Servpro's IICRC Certified Technicians completed the dry out portion for the complainant, exceeding the drying standards set forth by the IICRC SWater Damage Standards and GuidelinesAll moisture detection and moisture monitoring was completed using industry standard equipment (such as penetrating and non-penetrating moisture meters, thermo-hygrometers, thermal camera, etc..)Furthermore the complainant is attempting to keep the funds issued by their insurance company for water damage repairs by requesting Servpro complete those repairs at no cost to the complainantServpro refuses to facilitate due to legal definition, principle and yes the complainant has been extremely volatile, hostile and threatening toward their own insurance company, assigned adjuster and Servpro personnelPlease consider the following, if Servpro did such an unacceptable job on the water damage dry out to warrant a Revdex.com complaint, why would the complainant want Servpro to then come back and complete the water damage repairs? Would it not be reasonable to assume the complainant would want a different repair company other than Servpro? The complainant could simply give a different repair company those funds issued by their insurance company to complete the water damage repairs, but instead the complainant wants Servpro to complete those repairs at no cost to them (allowing the complainant to "pocket" the funds issued by their insurance company)Also consider this, if the water damage was not sever enough to warrant the removal of saturated materials according to the complainant, then why did they feel they needed to file a water damage claim with their insurance company in the first place?Complainant stated in Revdex.com complaint, "serv pro was sent out to my home from my insurance company just to help clean up no more than gallons of water where my water feed line to the refrigerator broke and leaked"Servpro only removed affected materials that could not be dried in place or restored.Lastly the complainant completed Servpro's Customer Satisfaction Form at the end of the water damage dry out which the complainant give Servpro all 10's (highest level of satisfaction) and an 8, but nowhere did the complainant make any mention of property damage or excessive removal.Besides, Servpro's IICRC certified technicians exceeding IICRC SWater Damage Standards and Guidelines, the complainant also signed Servpro's Authorization to perform services which clearly states: [redacted] Provider’s performance of the Services is limited by, among other things, the pre-existing conditions and characteristics of the premises, material, fabrics, furniture, and/or other itemsPROVIDER EXPRESSLY DISCLAIMS ANY RESPONSIBILITY OR LIABILITY FOR ANY PRE-EXISTING CONDITIONSClient shall retain responsibility and shall be liable for all effects of and costs necessary to correct such conditions, including, by way of example and not limitation, the conditions identified below: (a) Provider may, in its sole discretion, pre-test materials for removability of spots or stains; dye or color fastness; shrinkage; fading; adhesive breakdown; or other problemsIt is not always possible to determine these conditions in advancePROVIDER DOES NOT GUARANTEE SPOT OR STAIN REMOVAL AND COLOR FASTNESS OR PREVENTION OF SHRINKAGE, FADING, OR ADHESIVE BREAKDOWN(b) Provider DOES NOT GUARANTEE that wall and ceiling cleaning will restore the original color to painted surfaces(c) Not all fabrics are conducive to cleaningProvider shall use reasonable efforts to advise Client of any adverse effects which may be reasonably foreseen due to the nature of the fabric or material involvedPROVIDER DOES NOT GUARANTEE THAT SUCH MATERIALS CAN BE CLEANED OR THAT THERE WILL BE NO ADVERSE EFFECTS FROM ANY ATTEMPT TO CLEAN SUCH FABRICS(d) A variety of materials are used in the manufacturing, upholstery and/or installation processThese materials include backing, lining, tacks, or other unknown substances that may cause discoloration or other adverse effects to the face materialClient acknowledges that it is impossible to determine when such adverse effects may occur and PROVIDER DOES NOT GUARANTEE AGAINST SUCH ADVERSE EFFECTS(e) Client acknowledges and agrees that mold is commonly found throughout the environment and that it is impossible to eradicate moldPROVIDER DOES NOT GUARANTEE THE REMOVAL OR ERADICATION OF MOLDPROVIDER SPECIFICALLY DISCLAIMS ANY AND ALL OTHER WARRANTIES AND ALL IMPLIED WARRANTIES (EITHER IN FACT OR BY OPERATION OF LAW) INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR ANY IMPLIED WARRANTY ARISING OUT OF A COURSE OF DEALING, CUSTOM OR USAGE OF TRADETHIS CONTRACT PROVIDES FOR THE PROVISION OF SERVICES AND DOES NOT PROVIDE FOR A SALE OF GOODSLimitation of Liability: IN NO EVENT SHALL PROVIDER, ITS OWNERS, ANY OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, FRANCHISOR, OR AFFILIATES BE RESPONSIBLE FOR INDIRECT, SPECIAL, NOMINAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL LOSSES OR DAMAGES, OR FOR ANY PENALTIES, REGARDLESS OF THE LEGAL OR EQUITABLE THEORY ASSERTED, INCLUDING CONTRACT, NEGLIGENCE, WARRANTY, STRICT LIABILITY, STATUTE OR OTHERWISE, EVEN IF IT HAD BEEN AWARE OF THE POSSIBILITY OF SUCH DAMAGES OR THEY ARE FORESEEABLE; OR FOR CLAIMS BY A THIRD PARTYTHE MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED THREE TIMES THE AMOUNT PAID BY CUSTOMER FOR THE SERVICES OR ACTUAL PROVEN DAMAGES, WHICHEVER IS LESSIT IS EXPRESSLY AGREED THAT CUSTOMER’S REMEDY EXPRESSED HEREIN IS CUSTOMER’S EXCLUSIVE REMEDYTHE LIMITATIONS SET FORTH HEREIN SHALL APPLY EVEN IF ANY OTHER REMEDIES FAIL OF THEIR ESSENTIAL PURPOSESome states/countries do not allow the exclusion or limitation of incidental or consequential damages, so the above may not apply to you[redacted] Servpro also has over photos documenting the water damage, moisture meter readings and saturated materials from the initial day of arrival to the final day of dry outPlease give [redacted] (Account Services) a call if you have any questions
