Shelburne Falls Wine Merchant

Failure to return security deposit or reimburse for returned, unopened merchandise. Total value approximately $1600.In July 2013 I contacted [redacted] at The Shelburne Falls Wine Merchant (SFWM) and worked with him and his assistant to plan wines and bar services for a wedding. On July 20 I submitted, with an agreement which I signed, partial payment by check for merchandise and services, (#[redacted] for $4425.24) and a check as deposit against loss of equipment (#[redacted] for $1240.00), to SFWM. I was explicitly told at this time that the deposit check would be held uncashed pending return of equipment. On August 24 I completed payment after the event with a check for the balance due, expecting to receive the uncashed deposit check later. Following the event two unopened cases of wine and an untapped quarter-keg of Steel Rail beer remained, and [redacted] verbally agreed to accept them and reimburse me. All equipment was retrieved by SFWM following the event. The following week I discovered from my August bank statement that the equipment deposit had actually been cashed August 6. I called [redacted] to clarify the matter and was told that the the deposit check had been cashed in error and that the "bookkeeper" would need to correct the error, and would "work out" the reimbursement for the returned wine and beer. He said that it might take "a few days" for the check to arrive. It did not.I called on a weekly basis throughout September without receiving answers to my messages. When I finally made contact with someone at the store I was told that [redacted] had been ill. I have continued to email, and now have sent a registered letter to SFWM requesting payment. I have received no reply to any message. Receipt of the registered letter, which was sent to the business address, has not been confirmed.Desired SettlementI would like to receive a check in the amount of $1,600
