As you may suspect, issues of client confidentiality control much of what I may disclose to youI am allowed to report the state of the public record and my overall services rendered
"MARGIN: 0.2pt 0.7in 0pt 0.55in">I am a criminal defense trial attorneyAccording to the Public Record, Mr*** was charged with Operating a vehicle while intoxicated - Operating a Vehicle with a .08% Alcohol Concentration Equivalent, and Wrong Way on a One Way StreetThe alleged event occurred in August of 2004, more than years agoIn criminal law we are an adversary system, the clash between State and defense both in negotiations and sometimes at trialOften-times, a client's willingness to put the State to the test and make them prove a case results in the State
reconsidering its position as a trial approaches, we have all heard of last minute plea deals or resolutions even during the trial itselfOur fee structure is based upon flat fees so that each service carries a price costWe specifically inform our clients that once we engage in the preparation for trial, this time cannot be refunded to us even if the trial does not take placeWe specifically call the fee a "flat fee for trial preparation" for this specific reasonI do agree that prosecutors are insensitive to the money that clients pay to have their cases prepared for trial and it would be much better for clients if prosecutors agreed more quickly in the case of plea bargainsHowever, there is some strategy to prosecutors waiting to see if the client is really prepared to go to a trial or not and as the days before trial approach, prosecutors sometimes change their mindsAs a defense lawyer, I cannot wait on the prosecutor to change his mind, I must go ahead and prepare the case so that the client gets a chance at the trial if it is necessaryAs I said, once I prepare the case for trial, the client does not get a refund if he or she decides to accept a favorable plea bargain before the trialThe client ultimately chooses to go ahead and have the trial or to accept the favorable plea bargain offered at the last minute
In the above complaint, Mr*** chose to accept a 'reckless driving' plea bargain AFTER I had already performed the trial preparationHe had the right to go to trial and I had prepared his case for that triallean tell that it was a last minute plea bargain from the public record because the amended charge was filed about days from the scheduled trial date which means the prosecutor did not offer the amended reckless driving until the last minuteyears later Mr*** chooses to complain
I vehemently deny any bad business practiceI have been an attorney since and I am an experienced criminal defense attorneyMr*** received the benefit of my services and reputation and was able to get his charge reduced to something other than drunk driving although the prosecutor waited until the last minute to make the offer which caused extra expense for Mr*** and extra work for meI reiterate that he could have chosen to go to trialThanks for letting me respondIf Mr*** wishes to waive confidentiality, I may be able to give more detail
