Eight weeks after signing contract the pool is removed. Was never informed of this before I signed.
On April 4, 2018 I signed a 1 yr contract with Shapes. Before doing so I mentioned I was coming there for the swimming pool. I specifically said to the young lady who handled my contract that now I would be able to get the exercise I needed without straining myself due to the buoyancy of the water and that I was not interested in the equipment or classes. On Thursday May 31, 2018, not even 2 months into my contract Shapes gave us a letter stating that the pool was to be permanently closed in 1 week, June 9. I asked Chelsy and another employee what were my options...could I get some money refunded so that I could join another fitness center that has a pool. I mentioned that I felt I was being forced to accept the type of exercise THEY felt I could do. Chelsy said no and that I needed to talk with Mary, the owner. I did so on Monday June 4. I mentioned to Mary that due to my having Multiple Myeloma, a bone marrow cancer, I would not be using the floor equipment since my bones are fragile and at risk at fracturing. I asked her if I could get the balance of my contract that I paid in full or have my contract transferred to the Brandon, FL Shapes since they have a pool. She said no and mentioned that, in time, even they would be closing their pool...although Lauren from that facility called me on Saturday,June 2, assuring me that they were not. I told Mary that that was too bad and not right. I did not get the names of the other women who signed contracts even more recently than me and have been cheated out of pool access. The Jacuzzi has been cool/luke warm at best for nearly 2 months. The sign that was displayed stating they were waiting for a part to have that fixed was nothing more than false. Were they really planning on spending money on something that was soon to be removed? There are so many women there who see this for what it is...a bad business practice. Many of these women are older and come there through the Silver Sneakers program. Some mentioned even getting charged for June despite the fact that they will not have pool access. I did tell Chealsy that if I had know that the pool was going to be closed in those few short weeks I would never have signed a contract. They would never have gotten my business. I'm 60. I don't need to be forced into exercise that jeopardizes my bones. On 7-15-18 I'm scheduled to have another 31.03 debited from my card they have on file to cover "Club Annual Fee". That's not even right. I will not be using their facility after tomorrow, June 7. Worse yet, if I refuse to pay this, will it mess up my credit report? That would just be wrong! I have now joined LA Fitness which has a pool. This is an added cost that I did not expect to pay out when signing on with Shapes. It truly is a shame and a scam to sign people on knowing that kind of a change was in the making. I work hard for my money only to have others...Shapes...work just as hard to steal it. I'm truly disappointed!!!

Desired Outcome

Recognize that we are not all young and energetic. We are at an age where we know what we would like...and not like...to do. Do not belittle us as if you know so much more than we do. The new classes/equipment that will be replacing the pool *** work for some people. Give consideration to those of us who have age and medical issues that we deal with on a daily basis. For so many of these women this was their one chance in the week to not only safely exercise but to enjoy the social atmosphere there. Instead of bringing in more equipment develope a program that can safely include older...heavier...sicklier women. Consider keeping the pool open...or perhaps reopening it once you see that the younger people have left while the older ones would have stayed for the simple fact that we really did enjoy the pool.

As per all members' contracts, it is stated that any amenity can be changed or deleted from the facility at any time. Shapes Temple Terrace is upgrading to a Premier Shapes club. The Premier model does not include a pool or whirlpool. The Premier model includes functional training equipment to better accommodate are member base. The half million dollar renovation should be completed in a few months. The club is open and all staff is assisting members to give them the best workout for their needs. Thank you

Customer Response • Jun 25, 2018

I did read Shapes response to my complaint. My issue was never about Shapes becoming a Premier Club. I understand their wanting to stay competitive in their field. My objection is with the deceitful way I was led to sign a 1 year contract with them. Why all the secrecy? Why not be up front with me - and the many other women who signed 1 year contracts with Shapes - that the pool was going to close in a matter of weeks? Even if Mary didn't know for sure ( which she specifically told me) that they were going to move ahead with the renovation and that the pool was going to be closed permanently, why not divulge that bit of information to me before I signed my 1 year contract with them? If I had an inkling that that was even being considered...I would not have signed up with Shapes. That is my biggest disappointment with Shapes. I lived up to my part of the contract by paying it in fulll. I was deceptively fooled by Shapes into thinking that I had found a pool in which I would be getting my needed exercise without compromising my bones that are already at a weakened state due to my 4 year battle with Multiple Myeloma - a bone marrow cancer. There is no compassion *** Shapes response letter. It reads like a cut/copy/paste segment from the standard contract. I would like to think that a persons conscience would prompt them to do the right thing when they know that they have conducted themselves in an unscrupulous manner. It would be a decent gesture on the part of Shapes to refund the remaining 10 months membership I have with them which would assist me in paying for my new membership with another gym that I've joined.

