Complaint: Advertise 3% of the sales price to negotiateTruth: We advertise 1% of the sales price or $- whichever is greaterComplaint: Advertise that the agent will not pay, that the bank will pay.Truth: We have never advertised that the bank will payPrior to taking on any file, we fully disclose to the agent(s), sellers and buyers about how we get paidThe agent can avoid responsibility for our fee if the contracts are set up appropriatelyBefore we work on any file we require that ALL parties understand and sign our contractsOur contracts detail each party’s responsibilities as well as the fee structureIt also makes the listing agent aware that he/she is ultimately responsible for the feeIn this particular case, we have five (5) contracts fully executed by all partiesAs a licensed agent, it is Mr [redacted] responsibility to review and understand any and all contracts he signs and presents to his clientsSo he was fully aware of the processing fee and how it was to be paid not only by signing the contracts, but when he asked for clarification about our fee - the negotiator and then one of the owners had several conversations with him to address his concernsEven after his first buyer cancelled the sale and Mr [redacted] was offered the opportunity not to proceed, he again chose to retain our services and instructed us to continue working on his fileUnfortunately, as his buyer reneged on the contract, the burden of the fee fell on the agent.Complaint: The agent is stuck with the bill, and will be left with no commission.Truth: In this particular case, the negotiator obtained lender approval for the sale, which included full agent commissions on both the Listing and Selling sidesAs Mr [redacted] represented both sides of the transaction, he was paid the full commissionAs mentioned previously, the buyer refused to pay the processing fee per the signed contract so Mr [redacted] was responsible for the fee.We are sorry that Mr [redacted] is unhappyHowever, as we fully explained to him about how we get paid, and gave him several opportunities not to proceed, we are standing by our contracted agreementWe provided excellent service - which not only resulted in a successful sale (including paying off a substantial HOA lien) with full commissions to the agent, but also gave the seller $10,for moving costs and covered the buyer’s costs as well
