Review: In September 2013 I bought a Parker shotgun from Shotgun Johnny's thru the internet site gunbroker.com. I sent them a money order for $5,934.85. The seller UPS'd a shotgun with a cracked stock. Photos were sent to the seller verifying the defects. Purchase terms were stated that I could get a full refund plus cost of shipping if not satisfied within three days. The seller acknowledged that those terms were met but refuses to refund my money, claiming that he is first trying to get an insurance refund from UPS. Gunbroker.com has been no help. After almost nine months, I'm doubting if they have any intention of ever refunding the money. I have many emails and photos to document this transaction and complaint.Desired Settlement: Shipping and insurance back to California will be $84.85. I am due a refund of $6,019.70. Then the defective gun will be returned to Shotgun Johnny's. They can still negotiate with UPS about their original insurance claim.

Company responded stating that when the gun left it was in good condition (we have pictures). UPS picked the gun up and delivered it. The company called UPS and turned the pictures over to them for insurance purposes and the claim was denied. I also sent the pictures to the consumer.

[redacted] - In my opinion, this attached document is the most important part of the dispute.
It states the gunbroker.com inspection period and return policy is "three days from the date the item is received, including the cost of shipping." This can not be disputed.
We met the three day criteria with the immediate rejection of the shotgun. In fact, the return policy does not even mention the condition of the gun. We would have the right to return it even if it were in 100% A+ condition, which it clearly is not.
As previously stated, I am entitled to my money back according to the written terms of this return policy. The seller is still free to pursue any insurance claims against UPS when we return the gun to him.