Thank you for allowing me to respond

Shapes Fitness For Women Temple Terrace Response • Jul 08, 2018

One of the reason's that we are upgrading to a Premier Shapesis due to our increasing number of senior members. We are getting a new line of functional training equipment and adding active aging classes to the schedule. We have a great positive response from most of our aging population. In addition, we will have an infrared sauna, which is GREAT for everything from anti-aging to arthritis.

Thanks

This location continues to put me in collections (3rd time now) after closing the account. The amounts and dates that the account was open is wrong
I originally joined Shapes in 2013. I moved shortly after to south Tampa. They said I didn't need to transfer my membership. The south Tampa location closed and they wouldn't cancel my membership because it was in temple terrace. I lived out of the range and sent paperwork to prove it but they never canceled the membership. Since they have put me in collections, then it closes. Then they get a new creditor and put me back in collections. The account was closed and now they put me back in collections with a different amount of money and different date of opening the account. I feel like this is harassment on their part. Is this allowed?

Desired Outcome

I want to stop being put in collection every time they get a new creditor with the wrong amount and dates. This account has been opened three times now and closed two times.

This is the third time you have sent me to collections after it has been closed two previous times. How can you continuously put me in collections, when my account should have been canceled when the south Tampa location was originally closed because I loved too far. This is a deeper issue then you checking to see how much I owe. Your business is unethical and never followed through on their end.

Now that I have found *** I can look into the money owed on the account further. I will respond with the exact amount after I review with billing and credit companies. Thanks

The gym continuously has contract issues with customers because of their deceptive nature. Their behaviors are extremely unprofessional.
For people who encourage women to stay healthy and stay in shape, they sure do a good job at making them not want to come to the gym at all.

On 10/23/2017 I went to the gym Shapes, a women's only gym. When I came to sign up it was always my intention to sign up monthly. Never in my conversation with the manager, Mary N., or upon signing the electronic pad was I told I was signing on a 12 month contract. I went to the gym for months, and paid more for personal training and for a health seminar. When I was not able to go to the gym anymore and went to tell them to stop automatically charging me monthly in late January early February of 2018, I was shocked to find out that they made me sign on an electronic contract without ANY mention of it beforehand. My contract was from October 2017 to October of 2018. I am moving in May of 2018. Why would I have consensually and knowingly agreed to sign the contract. Mary, the manager, who sat and negotiated the price of signing up for the gym, told me she was giving me a discounted price because I was a college student, not because I was signing up for a contract. I explained how I was not informed and would like to cancel my contract. Mary refused and kept insisting she had informed me. Her solution as she smiled, "Wake up at 5AM." She also said she's been running this business for years and that "all gyms do it that way." Gyms do contracts. Gyms do not lie to customers.

Later that day, I was speaking with my friend about how bothered I was with their treatment. I was shocked to find out they have done this to so many other women. My friend informed me she read their Yelp reviews and saw that other women also faced similar issues with Shapes in Temple Terrace. So I called back and spoke with Kelsey, apparently also a manger. I explained the entire situation and informed her that I already did speak with Mary. I also informed her that after reading the Yelp reviews I knew with certainty that no, Mary did not inform me about the contract and that it wouldn't have made sense to sign it since I am leaving in May. Kelsey said I can come in and she'll fix the issue for me. I need to show two proofs of moving and either pay half the remaining balance, or a fee of around $150.

