January 12, the prospect called our office and an appointment was made to visit our community on January 17th The prospect and her uncle actually came to the property on January 14th and toured [redacted] ***(Guest card attached)At this time they were given our brochure which also contained an information sheet (attached) that lists the floor plans, pricing as well as pet policies, deposits, and other fees On this sheet it clearly states that the application fee and reservation fee are non-refundable They were contacted on January 15th as a follow up to the tour, the prospect stated she would like to keep the appointment for the 17th to apply for unit The prospect went on-line and applied for the unit on January 15th at 9:pm and paid the application/reservation fees at this time When I came to work the next morning I had emails that they had applied and paid the fees – I relayed info to leasing agent The prospect and her uncle did come in on January 17th and brought proof of income and that time the leasing agent completed a Cash Settlement Statement (attached) that gave them all the information such as address, move in date, fees as well as showed that an on-line payment had been made on the 15th The prospect and her uncle both signed the form – this form also clearly states these fees are non-refundable Regarding the landlord verification, we are unable to verify rental history with family members unless there is a legal Lease AgreementWe did however verify with her previous landlord her rental history Information received from reporting agencies led to rejection of application The leasing agent notified the prospect of this by phone and that a rejection letter would be sent via US Mail We do not owe the prospect a refund as she was made aware on more than one occasion that the fees are non-refundable Sincerely, [redacted] Commun
