Legally, we have no responsibility to return the $application fee. The application by Ms*** was made prior to the receipt of a reservation deposit to hold the property for which Ms*** applied (Park Terrace Lane). Receiving multiple applications for the same property is
legal as is the process by which our company qualifies applications. When a deposit was received later the same day of Ms***'s application (which we had already processed and incurred fees), we did ask her if she had interest in any of our other available rentals, but she did not.We did appreciate that Ms*** was interested in one of our rentals and we appreciated her potential business, therefore, we have placed in the mail a check to her for $40.00.
