Dear [redacted],Your letter dated April 29, 2015 has been received. Thank you.Pursuant to your instructions, we have de-identified personally identifiable information in this case. The facts are as follows:(1)The cat conceived after the first stud...

service. Those kittens died.(2)As stated in the contract (attached), health of a litter cannot be guaranteed.(3)The contract terms were fulfilled after the first stud service where conception occurred.(4)The additional visits referenced in the contract are for the case where a cat does not conceive the first time.(5)The two subsequent times we boarded the cat for stud service were not under the circumstances covered in the contract (failure to conceive at the first visit). To re-iterate, the client's cat conceived during the first stud visit. This fulfilled the terms of the contract. It was unfortunate that the kittens died, and we twice agreed to have the cat return for stud service at no extra charge even though the original terms of the contract had been fulfilled after the first visit. After the second and third boarding stud service visits, the cat still did not conceive. The client wanted to bring the cat back again free of charge for several weeks of boarding and additional stud services. We indicated that we would need to receive payment for further stud services. It was only then that the client suddenly wanted a refund for the original services. The client has now complained to both the Consumer Protection Division and the Revdex.com. We have responded in writing promptly to both organizations. In the various written complaints, the client has failed to report this key fact – that the cat conceived during the first visit. Please refer to the contract terms.
In our view, this is very dishonest.
Our goal is to have satisfied customers, and we did advise the client's attorney that we would board the cat again under specific terms for new stud service. However, a refund is not due since the original services were received. This was in early March, and we have not received any further communications from the attorney since acknowledgement of our response.Following a fair and unbiased review of the contact terms and true facts in this matter, one would reach the conclusion that no refund should be given for the original services we provided. We hope that you see that we have tried to accommodate the client by twice boarding the cat free of charge again - and that a demand for refund of the original services is not warranted. Finally, we seek your assistance in helping us understand how we can protect our small business from false allegations. It has taken considerable time to address these issues. We are very small cattery and our reputation is important. It seems unfair that one can simply make false claims, misrepresent the facts, or omit key information - and then tarnish the reputation of the business.
Please confirm receipt of this written response in writing at your earliest convenience. You can do this by sending me an e-mail at [redacted].
Thank you for your assistance.
