MsNeal, This is the response for our firm in reference to the complaint lodged by Brad *** Our firm (not me)performed the closing when Mr*** bought his property in January of He sold his property in June of and our firm (again not me) prepared his deed
documents for the sale. We did not do the closing. In between our work on his purchase and his sale he acquired (march, another small piece of property adjacent to the property he had purchased in January of that year. Our firm had no part in his acquisition of this second property. His Realtor asked us to do the deed for the sale of his property and we prepared the documents for the property we knew he owned and was set out in his contract to sell. The deed was then delivered to the attorney’s office(not our firm) who was doing the closing. It is standard practice for the closing attorney to review the deed to insure it is conveying the correct property. Evidently the attorney either did not review the deed or they were also not aware of the second piece of property. The problem occurred when the property was sold and either the attorney did not review our deed or the seller did not communicate to either the Realtor or the buyer’s attorney that there were pieces of property involved. Any error that was made occurred then and that closing attorney has the responsibility to correct it I was not involved with Mr***’s purchases or sales. The property has gone through at least sales including a foreclosure since Mr*** owned the property. After almost years fixing the problem became urgent. I have never spoken with or emailed Mr*** He may have spoken with our staff. I don’t believe it is a reasonable expectation for us to drop everything and fix something we were not ultimately responsible to correct Despite his actions in filing this complaint and the absence of a legal obligation to do so we have prepared a deed for his signature.