I went in one day and found Mary, I asked for Kelsey and was told she was not there so I left. Mary realized what I was coming in for spoke and without a doubt, had spoken with Kelsey by the next time of me coming in. When I came in again, both Mary and Kelsey were present, and Kelsey approached the situation in a completely different manner than what we have agreed upon on the phone. It was very clear to me that Mary has told her not to cancel my contract EVEN though Kelsey told me she can and she WILL on the phone. Even more clearly when Mary walked up to Kelsey right in front of me, whispered in her ears as they both smiled nonchalantly, and Kelsey whispered back, "Yes, don't worry." On top up what they have done, they have excellently managed to be rude and non-professional. They truly took great pride in what they were doing.
Additionally, they were clearly able to cancel the contract but preferred to suck money from me and other ladies that they have done this too. It was not as if they were going to cancel it for free. I would still have had to pay $100+ extra to cancel the contract.

Kelsey took my ID that had the address of the place I was moving to in order photocopy it. I informed her I did not have any other proof of moving since I was moving in with family and nothing else had my name on it with the address accept that ID. After copying it she said she will show it to the manager and he will confirm the information. Then she continued to inform me she will not cancel my contract, as if I did not see it coming. I was shocked of how they could be so deceiving, and it upset me. I told her I did not understand and that we have already agreed to cancel it. Kelsey continued to talk about how she spoke with Mary

I was very upset because I already informed Kelsey of everything that happened from A to Z. It was not as though I did not inform her of having already spoken with Mary, so for her to change her mind had no justification. I asked Kelsey to have the contact information of this man (who is also apparently a manager) so I may speak to him. She denied to give me his information and said he will call me. On 2/13/2018, I get a call. It was Mary. Talking so nonchalantly as if she has done nothing unjust, she said, "Yes, I'm the manager. You wanted to speak with me." At that moment, it was clear they were playing with me, throwing me back and forth wasting my time and my energy. When I told her I specifically told Kelsey I wanted to speak with this other manager that owned the place, she said, "Oh, you mean you wanted to speak with my husband?". I realized it was going nowhere with them. They reply to angry members on Yelp about coming in and fixing their contract issue. Yet, when I went in multiple times and called, I was treated very unprofessionally, poorly, and deceivingly. I am disgusted that a gym promoting female health manipulates women and negatively effects their well-being to this degree. I was so depleted from the entire situation and had so much to focus on in my last semester at college, I did not want to waste my time nor energy on them anymore. I had to look somewhere else.

Shapes Fitness For Women Temple Terrace Response • May 05, 2018

When a member signs up at Shapes Fitness for Women they are told the terms and conditions of their membership agreement. Immediately following signing a contract an email of the contract signed is sent to the member with all of the terms and conditions of the membership. There is also the consumer's 3-Day right to cancel. If a member wishes to cancel due to relocation, as per the contract it is a $150 fee or 50% of the remaining balance-whichever is less of the two amounts-- once two proofs of relocation are submitted to club if there is a reciprocal club to go to. If no reciprocal club to attend, then the fee is $75 or 50% of the remaining balance--whichever is less of the two amounts.

I paid for a 2 year membership after being assured that if I moved due to PCS oract started in Oct 2015 and I was unable to work due to hip surgery from Feb-Oct 2016. When I called to let them know they said my only option was to freeze my account. Subsequently my husband received orders to Jacksonville. They said that I could freeze my account or drive 37 miles from my membership to go to a gym they are partners with. When I signed up, they assured me if a gym was unavailable I would receive a refund. Each time I contact the gym, I am told that *** H.(the owner will contact me) $628.84 and a year later and I have not received a return call. I have talked to the manager Kelsey at least a dozen times.

Desired Outcome

I would like a pro-rated refund

Shapes Fitness For Women Temple Terrace Response

joined Shapes 10/28/15 for 2 years. On 1/19/16 she put her membership on freeze due to medical reason. On 4/15/16 she called the club to get transfer information to Jacksonville due to re-location. She was given the information and said that she will transfer her freeze time and the rest of time left on membership to that location. On 11/29/17 Kelsey, the manager at Shapes returned her call requesting a refund. The membership expired prior to this phone call. I called and left a message on 11/30/17. I have no record of any calls other than the above. According to the notes, the member said that she would transfer her membership to the club in Jacksonville and I had not heard from her since. Thank you.

