When MrShear spoke to Ms*** about the resolution, Ms*** was going to call MrShear back with her decision on what she wanted done to the nails and a convenient time to complete the work. SHE HAS NEVER CALLED MRSHEAR OR THE OFFICE WITH ANY DECISION OR INFORMATION!!!

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
MESSAGE FROM BUSINESS:Ms. [redacted] was made aware, at the time of removing the old roof, that the roof would need 3/8" plywood over the top of the existing roof decking because there were spaces between the boards.  She was told what the price would be - $2,500.00, which she agreed to .  She also stated to the foreman that she knew that wood would have to be installed over the existing decking because of the spaces between the boards in the attic, because another contractor, who was twice our price, told her it needed plywood.  Upon completion of the job, Ms. [redacted] sent an email on June 4, 2015 and also call the office stating that the clean up was not done well and that there were nails sticking through in her attic about 2".  At that point we offered to bend the nails.  Ms. [redacted] wanted the nails cut and we told her that we could not warranty the wood from buckling if we did that.  We informed Ms. [redacted] that the nails were put in the plywood in certain areas that the foreman felt necessary because the decking felt springy, and he was afraid that the plywood would buckle and lift up, creating a hump in the roof, so to insure that this didn't happen, he put extra nails in the plywood through the existing decking, not only in the rafters.   Mr. Shear called Ms. [redacted] to discuss the issues, Ms. [redacted] returned Mr. Shear's call on June 12, 2015.  They discussed the issues and resolutions, Ms. [redacted] was to call Mr. Shear back with what her decision was on what she wanted done – either bend the nails back or to cut the nails, with no guarantee the plywood would buckle.  To this day, she has never called with any decision.   Attached please find the contract which Ms. [redacted] signed.  Thank you.My response:
1.  I did not state "to the foreman that she knew that wood would have to be installed over the existing decking because of the spaces between the boards in the attic, because another contractor, who was twice our price, told her it needed plywood."  I did have a proposal from another contractor, and the proposal did not mention plywood.  (Also, the existing shingles were installed over the boards, and I did not expect Shear to insist on covering the boards with plywood.)  I believe that Shear put in a low bid to obtain the contract, and then coerced me into accepting a higher price after they had removed part of the roof.  At that point, I would have preferred another roofer, but I did not think that it was a viable option.2.  Tracy did not tell me that "the nails were put in the plywood in certain areas that the foreman felt necessary because the decking felt springy, and he was afraid that the plywood would buckle and lift up, creating a hump in the roof."  Even if she did, and even if it was necessary to put in nails between the rafters, the nails should not protrude 2" beyond the decking.  3.  I did call with a decision, and told Ken Shear that neither bending the nails nor cutting them without guaranteeing the roofing job was OK with me.  I believed that he agreed to cut the nails while maintaining the guarantee, but I may have misunderstood him.  4.  I do not consider the job complete, and I expected Shear make arrangements to cut the nails and finish the cleanup.    Instead, they sent a Demand Letter, threatening a lawsuit, without any further attempt to address my complaints.

I'm writing this letter in response to answer the complaint letter sent to my company. I would like to first explain my company's policy regarding "free estimates". A free estimate is provided to homeowners who own the home or property in need of repair. When my business is requested to...

provide an estimate for for a perspective buyer of a property or insurance claim estimate, then it is explained at the time of requested service that there is a $125.00 fee to cover the estimator's time and paper work service. If the perspective buyer purchases the property and uses my company to complete the work noted in the requested estimate, then the $125.00 fee is deducted from the bill of service.
