Since I submitted this complaint, the business has filed for chapter reorganization, and they
have had their licenses pulled by consumer affairs. They have $47,of our money and I am not expecting them to be finishing our job. We are in the process of hiring another company to finish it for us, and are filing claims with consumer affairs as well as the Nassau County DAs office. Of course we will fight for what they owe us in money, but what they have cost us in time is immeasurable.

 This company lists on their website that they are an accredited business with Revdex.com. I had placed a complaint previously with the Revdex.com as the company kept delaying and making excuses not to finish our job. I then got a phone call that they cannot proceed with our job until I remove the complaint with the Revdex.com. I immediately resolved the complaint thinking that they would now finish the job. Months later, and there has still been no progress with our job and continued excuses. Please help.

Review: The rebates have been the biggest issue. The following rebates were advertised:

High Efficiency Incentive Rebate - $3000

Thermal Hot Water Incentive - $ 4000

Residential Energy Efficiency Rebate - $ 2350

Residential Water Heating Rebate - $ 1500

Green Building Program - $ 5125

The above rebates as well as the state and federal tax credits were all laid out to us by [redacted] when he came to do his sales call. The above rebates, exclusive of the state and federal tax credits, totaled $15975. Of those, we have only received one rebate, from [redacted], for only $800. This means that a total of $15175 in advertised rebates remain that we were told we were entitled to and have not received. The projected “Final Out of Pocket Expense” was written up for us as $15121. The amount of rebates advertised that we have not received is $15175 more than the alleged out of pocket cost, so the rebates we have not received alone amount to more than what the out of pocket cost was presented to us to be. That is indefensible. We have received only 5% of the rebates advertised to us. This project has cost me more than double what I was told it would. Even worse, every time we have tried to find out what is going on, we get nowhere.

At the end of December 2013, when we received the rebate for only $800 from [redacted], we contacted your office. We eventually spoke to [redacted] who advised us he would look into it. He told us that there was no more he could do and that we would have to speak to you. That was in January 2014. Since then, my wife has tried and tried to speak to you or make an appointment to come in to speak to you and she has been disregarded and not called back or put off. Here is a sampling of contact with your office in just the last month of so:

Called on 3/**, 3/** (twice), 3/** and 3/** trying to make an appointment to speak to you. Each time, she was told an assistant would call back to schedule an appointment. This never occurred. Finally on 3/**, [redacted] spoke to my wife and was advised of the situation. He did not call back, so on 3/** she called and spoke again to [redacted] who said he would talk to you ([redacted]) and would call back the following day. This did not happen, so on 3/** she called again and spoke to [redacted] who still did not have any information. On 3/[redacted] advised her that [redacted] was working on it and would call us back in a week. Again, this did not happen. On 4/** my wife again called and spoke to [redacted] who said he would send [redacted] another memo. Today, I finally called to speak to you. Again, you did not speak to us and instead had [redacted] call me and ask me to email you. I told [redacted] and I will tell you again that I find that unacceptable and disrespectful to not speak to us. The treatment of my wife with the lack of call backs is appalling to me, especially when she was the one who wanted to have this worked out in an amicable way and has given your company the benefit of the doubt time and again.

In summation, this project has been by far, worse than any other home improvement project I have ever been a part of with the completely haphazard way that it was done and the lack of scheduling or notification to the cus[redacted]er. The lack of call backs and disregarding of calls by the cus[redacted]er is beyond my belief. Having been sold on over $15000 in rebates and only receiving 5% of that, $800, is deceptive, immoral and unacceptable. I have told [redacted] and I will now tell you, I had not wanted to contact the Revdex.com, Nassau County, etc, but we have gotten nowhere and at this point it seems as though we have been disregarded. My check of the Revdex.com site just this morning shows 5 complaints in the last 12 months. I hope that this can be rectified without involvement of regulatory agencies but if I do not hear from you [redacted]orrow, I will go ahead and begin the complaint process. Throughout the entire process we have been flexible and worked with you and your company, taking days off work to be home for work to be done, rearranging our schedules on sometimes an hour notice because of a lack of proper scheduling, and throughout we have gotten treated more and more poorly. Simply calling us back would be a start, but time and again, as shown above, we were not even given the courtesy of a call back. I hope you can understand my frustration as what has happened here has had a negative impact on my family, and these are not small problems. We are cold in the winter. Had I known that on cold days the unit could not get my house above 65 degrees I would not have had this system installed. On the financial front, this is not a few hundred dollars, it is 95% of the advertised rebates, over $15000!