Customer Response

(The consumer indicated he/she DID NOT accept the response from the business.)
Contacted the club several times. I have written down October 12, 2016. I explained about time that Clive was 30 miles away. I was told that I needed to use the Jacksonville club because there was a club close enough to me. I asked for call back from the owner. And was assured that I would read receive a call back from the owner. In January of this year, I received a bill from Shapes. I explained again that I live out of the area. They said the only option was for me to pay to renew my membership or paid $31 or the freeze no longer applied. I explained my husband received orders to Jacksonville and I could not work out at the location in Jacksonville. They said I needed to pay the $31, so I again had to pay $31.03. At that time I requested a call back from the owner again. I did not receive a call back. I called again when I received my credit card bill on February 12. I left a message again requesting a call back. I did not receive a call back. I had a reminder that popped up to contact the Jim on April 12. I left another message. I received an email requesting another payment from the gym and I called in both October and November and explain the situation and was told I would receive a call back. The only time I have received a return call was in November.

I had a no fee contract with the Shapes Fitness Center and now they are trying to charge me a monthly fee.
I became a member of the Healthways (Prime) fitness program which was offered to me through my health insurance provider Blue Cross and Blue Shield. I have been member since 2015. Through this membership you Healthways a monthly fee and in return get unlimited access to a group of fitness centers. I had a membership with the Shapes Fitness Center but let it expire after getting the membership with Healthways. I presented my Healthways card to the Shapes Fitness Center and they accepted me as a member with a no fee contract. On July 1st, I went into the Shapes facility and they had a sign posted about silver sneakers members having to pay a fee. I'm not part of the silver sneakers program but they group us all together. I ask the associate behind the desk if I had to pay before I could attend the class that day. She said I would need to pay $10 a month to have full access to their facility on a monthly basis. She said if I didn't pay, I could no longer attend any of the classes and would only have access to use the weights. She also wanted me to leave a credit card on file so they could debit my account. I told her I would pay the $10 since I was already there for
a class. I was under the impression that I paid for the month of July.
So I came back maybe 3 or 4 times to the facility. I did not attend anymore after July. All the times I entered the facility no one stopped me or said I couldn't use the facility because of an outstanding bill. I received a bill in the mail around July 27th with a July 16th fee of 15.70 and a July 26th late fee of 9.50 and another charge for August 15th or 15.70. I went into the Shapes facility to try and get this resolved but they told me I used the facility and attended some classes in July and this is my bill. The associate stated that she told me this information on July 1st. She then stated they would change the amount due to $10.70. I told her I wasn't paying because I never signed a contract agreeing to this charge. She stated that "I guess it will just go on your credit". I called the billing office and it still shows $40.90 as the amount I owe. They have been calling and harassing me through phone calls and text message about this bill. I don't know what else to do.

Desired Outcome

I want them to remove the 40.90 outstanding fee on my account. The agreement number is XXXX-XXXXX

Shapes Fitness For Women Temple Terrace Response

Member came into club on 7/1/17. She was informed of the new policy and given the option of paying $10 plus tax or $10.70 for the month of July or to pay just for one class. Member said that she would pay for the one class and said that she will not be taking anymore classes that are not included in her membership. Member used the club and took classes on 7/6/17, 7/13/17 and 7/15/17. So, instead of billing $10.70 for each class (which is what the price is for a class not included in membership) Shapes just billed her $10.70 for the month. The balance on her account is $10.70.

Customer Response

(The consumer indicated he/she DID NOT accept the response from the business.)
I dont agree completely with what the response was from the business. It was not explained to me about paying 10.70 a month or 10.70 for one class. If that were the case, why did they only require me to pay on July 1st and not the other days I used the facility in the month of July. Normally they would stop you at the desk and make you pay before using the facility if you did not have a contract. Every time I entered the facility my card was scanned. I will pay the $10.70 balance only because I'm tired of being harassed constantly. I have been a loyal member for this business for over 10 years and I'm disappointed with the way they handled this whole situation.

Shapes Fitness For Women Temple Terrace Response

Since the member was given the option of paying for the day or paying for the month(either way it is $10.70) on July 1st, entering again in July would mean that she wanted to pay for the month, so that is how it was set up. The membership was set up to continue at $10.70 per month. Thank you.
