National Fire Adjustment Company (NFA) was retained by Mr*** to assist in the insurance recovery efforts after his property on *** St sustained significant fire damages in May of NFA’s licensed public adjuster, Al ***, was assigned to handle the insured’s claim for both damages to the
structure, as well as loss of rents. Upon retainer, NFA contacted Mr***’s insurance carrier, Allstate, to advise them of NFA’s involvement and request a copy of the insurance policy. Mr*** then began the process of scheduling, what turned out to be numerous inspections of the property, with NFA’s building estimators and AllstateDue to the extensive damages sustained, which far exceeded Mr***’s Actual Cash Value insurance policy he had purchased through Allstate, Allstate raised the question of Market Value, as the insured had originally purchased the property for $17,in December of The initial broad evidence building estimate prepared by Allstate, offered the insured $61,in damages. Upon review, Mr*** was successful in obtaining a revised offer of $85,348.02, an increase of $24,193.13. Mr*** presented the increased off to Mr***, however advised him against accepting. Mr*** felt additional items needed to be taken into consideration and requested additional time from the insured in order to resolve these discrepanciesDuring a sit down meeting between Mr*** and Mr***, Mr*** advised his client that a possible increased offer was under review, totaling $109,000, plus Loss of Rents. Mr*** again advised Mr*** that should he decided to execute the Proof of Loss document which states line 7, “the Whole Loss and Damages was…..$85,348.02”, the building portion of his claim would be finalized and no additional funds would be released by Allstate pertaining to the building portion of Mr***’s insurance claimAgainst Mr*** and NFA’s recommendation, Mr*** insisted on accepting the insurance carrier’s settlement offer of $85,348.02. Mr*** executed the enclosed Proof of Loss form and therefor finalized the building portion of his claim with AllstateIn late July of 2016, Mr*** engaged in a phone conversation with MrPatrick ***, manager of NFA’s Rochester office, as Mr*** had previously inquired about a fee reduction prior to any issues pertaining to the building portion of his insurance claimMr*** had requested a fee reduction on the Loss of Rents portion of his claim, as he felt he had settlement the loss of rents claim without assistance from Mr***. Mr*** advised Mr*** that he was able to secure a payment from Allstate for months lost rent, totaling $10,500. Mr*** reviewed the file and advised Mr*** that the $10,Loss of rents payment he received was merely an advance payment that Mr*** had requested from the carrier. The file notes indicated that Mr*** felt the Loss of Rents exposure might be able to be worked out at the full month allowance afforded by the policyWith the potential for additional funds pertaining to the Loss of Rents, Mr*** inquired if Mr*** and NFA would be pursuing these additional funds on his behalf. Mr*** assured Mr*** that NFA would be pursuing the potential additional funds, however, NFA expected to be paid for services rendered. MR*** then offered Mr***, as a courtesy, a waiver on our fee for the $10,Loss of Rents advance payment, should he be happy with that payment; however, should Mr*** wish to continue our pursuit of the full months Loss of Rents time period, then NFA would expect payment. Mr*** was successful in his pursuit for the full months Loss of Rents claim, thereby securing an additional payment to the insured in the amount of $7,Due to the information provided, National Fire Adjustment Company feels the complaint made by Mr*** has no merit

NFA, National Fire is in receipt of Mr***’s response. As previously advised, MrPatrick ***, NFA’s Rochester office manager, engaged in phone conversations with Mr*** in July of in which Mr*** had initially requested a fee reduction on the Loss of Rents/Income portion of the claim. At that time, Mr*** felt he had settled the Loss of Rents claim, at $10,500, without assistance from NFA adjuster, Mr***. However, during the conversation Mr*** advised Mr*** that NFA believed the Loss of Rents/Income exposure went beyond the $10,previously released, and would like to seek recovery for the full months afforded within the policy (totaling $18,000). Once advised of this information Mr*** had inquired if NFA would pursue these additional funds. Mr*** was advised that NFA would proceed; however, NFA expected to be paid for services rendered. Again, during the conversation, Mr*** offered to Mr*** that should he be satisfied with the $10,as TOTAL Loss of Rents payment, then as a courtesy, NFA would waive our fee on that portion of the loss. However, if Mr*** would like NFA to continue pursuit of the full month Loss of Rents time period, then we would proceed accordingly, but again expect to receive payment, as per retainer agreementDue to the efforts made by Mr***, National Fire Adj was able to secure the full months Loss of Rents/Income claim, totaling $18,000. Therefore, NFA stands by the position in which NFA was fully entitled to receive payment for fee earned and will not be granting Mr*** the requested fee reductionAs previously advised, unfortunately, Mr*** had purchased an Actual Cash Value insurance policy through Allstate. Again, due to the extent of damages sustained, which far exceeded Mr***’s Actual Cash Value policy, the carrier raised question of Market Value. The Tax Assessed Value of the structure, totaling $47,600, was one of the factors used in determining the settlement offer presented by the carrierMr*** was presented with the revised offer, totaling $85,348.02, an increase of $24,from the original $61,154.89. Mr*** advised Mr*** against accepting this increased offer, as Mr*** felt there still items that needed to be addressed and requested additional time from Mr*** resolve the remaining discrepancies
Mr*** went against NFA’s recommendation and insisted on accepting the insurance carrier’s settlement offer of $85,348.02. Mr*** executed the Proof of Loss, which clearly states on Line 7, “The Whole Loss and Damages was…$85,348.02” in front of a Notary Public in NFA’s Rochester office. We have attached an October 6, letter to Mr***, authored by MrPatrick ***, NFA Rochester office manager that addresses Mr***’s concernsDue to the type of policy Mr*** had purchased through Allstate and the execution of the Proof of Loss, against NFA’s recommendation, the claim has been finalized. Respectfully Submitted, Katherine M***National Fire Adjustment Co., IncLicensed Public Adjuster Director of Client Relations
