June 1, 2016To Whom It May Concern:I am writing in response to the above-referenced matter.I completed an estimate for the customer in the complaint on April 13, 2015 at her home. I provided a copy of the estimate for all of the recommended tree work to the customer totaling $1405.00 (See attached...

redacted proposal). I spoke with the customer at her place of employment in November 2015 when she told me to complete all of the work at her home.  She also spoke with my wife where she indicated to her. “Tell Mr. Shull to just get the work done!  I just want it all done. The tree work was completed as indicated on the estimate on January 14, 2016. The customer never indicated that she did not want the work completed or partially completed. When the customer contacted me after the work was done, she asked if she could make payments to pay the full amount ($1405.00) to which I agreed because my family has been going to her family business for over 5 years and wanted to give her the opportunity to make payments. The customer made two (2) payments- one in the amount of six hundred ($600.00) dollars and the other in the amount of one hundred ($100.00) dollars.  Months went by since I heard from the customer regarding further payments toward her bill and I reached out to her asking if she could have her outstanding balance paid by the end of May 2016.The customer indicated that she could not pay that balance by that time frame and asked if she could continue to make payments toward the full amount and I agreed to allow her to continue to payments toward her balance. The customer never once disputed the amount that was completed on her property and only asked to be able to make payments toward her bill. I am hopeful that the customer will continue to make payments toward her bill; however, I have already given her a discount toward her estimate and cannot accept an additional fifty (50%) percent off of her outstanding balance. The customer can continue to make monthly payments in the amount of one hundred ($100.00) dollars until her outstanding balance of seven hundred ($700.00) dollars toward her total amount of $1405.00 is completely satisfied with my company.If you would like to discuss this matter further, please do not hesitate to contact me.  Sincerely,Edward  S.Owner

I am completely dismayed with what they have to say. I will address the letter sentence by sentence. However before I do I would just like to say every other tree service I have dealt with in the past gave me a courtesy phone call the night before, this company chose not to, for if they did none of these issues would have taken place as they did. As you can see several months occurred between each instance. I would imagine a call the night before to move vehicles and make sure everything was still ok to proceed would be a necessary precaution. Is this not a standard business practice for a tree removal service? The other thing which I am now more alarmed with then any issue I already had is that there is a signed contract attached. I NEVER SIGNED ANYTHING. This signature is not mine and nor did I sign anything with him ever. I am extremely shocked anyone would have the audacity to sign my name as to something I have agreed to, when I clearly DID NOT. I can provide my signature if necessary however this is not even close to my writing. We also only talked and I told him that I did not want my stump removed we had agreed he was able to make an exaggerated long stump and cut a seat in it. However due to the intervals in time he has no recall of anything I said. I also stated at that conversation I didn't want everything done, just the back tree cut and a "chair" created and the front tree trimmed. If you look at the estimate he attached the first line states what I called him for "rear tree dead or dying? Remove, front tree prune" and this is what I agreed to pay for during the discussion we had  in Novemeber. It was also at that time I told him I would not be able to pay in full and could I pay over a few months. He said that was fine, now I am assuming cut tree at $495 and prune at $120. And a little additional to make the chair as we had discussed. Please see his attachment as to what he quoted. All of the other items were an FYI however not what I called him to give me an estimate on. Which is very evident by the first line of his document. There is even a line on the estimate to remove my neighbors tree, which is not me property and surely nothing I could have removed as this is not my property. So I could have never signed this due to the simple fact I can't legally remove my neighbors tree without their permission. Gina S[redacted], Ed's wife would not speak to me about anything business related, she would always give me Ed S[redacted]s number to call him direct. So never did I tell her I wanted everything done. She would not even give me the address to send a payment to. She gave me his phone number. Never once after the fact did I receive an invoice stating any certain amount of time he wanted payment. If he had planned on it being paid in 3,6,9 months etc. nothing at all.... I had to make contact to find out what the address was. His wife wanted no parts in any business with me, nor did we ever discuss anything about it. On January 14,2016 when the work was done I was in complete shock. We had not talked in two months and I assumed he was not ok with the payment arrangement and had decided to not complete the work. My boyfriend stopped home and first assumed our neighbors were having tree work done and then when they almost dropped branches on his new [redacted] realized these people were on our property cutting trees down. I was so mad I could not speak. Why would someone show up to do work on my property without calling. My mom called his wife Gina immediately and the only thing she said was did your daughter sign a contract. My mom said no and she said I'll have Ed call your daughter direct, again not wanting to be involved at all. He called me and I told him how upset I was and that it was not what I had asked for and I could not believe he showed up like that. With such a long period in between and no signed contract it is obvious how mistakes like this could be made. He kept saying he didn't remember our conversation at all. He only remembered me saying I couldn't pay all at once and that I wanted it done. Instead of what I would have thought was important what I actually wanted. He even told me it was my responsibility to remove my neighbors tree, I may be young but not stupid. Without their permission I could not legally remove their tree or any other of their property. It says his letter I never stated my disatisfaction, which is utterly not true from the day he showed up he knew I was extremely mad. He even said to me on the phone he was surprised I was being as calm as I was, but he is now saying we never spoke at all since he did the work?? He told me to go home and look at how good everything looked and to call him back. I never called him back and he called me again a few weeks later. I told him everything did look good but it was again not what I asked to be done. I said for he sake of our business relationship I would just pay but it was going to take me even longer as I did not plan on the amount to be double what I originally anticipated. I made two payments and if you look at the second estimate he submitted he dated the payments at the top. They were $600 on March 25 2016 and $100 on April 22 2016. I told him on the phone when I got my tax return I'd pay a good chunk, as I stuck to my word as you can see. On April 29 2016 he states in a text message to me at 4:47 pm                      "[redacted] Edward S[redacted] I am contacting you regarding your invoice. I am going to need this invoice squared up by e end of May, otherwise I am going to start charging interest retroactive upon when it was completed. Thank you for your kind attention to this business matter. Sincerely, Edward S[redacted] // ; 4/29/16"I asked to talk on the phone and he would never call me back. So I am not sure where he gets that "months went by since I heard from the customer regarding further payments towards her bill." I did indicating that I could not pay because who can come up with $700 with no notice, however as you see by his documents it had only been 7 days. So I am not sure what he is talking about. Seems to me like he was just trying to bully me into paying, however I have not since the work was completed received any sort of bill at all. I would like direct your attention to the estimate, it says at the mid bottom right this proposal may be withdrawn by us if not accepted within 10 days. The date on the estimate says 4/13/15 and then it was supposedly accepted 11/20/2015. And then the work completed on 1/14/2016. I am not even sure how this could even still be a legitimate bill or estimate when they wrote themselves that it is withdrawn after 10 days. A new estimate should have been created and signed by me before any work was completed. The time line is too spread apart for anyone to remember anything said between two people months before. Especially with nothing written down at the said Novemeber 20 2016 meeting stating the changes that he can't remember I made....again a simple phone call the day before would have cleared up all of this confusion and misunderstanding.What surprises me is that he is still concerned only about receiving money. Not at all about all of the other issues at hand. As you can see by his response, the only thing addressed is money related. Not about why he just showed up without confirming after two months and forged my signature.Thank you for your time,[redacted]
