Dear Revdex.com, I am writing in response to a complaint made against me involving a former tenantID [redacted] I never made a verbal agreement to use the tenant's security deposit as last month's rentThe lease is a Stark County Board of Realtors lease which I use because it spells everything outIt states very clearly in blue ink that the term of the lease ran September 1, to September 1, I changed her rent due date to the 5th of every month because she explained she may be late in the rent, due to when her child support is receivedI did not want her to accumulate late fees nor I looking for the rent on the 1St and it not being thereI did this to accommodate her situationShe was late a total of five times and every time had an excuseI let it go the first time November which was in the third month she lived there as she stated it got lost in the mailI explained that was the only time I would let it go and any future rent received after the due date would assess the $late feeTherefore the other four times May 2014, August 2014, May and July I did in fact assess the late fee and she did pay itI called her on the due date if it was not in my mailbox so she had the opportunity to drive it to my residenceShe took it upon herself to use her security deposit as last months rentI explained that was not our agreement and her rent was due as stated in her leaseShe apologized and stated she misunderstood, give her a couple days and she will see what she can doI was holding a check from the previous month when her rent was late, she mailed that after the fact and stated the other got lost in the mailI received the checks within a day of each otherShe told me to hold onto the second check and cash it on the 5th of the next monthJuly 31, she asked me what the check number was, when I got home on August 3, I text her the number and did not think anything about itI also asked if it was okay to cash the checkWhen I received her notice to vacate later that day she stated she misunderstood and the money is not there at the moment but she would see what she could doAfter asking several times to cash this check that is when she got hostile and made accusations about a verbal agreementRealizing she was not going to work with me, mid month I went to her bank to cash the check and she had stopped payment on itI asked her to leave by the first of the month, there was no forcing, she had not paid her rent and her lease stated the first of the monthShe told me she would be out August 31, She text me that morning and said it would be the following dayWe were supposed to meet there on September 1, at 9am to turn over the keys and do a final walk throughShe chose to leave the keys on the mantel and not show upI had requested a forwarding address several times and she had not given it to meThat is yet another agreement she chose not to fulfill as per her lease she is required to do so.? As to the condition of the property not only is it safe but was given to her move in readyThe house was clean and everything working properlyThe small fence had a? board that needed replaced due to neighbor's dog but certainly not a safety issueDoor locks were purchased and installed brand new for herPlumbing is all copper with newer faucetsCentral air works just fine as we had both the furnace and air serviced for the new tenant, no issuesWe had a tree removed prior to her move in date and the pipes cleaned due to tree rootsShortly after she moved in she did have a very small back up in the basement and we had a professional company out the same day to fix the issue then no other problems sinceA week before she moved out her boyfriend was at the house and stated there was a bee hive by the front doorMost tenants would buy a can of $spray and take care of the bees, which is what we did the day she moved outThat door was barely used as she actually came in and out the back door by the garage which I am assuming is why she didn't take care of it or mention it sooner.Per the lease agreement the tenant is responsible for all utilities including the water billUnfortunately the water is a bill that attaches to the property not the tenantThis tenant has left me with a $balance that is her responsibilityI did go to the water company with her and I did believe there was an error that I did not want her to be held accountable forMy husband who is a licensed plumber as well as the city went to the house several times to make sure there were no leaks inside or outside and there were notNot even a dripBut after meeting with the water department they explained it was her responsibility to send in readings while the water meters were being replacedShe failed to do so and paid estimated bills for approximately eight months which is how her water bill became so highI sent her a certified letter with documentation from the water department in regards to her bill, she refused to sign for the letter and the letter was returned to meAs for making threats to harming a professional at the water department that is just ridiculous and yet another fabrication.The tenant has left me with a messCandle wax on the carpet, hardwood floors and baseboards, deep scratch in the wood floor, a dented and scratched refrigerator, broken window, one ripped screen, stickers on walls and windows, flower beds over loaded with weeds, and a whole lot of dirtI did not receive this house back in the same condition it was given to her inPlus I was left with a gas and a water bill.There were no ongoing issues, no advertising, no threats etcAs a matter of fact there were no problems in her two years as a tenant until she decided that she was going to vacate and not fulfill her contractual obligationsI think it made her more upset when she could not manipulate and lie into getting her wayI have documentation to back up every statement in this letterI purchased my first rental approximately fifteen years ago and I have the same tenants in that unitI have very little turn over in my rentalsMy best guess is that she is attacking me so that she had something in writing to give to her loan officer / new landlord so that they would not contact me for a reference