With regard to one rebate, were sent a letter, from [redacted], with an energy audit application to complete, which, according to the letter, “is how we will be able to get you the $3000.00 rebate we discussed”. We completed the application quickly and forwarded all the information to your office. Several times we called to find out when the energy audit would be done, but it never was. Several times I was told, a few of those by [redacted], who at least made an effort to call us back when we would call, he would look into it, but still it was never done. When [redacted] called to collect final payment, I asked him about it and he had no idea about it as well. When I said I would withhold final payment until I got a call from [redacted] explaining what the problem was, I received a call the very next day. [redacted] advised me that that program had been discontinued but that there were other rebates. This was in October of 2013, though we had submitted the [redacted] energy audit approval to you by email on May *, 2013. Six months had passed, and no one advised us that this program had expired or been discontinued until I requested an explanation before making final payment though we had continually asked and asked, even being told initially that work could not begin until the energy audit was completed. Due to a lack of scheduling, this rebate apparently expired and no one advised us. That is through no fault of ours, as we did exactly as we were told and made every effort to get this audit completed. Further I was told by you that after we paid we could get the certificate of completion and then would be eligible for further rebates. This was not the case. I will detail my issues with the dishonesty regarding rebates later.

Additional Issues : The project was to start approximately June * and be completed approximately July ** This also did not happen. As a matter of fact, the project did not begin until mid July, and that was only because we called many times to find out what was going on. The project was indicated to take approximately 1 month, but did not complete until the first week of October, almost three months later. During the entire project, it was extremely difficult to have any idea when work would be done, or who would show up. Even the subcontractors we had here voiced frustration at showing up at homes to do work and no one being home because no one at Sherman contacted the homeowner to tell them that workers were coming to the house. In short, scheduling was a complete disaster. Worst of all, on August ** (Sat), my central air unit was disconnected. No one showed up to get the geothermal unit running until 10 days later, Sept *. This was during the hottest time of the year, and my children and family were the ones who suffered. We called and called trying to find out when someone would come to hook up the geothermal unit, but could never get a straight answer. Eventually, Sherman did provide a single portable air conditioner unit (5 days after the C/AC was removed). If there was an operational need to have the C/AC disconnected and the geothermal unit could not be hooked up for a week and a half, why couldn’t someone tell us that so we could have made arrangements beforehand instead of having my kids sweating in 90+ degree heat? Again, the lack of a straight answer on anything has been a common theme.

Some of the workmanship and promised performance has been lacking as well. During the colder days of winter, the unit could not heat my home to above 65 – 66 degrees even though it ran all day long. I went into the attic and observed the connections to the air handler had not been taped and significant air leakage was occurring.Desired Settlement: I request a reasonable refund of the over $15000 dollars in rebates which were advertised to us, on company letter head, which were either not actually available, not honored, or not qualified for due to the actions of lack thereof of Sherman Industry. Work was not done to get our rebates by Sherman, yet we were set up with a company to offer approximately $40,000 in financing within days of signing the contract. Also, I just checked the "nomoreoilorgas" website which still has the Revdex.com logo though my check of the Revdex.com website this morning indicates Sherman is no longer accredited, further falsified advertisement.

Review: During the sales visit, the overall cost of my equipment installation was said to be lowered as a result of approximately $17,000 in various rebates. I was given a document which listed the rebate programs and their respective amounts. These rebates were to come my way 6-8 weeks after project completion. Of that amount, I have only received an $800 rebate from my electric company. I was given a letter at project completion (December 2013) stating that Sherman Industry was working on gathering information regarding the rebate programs and I would be contacted shortly. Twice I was told by staff that my file was "on the desk", but I have not gotten any further contact from them. The dollar amounts mentioned are separate from Federal and NY State Tax Credits which I have received.

In addition, I have a leak in my geothermal piping that they are aware of for several months now. I was told that a repair would be done, but I cannot get a response to my phone calls or emails.Desired Settlement: I would like for Sherman Industry to point me to where these rebates are to come from so I can recoup the advertised rebates, or to refund that expense to me. I would also like for them to make the repair that they said they would.

