To begin, we did have a lot of back and forth missed communication due to individuals being out of the office for vacation. Mrs*** bought the boat from a dealer in El Campo. The dealer informed her that the hull had a year warranty. The dealer has confirmed that this was
communicated. The boat was already one year old. Mrs*** is claiming that it was there from the beginning. If this was the case, why didn't they bring it to the attention of the dealership? We fail to see where her expertise is creditable being that she isn't in the boat building business. They could have hit something while out fishing/boat riding that caused the gel coat to spider web. She never brought the boat to us to look at the spot in question. She took the boat to ***'s fiberglass repair shop instead *** told her to bring the boat to Shoalwater for us to inspect and she refused. She told him to go ahead and fix the issue. *** said that Mrs*** said it was inconvenient for her to bring the boat by since she was on her way out of town. She also states that we lied about talking to ***. This is false. We went to his shop and have a conversation with him and he can also confirm this. He stated that he told her that it COULD be, NOT WAS a factory issue and would tear out his work so we could see the repairs he made. Our company doesn't release boats that have been repaired or altered. If a boat doesn't come out of the mold and meet the specs required, the hull is scraped. She is stating that we repaired the boat before sending it to the dealer. This is because as previously stated, we do not release boats that have deformed hulls. Being that Mrs*** didn't bring the boat to us for inspection and work has been completed on it, the warranty is no longer valid. If she would have brought the boat to us first, we would have been more that happy to inspect the boat. This is no different that what a car dealership would do

This is going to be our last explanation of what occurred regarding this matter. Ms*** is apparently confused about the facts. The facts are that the boat in question was never brought to Bell Boats for inspection and/or repair for warranty work. This company has continually honored all warranty repairs on boats that have been brought to our shop. We cannot and will not honor repairs done by third parties when we are not given a chance to review the problems with the boat. Once a repair is done, Bell Boats is unable to determine the original defect and whether or not it was covered under warranty. *** of ***'s Fiberglass advised Ms*** that she should take the boat to Bell Boats for the repair and she advised him that it was not convenient. This was conveyed to Bell Boats, not only by *** (***'s Fiberglass) but by Ms*** in her conversation with *** ***. According to *** (***'s Fiberglass) he asked Ms*** several times if she was sure that she wanted him to make the repairs, knowing that it was possibly a warranty repair, and apparently, as evidenced by this complaint, she agreed. Each party in this matter can continue to state "he said - she said" but this does nothing to resolve the issue. Bell Boats stands by the products it produces and makes all warranty repairs that are brought to their attention. If there is a warranty issue it must be repaired by the manufacturer or in the event the boat is out of state, pictures of the defect must be provided. We sincerely hope that this explanation resolves this issue. *** ***

I am rejecting this response because: In rebuttal to letter from Shoalwater, they are 100% right about one thingWe don't build boats! We were told by ***; at ***'s fiberglass and repair that the defect was no fault of ours, that sometimes when the boat comes out of the mold they can have a blemish. We took the word of someone who does build boats and repairs them*** has years of experience in fiberglass repairs. After dealing with Shoalwater on this issue and, the lies they have told, I have no doubt if we would have taken it back to them, they would have lied about that too, saying we caused the damage. Its a shame they would stoop to such low standards to save $
