I am seeking a refund for my paid in full membership due to they are unable to provide a full gym since May 2018 .
On May 11th 2018 Shapes gym was moving to a different location. I was told the new location would be up and running in a week .I paid for a full year on March 17th 2018 . I was aware of the move and had no problem with the new location. Unfortunately the gym is still empty to this day except for a classroom . I finally went there to drop off a written notice ( per contract) on 12/12/18. I never heard anything from the owner.You can't call the gym ,mailbox is always full. I went by there again on 1/16/19 , and informed the staff that I was never contacted and left another copy of the written notice .The contract states that if the gym fails to provide a facility within 30 days , the member can request in writing that the contract be canceled and a refund will be given within 30 days. She finally sent me a text on 1/24/19 that she would call me as soon as she is out of a class and review my contract for a refund . She has still not contacted me.

The club has relocated and is in breach of contract regarding reopening within 30 days and of equal quality but will not refund my paid up membership.
I have a contract that is for one year paid in full to the amount of $231.12 which is for the period from 3/30/18 to 3/30/19. I entered into this agreement on 9/20/17 under pressure to sign before the end of the day and way before current membership expired because the club announced that they would be relocating and rates and terms would increase. The move didn't take place until 5/14/18 and members were original told they would reopen new location at 3510 53rd ave west Bradenton 34210 on 6/1/18. On 5/31/18 an email was sent out around 7pm stating that they would be open for group fitness classes only and will fully open on 7/1/18. I have personally been by to see the new location and its so far from completion with no signs of any construction taking place, was told there is some problem that is in litigation. Also come to find out that the group classes have a 20 person limit on a first come first serve basis and there is only one working restroom air conditioning is not sufficient etc... After much consideration I decided to request to get out of my contract and have the prorated amount credited to me. According to the contract it states that they to reopen the facility of equal quaility within 30days at which time I can and did request a refund of which I was told that they will not honor my request due to the fact that they are open for classes. I hardly call that a club and with the normal class sizes up to 50 members per class at attendance I I feel this was a terribly premature gesture and a desperate way to keep members from bailing. I also dug a little deeper and contacted the local permitting depart and was told at the beginning of this week that ther was no certificate of occupancy nor even a partial on file and that they would send code enforcement to investigate. Shapes states they have been allowed to open but I requested to see a copy of certificate but have not been responded to. The club in its current condition is unsuitable for its members and shouldn't be open at all. Memberships should be refunded if requested, which is in the contract given the current circumstances.