Review: Only a portion of work promised was performed. Job is not being completed in a timely manner.Desired Settlement: To finish the job

Review: Sherman started work on our house over a year ago to install a Geo-Thermal heating and A/C system. The job was to include heating the pool. In November they installed the the pool heater but the pool was already closed and could not be tested. I was promised that when the pool was opened they would return to test and complete the work. They have been paid in full and for a month now we have been trying to get them to come and finish the work that they promised would be completed when the pool was open. Two times they have no showed and persistently do not call us back.

We are seeking help in getting them to complete the work they have been paid for as they have been unresponsive to our repeated calls.Desired Settlement: Finish the job you were paid to do.

Review: We hired Sherman Ind. company to install a Geo Thermal System for both heating and cooling in our home. They described the process which should have taken 3 months to get plans diagrams ect. They asked us for 6000 dollars as a start up cost. Fine. We gave them CASH. 3 months go by ... Nothing. I called them up and they said they were waiting on some government paperwork for our incentives. Fine they finally get the paper work and sent it to us to fill out. About 2 weeks later I get a call saying they will now install the outside siloes and will have the outside tubes installed and connect them to the room where they connect. Fine so far. Here is where they get silly. They ask us for another 10,000 dollars to pay for the digging. Fine we paid it.. the silios get installed. My lawn is a mess but it is in the contract they return it to its former glory. NOTHING HAS BEEN DONE. Now 1 month goes by and no further work has been done. Only E-mail after E-mail of excuses of why thay are delayed. They called and asked for another 9000ish to get the equipment. Stupidly we gave them that. So we have given them a total of roughly 26,000. with out government incentives. Another 2 months go by and now I get a letter saying the compay is filing for bankrupt Chapter 11. Alll emails are available at your request. We have all paperwork and the contract. If they cant do the job What can be done?Desired Settlement: They can either finish the job or give us our total money back inculding the money needed to replaced the lawn they trashed and said they would repair.

Review: Having funded the project in September of 2013, Sherman Industries has failed to begin work on the job. The start date was listed for the beginning of December of 2013. Due to the failure to start on time, I have paid an additional 3000.00 in oil bills, while simultaneously paying the loan of for the new system. There is no communication concerning the start of the project, unless prompted by my own phone calls. Each of these calls has ended in a proposed start date that is within reach, but when that date comes there is no communication and no start to the project.

It is now the beginning of May and no start date has been set. Two owners of the company have both promised to communicate with me on certain dates, and both have failed to do so. [redacted] promised to call me May [redacted] with confirmation of a May [redacted] start date, but failed to do so. When I called [redacted] on the [redacted]. stepped in and said he would be in contact with me that day to resolve the issue. It is now the [redacted] and no communication. When I called to speak with [redacted]., [redacted] my salesperson was given the phone and he promised a start date of the middle of May, TENTATIVELY!!Desired Settlement: I wish to be compensated for the oil bill incurred due to Sherman Industries failure to start on time, which amounts to $3500.00.

Also if Sherman Industries is unable to begin the project before the end of this month, I would like a full refund including loan fees, so I may return the monies borrowed to fund the project.

Review: Company has charged almost full money for Geothermal System but has neither installed nor made it functional. The contract was signed almost an year ago and still begging them to finish the work. Calls / emails are going unanswered.Desired Settlement: Requesting them to come back and finish the job, ASAP.

