Shaker Management has responded to all complaints, unfortunately there are third and fourth parties involved with the decision making process I have spoken with the tenants and explained this to themThey are great tenants unfortunately some problems require a little more time for a resolution

The tenant moved in and moved out within days...stating to his Realty USA agent that he was moving in with his grandfather because he was pulled over and the police took his license so he needed to move in with his grandfather to have transportation to and from work Shaker Management was never notified of the tenants "black mold" issues until several phones calls to him went unreturned The tenant was reminded that according to his lease he should have notified us of a problem before abandoning the property There is NOT black mold in the property The property was not vacant for years prior to him signing a lease The property was vacant a couple of months as the entire apartment was painted and new carpet installed which in his days at the apartment the tenant managed to leave stains James was never hung up on, quite the opposite he hung up on me after demanding his deposit be returned when I tried to explain to him he signed a legally binding contract when he signed the lease for a year, and according to the lease he needed to notify us of a "potential problem" and give us an opportunity to correct the problem if there had in fact been a problem before abandoning the property I believe James is using the "black mold" as an excuse as he stated to his Realty USA agent he was moving in with his grandfather because it was more convenient

The amount disputed is for a PRO RATED portion of the carpets being replaced due to the fact that the tenants cats had used the carpets as a bathroom along with the sun room, which also needed to be professionally cleaned as there was still stains from the cats on the floor The tenant had the carpets professionally cleaned and the smell and stains were still present Therefore the damaged carpet needed to replaced and as per the tenants lease he was charged a pro rated portion for this replacement

The stairs were completely rebuiltThere have been numerous attempts to gain access to respond to the many complaintsThe complainant is not even on the lease for the property and insists we only deal with himThe last time the contractor contacted the legal tenant to schedule a time to complete
the cosmetic repairs from the stairs being rebuilt, the complainant called back and he was told he was not allowed to do the work unless he was accompanied by myself to watch him work, this request is unreasonableAnother message was left with the tenant this morning to try to schedule a time for the contractor to complete the work The contractor was instructed if he is harassed in any way by the complainant or the legal tenant he is to leave

SM mentioned a fee for cleaning a sunroom. I want to make it very clear that I am NOT disputing this charge. I am also not disputing the need for replacing the carpet. What I AM disputing is that they charged me far more than is conventionally permitted to do so. Carpets have a finite life span, and it is widely accepted that landlords a) cannot charge for replacement of carpet that is past this expected life, and b) must pro-rate based on the remaining expected life. This, I contest, SM is not doing. They are reportedly charging 75% of replacement cost. This is only appropriate if the carpet was a) brand new when I moved it (it wasn't), and b) had an expected life of 20 years (doubtful). Moreover, SM is CONTRACTUALLY REQUIRED to provide documentation to such effect. This is now the third time they have declined to provide said documentation. By refusing to either provide the required documentation or return my security deposit, SM is in breach of contract. Absent the above conditions holding (unlikely), the amount they are witholding is also not appropriate.
