Complaint: [redacted]I am rejecting this response because:
As stated in my previous letter, I do not appreciate being threatened with a lawsuit simply because I questioned the workmanship of Setzer Construction. I have no reason, or personal motivation to "slander" or make fraudulent statements about Sezter Construction. I am simply looking to avoid continued damages to my house and do not want to pay, once again, for a job that was done improperly, and that carried a 5-year warranty.

Complaint: [redacted] I am rejecting this response because: Setzer Construction did not stand by their 5 year warranty and is now making accusations that I am only seeking "personal gain" and threatening legal actions if I do no “cease and withdraw any and all complaints”. I do not appreciate being threatened and bullied simply because I questioned their workmanship. I am not seeking compensation for the damages that Setzer Construction alluded to in their letter (i.e. rust). I am concerned, however, about continued water damages on the ceiling in an additional room in my house; an area that I have not done any repairs, and can therefore not be attributed to any actions on my part. Additionally, Setzer Construction stated in a recent letter that I was “yelling and screaming and swearing obscenities and making threats” during a recent telephone conversation, which is entirely false. I did tell Mr. S[redacted] that my roof was continuing to leak, and informed him that I was not pleased with his finished product, to which he reported that he had done all he could on the roof. I then told Mr. S[redacted] that I would like a refund based on the warranty and his failure to meet his contractual agreement, to which he refused. I told Mr. S[redacted] that I would turn the matter over to small claims if he was unwilling to stand by his contractual agreement, to which he respond “you do that” and abruptly hung up the phone. Also, Mr. S[redacted] stated that he would “VOID” his warranty if a contractor has “been on the roof” or if I hired another contractor to do repairs. I do not have any signed documentation agreeing to this condition, but need to have another opinion about the condition of my roof. This, therefore, creates a double-bind, or a catch-22 because Setzer Construction is unwilling to stand by their 5 year warranty and allows no option to seek another opinion. I do not appreciate being called a liar, nor do I appreciate being threatened with a lawsuit simply because I questioned a company’s workmanship, and asked them to stand by their warranty. I am, therefore, not seeking “personal gain”, but would like to avoid continued damages and additional expenses due to the matter being delayed, and the company’s refusal to stand by their warranty. I have attached a copy of the certified letter that I have sent to Mr [redacted]. The letter should explain my position regarding this matter. Mr [redacted] has flat out lied. I believe the letter explains the issues and the reaction and problems that have occurred. Please let me know what I need to do...

to resolve this issue.

It would be advisable for you to cease and withdraw any and all complaints you have or intend to have regarding this matter. I have been advised that I have grounds to file suit against you for slander and fraud due to the lies that you are perpetrating in order for personal gain.Setzer Roofing & Construction LLC did the repairs on your home as specified in the contract. At the time we bid the job you had already torn the ceilings and insulation out in your living room and had installed a clear plastic in place of the ceilings. (Possibly to make the insurance pay more) After completion of the roof repairs you contacted us and stated that the roof was still leaking we went to your home several times and could not find any problem, although we did add more roof cement and covered everything that we thought might possibly be a problem. During each of these trips to your home we met with your parents. None of us could figure out why it leaked at random and was only small drips on the clear plastic yet there was no evidence of where the water could be coming in. In fact, the last time that I was at your home I ran a water hose on your roof for over 30 minutes with no leakage. It was determined that the clear plastic you installed in your home was building up condensation on the interior of the metal and on the plastic. Your mother was concerned early on about the rust occurring on the interior underside of the metal roof. I do not do interior work. You kept that plastic up for months allowing rust to occur on the underside of the roof. Further more I did not hear from you all winter and into the spring. In June I was at the lumber yard and saw your father, he stated that you were still having a problem, I offered to go right then to your home, your father called you and you said you could not do it then but would let us know when you would be available. I did not hear from you again until the Middle of August. At that time your mother phoned me and I was speaking with her about when I could come. I told her that I would come up there do whatever I could and that if needed we could request that the insurance send someone out. (I do not believe that the exterior roof is the problem, I believe  the metal has rusted from the inside out due to the condensation caused by your actions.) During this phone call with your mother I could hear you yelling and screaming and swearing obscenities and making threats I am a business man and expect people to give me the same respect I give them.  At NO time have I, or anyone from my company requested more money or not offered to stand behind our work and the warranty. I offered to come and take another look and I was still willing to try to work with you, your parents, the insurance company, or whomever to help you figure this problem out. But I will not tolerate threats and vulgarity towards myself, or anyone associated with my company.  I do not do interior work but I do know that if you installed insulation and it was not the proper R rating it could also be causing more condensation, therefore you need someone whom is qualified in interior repairs (insurance companies have qualified people) to look at this. It is not the Insurance companies or my responsibility to repair problems that you have created by taking matters into your own hands without the knowledge or the skills necessary to complete the repairs without causing further damage. You also stated that you have another contractor willing to do repairs on the roof. If that contractor has been on the roof area to do repairs that also VOIDs your warranty as stated in your contract.
