Shamrock Construction of Virginia

Review: I started construction with Shamrock Restoration, own by [redacted] located in [redacted], Virginia [redacted] of March 2013. The company was referenced by [redacted]; a third party liaison design to assist both U.S. Military Active and Reserve members or spouses with reliable contractors around the community. The completion date of September 30, 2013 was not met as mentioned in the original contract. The delay was mainly due to inexperience engineers within Shamrock; plans repeatedly did not meet [redacted] County Standards for permit to built. Deadline was extended to November 28, 2013. Shamrock once again did not meet the timeline. Rather, decided to change project manager without prior notification, new manager is [redacted]. The sudden changes again caused more delay on the project. A requested new completion date of January 17, 2014 again was not met by Shamrock. No progress was made between November and January even.

With the help of my legal attorney and [redacted], we came to an agreement of February 15, 2014 as the new and last deadline for the project to be completed. We are one day short from the suspense yet items on the punch list is either completed with extremely poor quality or not at all.

[redacted] County inspection failed due to Shamrock poor staircase design and has yet to pass as of today. We are no longer interested in doing business with Shamrock Restoration since the company has breach the construction contract and are in clear violation of 18 Virginia Administrative Code (VAC) 50-22-260, which prohibits: (1) negligence and/or incompetence in the practice of contracting; (2) the unjustified cessation of work; (3) any intentional and unjustified failure to complete work contracted for and/or to comply with the terms in the contract; (4) any failure to obtain a building permit or applicable inspection, where required. Pursuant to 18 VAC 50-22-200 such violation may result in the Board for Contractors ordering fines, remedial education, or revoking or suspending of contactor’s license.Desired Settlement: This is a $274,802.22 project. There is several unfinished work but the most important work uncompleted are the stairs and band board around the house. My intent is clear and has been communicated with Shamrock. We are asking for the following below be refunded by February 20, 2014 in order to avoid further delays. This has caused an enormous unnecessary stress for our Family, both mentally and financially.

Unfinished Items:

1. The whole stair railing is wrong; posts are installed incorrectly with damage materials and improper alignment. We are asking for a FULL REFUND for the stairs - $8,572.59. That will be spent on hiring a new contractor for a new staircase.

2. Install WHITE PVC band board over brick and around home as shown in original layout, we are asking for a HALF REFUND for the band board - $4,172. That will be spent on having another contractor finish the job.

A total refund amount of $12,744.59 is expected from Shamrock by February 20, 2014 to close the contract. No further extension will be given since the project has long passed the deadline back in September 30, 2013 with three incomplete extensions.

Both were not executed correctly. All supporting documents will further go into details of what has been mentioned here.
