For your reference, details of the offer I reviewed appear belowThis complaint was made after several attempts of contacting Mr***Our professional relationship was based on is trusting his wordHe is correct about us wanting a "hands off" dealAs seen in bills submitted by him, we gave a 25% depositWe gave him the balance amount the day before the work was completed, again based on trustWe wanted him to continue to maintain our yard for years to comeHowever, I wanted to see how the landscaping comes along for at least one year, as all the plants were really young and smallHe and we agreed that he will maintain the landscaping for one year starting the end of June 2014, when we made the paymentAll plants had one year contractMany plants started dyingMr*** had recommended an irrigation person, who recommended adding another irrigation line costing almost dollars as the irrigation did not cover those plantsIdeally, Mr*** shouls have known which spots irrigation would not cover and not planted in those areasWe still went ahead and took that extra expenseUnlike what Mr*** is saying, the trees started dying in November 2014, however he did not replace them till May 2015, as he said that was the right timeThe new trees were really poor quality and started dying within a few weeksI contacted *** and he promised me he will replace themHe did not replace them till AugustI had to contact him several times to come and look which he did in AugustWhen he came, I showed him several dead plants in landscaped ares, that had died despite his "fertilizing" in fall and springHe promised me that he will replace them, put tulip bulbs this year, since he failed to do them in Oct However, he sent us an invoice for the work that he had done in APril, which was part of the contractHis one year of contract maintenance started in June It seems he changed his mind after seeing that the landscaping had really not taken off well, probably because of poor soil preparationHe was not willing to replace the trees either, so he sent us a billAs you can see from papers submitted by him, the maintenance was only a proposal given to us by him at requestWe had told him that we will only sign the proposal if we are happy with his first year's maintenanceThis was also, because Mr*** had not been able to give us a single reference of his previous work that had been well maintained. We feel that Mr*** should do the following to resolve this issue: Replace two dead trees per contract: He deliberately waited till May 20, 2015, even though I had informed in Nov that the trees were deadI also informed him on June that the new trees he had planted were dead already. Replace dead plants per contract Plant bulbs as promised next fallI am attaching the pictures of my communication with *** over several months,

also wanted quotes for c:omprlete annualmaintenance for a 4year term, year by year. The [redacted]'s wanted their landscaping tobe "HANDS OFF" by them.Attached are the copies of all proposals for the initial job, along with it.emized year byyear maintenance proposals and services to be provided. This rrvas at largerresidential landscaping job, so I offered to include the 20t4 maintenanrce proposal (page A) forfree, and also offered, to plarrt some flowers in 5 flow'er p,ots (Planted 7 flower pots). After completion of the lanclscaping and receiving firral piayment Mrs. [redacted] asked if I would plant bulbs in the fall, I agreed to do so itt no charge.(Because of early snow fall in November, the bulbs could not be planted because we had moved into winter operations.)October 2Ot4 Mrs. [redacted] called and said they had a wet area irt a backyard turf where we removed some trees. I told her I would come look at it. Onc,e I observedthe wet turf area in question, Ihad a PJLcl€w come out and excatlate the area, to find the source of the water. After excavation of the area, the source of the waterwas not found. The problem seemed to resolve itself after the weather dried up. I also paid an irrigation contractor, to come out and inspecthe system to make sure itwas not leaking. We were not under contract to do any irrigation vrork. PJL did adjust the lrrigation system, to the best of the system capabilities, for ther nevu landscaping, at no charge.PJL's standard agreement, is that all plant material is guaranteed f,rr L'year from the date of installation. PJL completed the project and honored our milterials guarantee, replacing a few shrubs and two trees that had died as late as May ,20th :2015. A month earlier, April 2015 | was contacted by Mrs, [redacted] regarding the mairrtenance proposal for 2015, (Page B) in the attachments. Mrs. [redacted] agrered to the 20t5 Maintenance proposal and wanted to proaeed, which we did, in good faith, with no down payment. PJL completed the spring portion of the 2015 mairttenance agreement.In late June / Early July 2015 Mrs. [redacted] advised that the two trees lthat had been replaced under warranty had died again. lwent out to look at the tree:; a few days later and observed the dead trees. We dicl not replace the trees at this time due to the summer heat setting in. While we were there, we weeded the bed:; at no charge.On August 17th 2OL5 PJL invoiced Mrs. [redacted] 53090.00 for the mainrtenance services performed up to 5-2O-2Ot5. S1315.00 of the invoice was I'or new pine strawper the 2015 agreement. Mrs. [redacted] Called on Sunday August 2l3ro art approximatelyT:3Oam. Mrs. [redacted] Stated she received my invoice, and was notgoing to pay it, because she believed it should be included in the lrandscaping she had already paid for. I reminded Mrs. [redacted] that the one year mainlenance agreement was completed at the end of 2O!4, and that we were currently perfornning the 20L5 maintenance proposal services. Mrs, [redacted] then proceeded to ask about the two dead trees in the landscape, which we had replaced once, at the end of the warranty period. ltold her I had to think about how lwanted to proceed, since s;he stated she was not going to pay for the spring maintenance services. I told her I didn't think it was fair, to ask us to replace the trees, if she was not going to pay for :services she knew she legitimately owed to PJL, to that point.In Mid-November, Mrs. [redacted] again called and asked about the two trees and bulbs. ltold Mrs. [redacted] I was happy to replace the two trees and plant the bulbs ifshe paid what she owed. Mrs. [redacted] still refused to pay the invoice. I told Mrs. [redacted] I thought it best, if we part ways, as she was getting 53090.00 of servicesforfree, and she could pay someone else to replace the trees that PJL frad already replaced, at the end of the warranty period.lam still willing to maintain a professional working relationship with Mrs. [redacted] if she is willing to pay the invoice she truly knows she owes. Once paid in full, PJL ishappy to return and replace the two dead trees, that the warranty has already expired on, at PJL's expense, and plant the bulbs at no charge, as vuas originallypromised in the summer of 2OL4.pJL has been in business for 15 years and we do hundreds of jobs per year. To date, there has only ever been one other complaint filed against PJL quite ;a feru yearsago. The current complaint, is certainly the exception, and not the rttle. I had not received an email from Feb 4, 2016. Thanks for resending it to me. WE are not trying to get out of any payments. This was a 25,000 dollar contract. We have paid him in full and as the papers submitted by him show, first year’s maintenance was included in the deal. [redacted] is showing the proposals that he submitted for subsequent year’s maintenance. He sent the invoice for maintenance months after the spring fertilizing was performed, as an after thought to get out of replacing the trees. The attached text messages show that he was going to replace [plants and trees, that he later decided he did not want to do. As per the attached text, several trees and plants were dying in November, that is a few weeks after he planted them he was supposed to replace them in March, but did it in June. This is a pain for us, not for him. We have had to call him and text him several times and he kept saying he will do it, until he decided he did not want to do it. It is painful to see such behavior after we have tried to give [redacted] every benefit of doubt. This is a genuine complaint, not bogus and was done only after we exhausted all ways to have [redacted] live unto the contract. Thanks you,[redacted] *
