Voluntary Petition which was prepared at her request upon retention of our services to proceed with a Chapter 7 Bankruptcy. Per your review you will discover that it is forty-seven (47) pages in length, complete in its entirety, and has been ready for filing since 2013.Further, as I addressed in March 16, 2015 e-mail the Petition is unique to the Client just a tax return would be unique to any individual filer, and therefore cannot be utilized for any alternative Client needs. Additionally, as specified in the applicable Contract for Legal Services the Petition preparation constitutes 75% of an attorney's time in such a matter and therefore if a Client chooses not to proceed with their case after this occurs, we retain that same percentage of the total legal fee for services rendered, which is what occurred in this situation.That being said, as I equally addressed in my March 16, 2015 e-mail, when the Client indicated she needed money to repair her home which is why she requested a refund, we offered to file the case for just another $100.00 payment on account and thereby waive the remaining $330.00 due. However, the Client instead demanded full return of the money paid which precipitated her complaint to your organization when we explained that a portion of the fees must be applied towards services rendered.That being said, previous to making her complaint to your organization the Client confirmed by telephone that she was in possession of the Contract for Legal Services and available receipts for payments remitted on account. Therefore, in light of the circumstances I believe it would be appropriate for you to request that she produce her applicable copies at which time she can equally point out whatever issues she has with the same.
