On November *** *** called wanting a quote for fall clean up. They bought new house and needed a good thorough fall clean up. That day *** ***, owner, met with her as documented. she wanted it done as soon as possible. She signed the contract for Sherman
& Sons while *** was there for the price of $plus tax for services stated. She was advised we would be out on Nov Prior to the 14th she did not contact us that services were not needed and they did it themselves. Our guys went to the job as scheduled. *** ***, owner, when he got there called *** to state it looked like it was attempted to be started but still needed a lot of work done to our standards. Obviously there was still a lot of work still needing done for them to spend 1/hrs there cutting grass and cleaning out the flowerbeds and pool area. On November 2016, days later, after it was done by Sherman & Sons, *** called to say they had done it already. She said she understood we came out and cleaned more thoroughly and asked what we can do for her. *** agreed to just charge her half the cost as good customer service and she agreed. Finally on February 10, 2017, months later, we received their check for $159.75Sherman & Sons stands by the quality of their work and do to the fact the contract wasn't cancelled by customer notifying us that they tried to clean themselves, and we went out as scheduled and saw that it was still in need of a fall clean up, we feel we were fair by offering them to pay only half the cost that was contracted for even tho they failed to notify us.Thank you*** ***, ownerSherman & Sons Lawn Care, LLC

I am rejecting this response because: it does not accurately represent the disputeAlso, they admit that it was obvious that the leaves had already been cleaned upThe leaves were stacked four feet high along the curb for roughly yardsNo reasonable person would assume services were neededFurther the purported contract was invalidAssuming, for the sake of argument, that the document my wife signed was, in fact, a contract, the contract was to perform leaf cleanup servicesSince leaf cleanup services were obviously not necessary, Shermans should have inquired whether services were still necessaryInstead they lied about the services they performed and billed for services they did not performI reassert my request for reimbursement of the funds that were paid for work that was not performed