Review: I signed a contract with this company on August **, 2013. The contract was for the installation of a geothermal heating and cooling system, and driveway. The work was supposed to be started approximately 10-**-13 and finished approximately 11-**-13. Conditions that were written into the contract as reasons the project might be delayed included weather, special order, acts of God, and availability of their drilling rig. It soon became apparent they did not have intentions of starting the work when they were suppose to, and the deposit was paid with loans taken out for the project. In late November we were given assurances they would be starting our project soon, but since our contract had expired I contacted a lawyer to find out what my options were. Upon contacting the company with this information I was requested to meet with the [redacted] at their place of business. The meeting was between he and I and maybe 2 other men. In a previous conversation my wife had with someone at the company she learned they had delayed our project to "install for someone who didn't have any heat" but had signed up after us. The result of this meeting was they agreed to pay for our oil until the project was finished. They as a result cancelled our oil contract we had with an oil company. The company sent me a letter saying we owed them money for cancelling our contract. Eventually the company sorted that out, however getting them to deliver oil when we needed it has not been easy either. they would only have 100 gallons delivered at a time, despite it being the middle of the winter and them knowing they would not be starting our project any time soon. When I told them we needed someone to service our boiler, something our oil company would do 24 hours a day, we had difficulty getting them to undertake this, until our boiler stopped working late at night on a weekend. On one occasion when we ran out of oil they told us a story about how long it would take and they would have to pay someone overtime to perform the work. When I spoke to the guy, who came in from his home, he told me in fact he was not on overtime. Around March, when the weather warmed up, they sent a crew to start the drilling. After about an hour the crew said there was an issue and they packed their stuff up and left. We finally had another crew show up almost a month later. After a week of drilling they still did not fulfill their end of the contract that said they would have someone come put sod on the grass where they tore my front yard up and to this day I has not been finish. When asked about this we were given an answer of we scheduled someone to come over and take care of it. It still isn't done. We had several different HVAC people come by and look at where they were going to place the duct work, and the last one who came approximately a week after the drilling was finished, he also told us it might be 2 weeks until they came back to start that work. We have not heard from any of them since. Every time we attempt to contact them they don't call us back. The few times they have answered they give us dates that are further and further away. I called on Thursday, did not get a call back, and finally just showed up at their business on Tuesday, which has Revdex.com stickers on the front door. The [redacted] came out to meet me when I called the office and informed them I was in the lobby. After many assurances that I wasn't being lied to, about people still being ahead of me, and an assurance I would be called today with a start date, I left with his business email written on the back of a card with his promise that if I needed anything to just email him and I would get a response every time. I was also told if I did not get a response by 11am to call and he would have a start date for me. As you can imagine 11 am came and went with no call. When I tried to call several times today the phone line was busy. When I attempted to email the [redacted] with the email he had written down I got a response that the email was not a valid email address. I called on the phone service number and did get through to the secretary. She told me the [redacted] was not there and that she would leave a message for him to contact me with the understanding he knew he was supposed to call me. Here we are at the end of the day and imagine my surprise I have still not received a call or email and once again don't know if my work will be started. I have filed for extensions from the inspection company the bank hires to make sure the work gets done. When I told the [redacted] about the up coming inspection he seemed to think they would be able to make some phone calls to the bank and smooth that over. I don't understand why they won't do the work they have been paid for, however at the end of last year they told me in order to get the rebates for the work to pay off the loans the job had to be paid in full. Thinking I could not wait for another year for the tax incentives I paid the job in full counting on their word that as soon as it was warm enough my work would be started. So the work has been completely paid for, and all I have to show for it is a torn up front yard where they did the drilling. Despite my experience, when a neighbor saw what we were getting done he began his own investigation and decided to sign a contract with this same company, I did not discourage him against my better judgment. Since the drilling was finished I signed a contract with another contractor to have my house dormered. That contractor was able to get the permits and finish all of their work, and I am still waiting for these guys to start the work on the inside of my house where weather, acts of God, or availability of drilling rigs is not stopping them from doing anything.Desired Settlement: Yesterday I was willing to give the company the opportunity to make right when the [redacted] came and spoke with me. Today after not getting the promised call back, having the phone lines jammed all day, and figuring out I was given a false email address, I have lost faith in this company. I have seen other people make claims against their practices and seen the efforts the [redacted] has gone to defend his company, claiming they were con artists and frauds, and expect the same treatment now. The job has been paid in full since December. They cancelled my oil contract, probably lying to that company saying there is no place to deliver at my house like they said they would do, and it has been like pulling teeth to get them to give us oil when we needed it. I just want them to finish the work they have been paid for before my wife goes to see the lawyer she asked me to call today. Excuses and being ignored will no longer be tolerated.

Review: Sherman Industries took a $37,000 down payment from me in February 2014 for work that was never started.

I believe they never intended to do the work as stated in my contract. They have now filed for Chapter 11

And there are many more people that they have defrauded out of money.Desired Settlement: I just want my money back for services not rendered. In addition, I strongly feel that this company needs to pay fines and serve time in jail for the way they have abused and defrauded honest and trusting people like myself.

