We have been working with and communicating extensively with Mrs. [redacted] to come to an agreed upon resolution. We have taken responsibility for the damage to her property and are working to finalize the resolution. The truck that damaged her property was a sub-contractor of ours,... for which we take full responsibility. Due to weather conditions, the driver was stuck in the driveway, and almost flipped the truck over. The driver refused to return the pod to her driveway due to safety concerns. Her belongings were packaged so well inside the pod that there was very minimal damage to the belongings themselves, but there was damage to her exterior landscaping from the truck, for which we have offered to repair. Mrs. [redacted] refused to allow us to make repairs, therefore, we have agreed to pay her to hire another company to make the repairs. I have never ignored inquiries from Mrs. [redacted] nor American Family and have always responded promptly. We have already paid Mrs. [redacted] $2,400 for the damage and we are hoping to reach a final agreement in the very near future.

Here is what I have requested from Servpro (in black) and their response (in red), then my response in black again.
I had also included pictures of the damages for them in my original email to Servpro.
 
10 Pavers and 10 flagstone stepping stones damaged by drywall being thrown on top of it. $ 250 – Stone does not get damaged by drywall debris.  Cleaning is appropriate here.  Based on your hourly rate of $49.42 make me offer on your suggested cleaning option including what kind of cleaning agent, I am not aware of anything that would take drywall out of stone.
Pavers and flagstone need to be replaced and reset by landscaper. $ 250 – I believe I saw a photo of one cracked stone, which may or may not have been pre-existing.  However, we will replace the one stone that was damaged and pay to have it reset.   I sent pics of 4 broken flagstones, I can go ahead and photograph all of them including all the stained pavers if you prefer.  
7 solar lights that were trampled on $ 100 – None of the solar lights appear to be damaged in your photos.  The solar lights were charged by a separate solar panel, the attached cords were ripped out, some of the actual lights are broken. (I sent pics if you recall)
Rockwalls in rock gardens kicked over need to be reset $250 – This would take approximately a half hour. That is impossible, but If you would like to come over [redacted], and set these in half hour, you are more than welcome.
Porch swing was moved from porch into the open and got damaged by weather (moisture) and drywall, needs replacement $400 – This item was outside prior to Servpro arriving on site.   Weather and wear is to be expected on items like this, therefore I do not feel the weathering of this item is our responsibility. The item was hanging under the porch, protected from the elements. Servpro unhooked it and set it out in the open, that is where the paint started peeling and wood got moldy.
5 large 20 foot aspen trees were broken or uprooted from being run over by pod/truck $ 2500 – You accepted payment to replace these trees already.   I accepted a payment of $2400, that is $100 short for the trees alone.
Gate, gate posts, fencing damaged and run over by pod/truck needs replacement $3200 (as per my contractor) – You accepted payment per our estimate for repair, on this, as well. Your $2400 payment (as I stated above) does not even cover the cost of the trees, let alone the gate, posts, fencing.
5 large lavender plants, 5 russian sage plants, 1 small pine tree ( 3 feet), run over (did not regrow) $300; replanting by landscaper $250 – I have zero documentation on this. If it was run over by a truck that size in the wintertime, how do you want me to document the non existent regrowth???
Trash was left under porch, drywall scattered all over yard. Needs to be removed and yard cleaned up, leftover drywall needs to be covered with garden soil  $500 – This would take approximately an hour plus the cost of garden soil.  Please be realistic!
 
Based on the above information, Servpro would be glad to provide a technician at no charge to perform the services above.  No thank you. you really expect me to trust your  people after all the damage they did to my property, not to mention leaving the door unlocked and wide open on several occasions, even after I confronted your lead guy Kevin about it????
 
If you will not allow a Servpro employee to perform the above items, we will offer to pay for 3 hours of a technician at $49.42, totaling $148.26, plus the cost of one paver and garden soil (approximately $20), for a total of $168.26. Please see my comments above. As well as my calculations from the last email. And please make me a realistic offer, otherwise don’t waste my time. We can go to court over this if you prefer.
