleaning my house. ServPro can pay the Professional Service Company the $273.00 to properly clean my house (6 hours) or I can pay them and deduct this from the monies that ServPro claims I owe them. Either way works for me.

9. Once this is done, I am willing to pay them whatever the difference is in what they claim that I owe them.

10. I contacted Corporate ServPro yesterday after receiving a letter from Corporate ServPro telling me that they were told by ServPro that we had reached an agreement and that we had SETTLED this claim. I told them about the 2 provisions in the settlement that I refused to sign and now I simply want them to replace (or pay me the value) of the missing items and either repair the damaged items. Any item that can't be repaired then I want full replacement cost plus any cost associated with having to hire the Certified Professional Appraiser. According to the letter ServPro indicated to Corporate ServPro that they SENT

their repairman to my house to do these repairs. ServPro NEVER sent their repairman that they told me would be coming from Georgia. Some of the missing items in my opinion appears were intentionally thrown away. For example I had the complete Tudor DVD box set complete series. Now I am missing the box and missing several of the seasons. They were all in the collector's box. I have attached the letter from Corporate ServPro and a copy of the cashier check made out to ServPro showing that I was willing to take a loss on my damaged and missing items. I was not willing to give up my Right To Free Speech.

I was told by ServPro attorney not to have any direct contact with ServPro but only go through him. That is why I am contacting ServPro through the Corporate Office. I also have the DVD pictures showing the unprofessional job they did, showing where they failed to clean, threw wadded up wrapping paper (used for the dishes in the kitchen) that was thrown between my double chair and the wall in the living room.

In spite of everything I am still willing to settle this but not under the terms of their attorney. I am not willing to settle this for the $5,723.87 any longer but I am willing to settle this for whatever amount is left over after they do or pay for all repairs, all missing items and give me credit for any item that can't be restored to its original condition. Corporate ServPro told me yesterday that they would be contacting me in the next few days.

I was served yesterday with a Mechanic Lien. I have contacted their attorney several times (as directed to do so by ServPro attorney) and he has NEVER responded to me. I will fight the mechanic lien. ServPro still has never send any repairman out to see if the items of mine that they damaged can be repaired by their repairman. I have been told for more than 6 weeks that their repairman will be sent out by them. I will submit all of the evidence at the mediation hearing concerning the mechanic lien including photos of the shoddy work they did on my house.
