Review: Shopbevel is a site where jewelry designers can enter competitions where their designs are publicly voted on and winners are selected. The winners enter into a contract with Shopbevel that states: "The designer retains intellectual property rights to the design, including the title and ownership of the design and may continue concurrently selling the piece. During this period, the designer makes herself available for press/media interviews and acts as a supporter of the Shopbevel platform (sharing what Shopbevel is about to her community and network). In exchange, Shopbevel committs (sic) to increasing exposure for the designer by manufacturing the product, featuring the designer in a blog post and across our social media channels and building out a beautiful designers profile with professional photography on our platform. "It also states:"The designer agrees to be paid out 15% royalties on each piece sold but for every piece sold using the designer code, Shopbevel will pay the designer 50% royalties. All paid on a monthly basis by the designers preferred method."One of my designs was selected as a winner. I signed a contract (also signed by Shopbevel's CEO) and mailed it in with my original design (actual necklace, not sketch). I upheld my end of the contract, including promoting Shopbevel via social media and word of mouth and sent several customers their way who pre-ordered my design. I also pre-ordered my design as I was interested in seeing how it turned out.Shopbevel did not manufacture the piece within the said time frame (4-6 weeks). After two months I checked in with them and they said they were merely running behind. Two weeks ago (3 months after winning), I received an email saying they were changing their business plan and would no longer be able to manufacture my design. I emailed them and pointed out our signed contract. I also asked them about returning my original design in its original condition. It has been a week and I have not gotten a response of any kind.Desired Settlement: I would like Shopbevel to honor their contract by manufacturing my piece as originally agreed. If that is impossible, I would like a settlement of expected royalties to the sum of $200 and my original design returned in its original condition. If the design cannot be returned in its original condition, I would like an additional $60 for the loss of the piece.

Review: I purchased a "groupon" for this company, yellowsmith.com for a custom made charm. I provided them a photograph of what I desired, and received an email with a blueprint of my design, stating that I had 24 hours to respond with any changes on the design or production would continue as displayed in the blueprint. I responded within approximately 5 hours of receiving this email, stating that the blueprint was not exactly as I had pictured, and gave a few descriptors of what I had in my mind. I included a few photographs of other designs that were similar to my idea. The response I got was rude and condescending, stating that there was no way that would work. I responded that I did not appreciate the condescending tone of the email, and if my idea would not work out, I would like to go with a different design. Almost 36 hours went by and I did not hear a response. Yesterday morning, 1/**/14, at approximately 7:30am, I received an email stating that, quote "Unfortunately, we cannot take accept this order any longer as it has breached our cutoff date for charms." I was instructed to contact groupon for a refund and that they would not be making my product any longer. I complied with all directives of responding within the allotted 24 hours, and if any cutoff dates were breached, it was because they did not respond in a timely manner to my emails because they did not want to respond to my confrontation of them being rude. I have included the complete, unedited email exchanges between me and their customer service person, [redacted] Delarosa, below. I would also be happy to email you copies of the email exchange, should you desire them.

HI there!

Here are proofs of your three charms. Please let us know within 24 hours if you have any changes before we move directly to production.

Thanks.

Hello,

After reviewing the proof, I don't think it's quite what I had in mind. It looks like the words are going to be engraved in something that looks sort of like a dog tag. Is that correct? If so, I really had hoped to have the letters free standing and attached to a chain. I included a few pictures to try to illustrate what I'm thinking. Let me know if this is possible, thank you!

We can't make the letters freestanding when they are not connected. How would they connect?

Cursive obviously works, but printing does not.

Jan ** (3 days ago) to info

Couldn't they be connected by putting a small bar between each letter? I've seen it done before, and I believe this is demonstrated in the examples I included in my previous email. As an aside, I don't appreciate the condescending tone of your last email.

Let me know how to proceed. If the letters cannot be connected somehow, I would rather go with a different design completely.

[redacted],

That will break and we don't produce jewelry that will break. Unfortunately, we cannot take accept this order any longer as it has breached our cutoff date for charms. We will move forward with a refund on any tax and shipping incurred on our side and you can contact Groupon Customer Support for a refund on the charm.

Jan ** (1 day ago) to info

Wow....just wow. You ignore my email for almost 36 hours and then say the cutoff date for charms has breached? And now you won't accept my order? I have contacted groupon for a refund and have also let them know about your poor business practices. I have copied and pasted our email exchanges for groupon to read so they can know exactly what transpired during this conversation. Turning away people's money because (a very mild) confrontation is uncomfortable is a perfect way for your business to go out of business.

Furthermore, it is sad for me that you wouldn't create my order or try to work with me in some way. My husband wrote those words and is being deployed with the Air Force. I would have loved to have this creation in some fashion to help comfort me while he is gone for almost a year. Perhaps I will have to look for a company with more integrity. I will also be passing on to my friends, family, and review websites the service I received here in hopes that other people will not give their hard earned money to such a company. I strongly urge you to reconsider your business practices and perhaps take a few business courses at a local college.

Jan ** (1 day ago) to info, me

We've refunded you for the taxes, but the rest needs to come from Groupon.

Thanks.Desired Settlement: I have contacted groupon, but have not yet heard back yet. I request a full refund due to yellowsmith refusing to complete my order due to their own breach of the "24 hour response" requirement. Furthermore, I would like the Revdex.com to have a record of what type of service this company is providing, especially to US military service members and their families. It is completely unacceptable and I have never felt more wronged by a company.