Review: Upon the installation of our Geo-Thermal unit, the system did not function properly due to a faulty part. This was determined by Sherman Industries immediately after the installation of the unit in May 2013. Within the past year, we have contacted them numerous times via telephone and visits to the office which always results in false promises to replace the part. During one of our spontaneous office visits in early June 2014, Sherman Industries stated they have the replacement part, and would contact us to schedule a time to install. That was the last conversation we had with them because, since then, they are no longer returning our calls. Currently, July 2014, the system is not functioning at all leaving us without any air conditioning.Desired Settlement: We would like Sherman Industries to replace the part and have the unit work as it should. If this is not possible, we would like a full refund since the unit is not functional.

Review: I have a contract start date of February (weather permitting). I have contacted the company numerous times and was always promised a call back which rarely occurred. When I did get I touch with someone I was told the drill can not operate under 26 degrees. I understand a slight delay due to this. I was given a new start date at the end of April. However it is now May [redacted] and still my project did not start. I have asked if I could simply be kept up to date with my project and start date. This request has fallen on deaf ears. I have never received one phone call from this company besides when they needed information for my financing. I have written the head of the company and he wrote back that I would receive better customer service and the updates on my project. So far nothing still.Desired Settlement: I would like my project to start or at least be kept up to date with the progress of my project. I would like to know why it is now three months behind schedule.

Review: We paid for a Geothermal Heating/Cooling system in full $37,770 in checks and credit card. The system and the company has been nothing short of constant problems, malfunctioning parts including many weeks this past winter with no heat. The system was so inadequate that it cost us 4 times the amount of electricity since its installation. The company would have different subcontractors come in and they would each pass the blame on the last technician. The company went into contract with us 5/*/13 and finally finished this past may,2014. The contract is supposed to be 100% on all work,parts and labor for 10 years. Well, it has come to be known that this company has filed for bankruptcy. We have been trying to call them and stopped by the facility and no one is returning our calls. All phone lines have been disconnected and we are having issues with the unit again. The work has never been completed. We also have forms that were supposed to be filed by Sherman Industries to receive our promised rebates.Desired Settlement: We want at minimum half of the money back. We will need to secure another company for service, repair as we signed a contract to be covered for 10 years.

Review: On October **, 2013 I entered into a contract with Sherman Industry to replace my old heating and air conditioning system with a new Geo-Thermal Heating and Cooling System throughout my entire home also including a pool heater. The total cost for this was $70,000.00 (seventy thousand dollars). This contract also included the removal of all baseboard heating and all air conditioners and the removal of all garbage and debris. After removing these items and the installation is completed they were to repair all walls. floors, and outside areas that they had to touch in order to do their work. Work was supposed to start Febuary *, 2014 and be completed on March *,2014. I myself had to remove all the baseboards, all 4 airconditioners and patch all the walls that were effected by the geothermal project as to not hold up my general contractor who was responsible for the rennovation of my home so I could move back in. Sherman Industry threw there garbage on my front lawn and left it there for me to clean up where it specifically states in their contract that they would remove all debris that was created by their installation. To date the job is still not complete. I have open holes in my floors, in my walls and ceiling where registers need to go. The holes in the walls face my basement stairs and a child can fall through this opened hole and fall down the stairs. The holes in the floor are also a danger as small kids could fall through to the basement. The pool heater is also not connected. The thermostat on the second floor is a used thermostat that was installed temporarily until the new thermastate arrived. My lawn and walls that they have touched are still not restored and there is no date set for Sherman Industry to return to complete my job.Desired Settlement: I want them to come and finish the job as stated in the contract. I want to be reimbursed for the removal of all debris, removal of all baseboards, removal of all air conditioners, and the repair of all walls that were closed by myself.

Review: Contract states work to be completed approximately by October **, 2013. We have exhausting all our efforts contacting Sherman to move this job forward. The delay has cost us over $15,000 on rent, interest and additional construction costs due to their negligence and disorganization. On 4/**/13, Sherman had the nerve of requesting an additional $5,000 to finish the job and have no plans of moving forward.Desired Settlement: We would like the job completed based on our expectations by April **, 2014, with no additional cost to us. They have already cost us enough.
