See attached documentOctober 5, 2015To whom it may concern:This is my response to the allegations made by *** ***.*** *** and his wife first looked at the home at *** *** *** on Sunday September 13" with Teresa D***, He then asked Teresa to prepare an offer to purchase for the
two of themHe later requested she redo the paperwork as the offer was to be in ***'s name onlyThis offer was eventually accepted by the sellers.There were many question concerning whether or not the property was in a flood plainTeresa had gathered information from *** *** from the City of *** *** was not satisfied with *** ***'s response because he was receiving different opinions from other sourcesUltimately he requested to be released from that contract on September 17thI also signed the release of contract (see attached).A few days later, Teresa D*** and Anessa H*** approached me to discuss a buyer that was now working with Anessa and Wished to write an offer on *** *** *** It was *** ***Teresa gave Anessa her blessing to go ahead and write the offer and she would present it to the sellersShe expressed it was her goal to get this horne sold for her clientI learned later that *** requested that Anessa be present when his (now 2") offer was to be presented to the sellersOn Wednesday September 23rd Anessa, Teresa and the sellers met at the *** office of Sibcy Cline to review the offer,I returned to t the office approximately 7:pm from a meeting at the *** City building (across the street)Anessa and I had a brief conversation in the parking lot regarding a "sudden death" versus a “first right of refusal” noticeI explained the differences to her and she left to go home to prepare dinner for her family.I entered the office only to be question about the very same thing with the sellers and Teresa D***Once again explained this was not relevant to this offerWhile in the room with the sellers, it was mentioned that this offer called for 4% in closing cost ($3200) whereas their previous offer requested $in closing costOther items included in this new offer had the sellers paying for a home warranty of $and $in an owner's policy of title insuranceIn all, this new offer was about $less to the sellers than the previously accepted offer written Sept 13thThe other item we discussed was the amount of time requested for a loan approvalThe request was daysIt's my understanding that while Anessa was present during the presentation of the offer, the closing cost and days for approval were also discussed and perhaps marked out and changed to the same as their offer written Sept13th.I had noticed while reviewing the contract with the sellers that no initials were entered at these changes to the contract, then left the conference room and returned to my officeBefore leaving the building for the evening, Teresa approached me to ask if it was necessary for the sellers to initial all the pages if they desire to reject the entire offerI stated it was only necessary to sign the last page along with their intent to reject the offer.I was told that a copy of the rejected offer was left at the office for Anessa to give to the *** and that either a voice mail or e-mail also was left for her telling her they had decided to reject his new offer.On Thursday Sept 24" received a call from *** *** (General Sales Manager of Sibcy Cline) after he received a call from *** ***Bob suggested *** call me, which he did*** began making allegations about things involving me that were not trueHe accused me of encouraging the Seller to reject his offer (which he insisted was the same as his previously accepted offer)He told me that Anessa told him she saw the sellers sign it and that I destroyed the copy they signedI did no such thing| explained to him that what Anessa may have witnessed was the discussion of possible changes but that what I had witnessed nothing was initialed or signedHe said I was lyingHe asked me to send him a copy of both his original offer written with Teresa (and later released) as well as a copy of the offer that was rejectedBefore I hung up with him was told he was going to file a complaintBefore leaving the office I scanned and e-mailed him a copy of both offers and carbon copied *** ***.The following day I had a conversation with Anessa regarding her communication with ***She said he had called or sent her several text messages wanting to know if she had an answer, She told him that she believed the seller was going to come back with changes that would reflect his offer written Sept 13th, but she didn't have it in writing yetIt wasn't until the next morning when she saw the rejected Offer left for her at the office.*** ***'s claims that I destroyed or forged signatures on any paperwork are all falseThe decision to reject his offer was that of the sellers.Thomas JH***Sibcy Cline Realtors

I understand you are frustrated trying to get your home sold.Your home was listed on June 2", as a possible short saleYour bank requires an application for loan modification prior to them looking into a short sale.It took quite a while for you to supply all of the documents to the bankIn
August the banks policy was to have you decline the modification (it was approved) and apply for a short saleOn September 24" the bank received your decline paperwork.Unfortunately you were declined for a short sale and the bank would only provide a loan modification.Since you can’t sell your home, you were sent a Cancellation from Sibcy Cline on November 16, We never heard back from youOn December 1, another email was sent to you by your agent explaining the cancellation for IIn you needed to sign.This is something that you and the bank need to resolve

See attached documentThe house in question at *** *** *** was initially put on the market on November 12, Due to little interest, the owner decided to rent the house during the attempt to sellSometime in June, 2015, tenants were secured and on or about the same time I received a
call from *** *** who was expressing interest in purchasing, I then relayed the information to the seller who explained they had a 1-year lease agreement with the new tenants, but would be willing to sell if the new owners would uphold the current sease agreement with the current tenantsWith those instructions I then proceeded into negotiations with *** ***, however, in the interim, I was instructed to remove the house from the Multiple Listing Service (MLS) by the seller and did so on July 7, After explaining the renter situation to *** ***, sometime later she agreed to the terms of keeping the tenants and we then signed a contract on July 25, and at that time I received a check for the earnest money from *** *** in the amount of $500, During the negotiations and before a contract was signed, I returned the house back on the market and to the MLSOnce the contract was signed on July 25, I was working attentively to get a closing date scheduledWe were all in agreement that August 25, was a good tentative date and we all put that on our calendars, hoping for a date soonerLeading up to the closing, on August 19th, I was informed by *** ***, representative from *** *** that there was a lien on the property from the previous owner*** *** was working diligently to get to the bottom of the issue regarding the lien, but told me of the difficulties she was having due to the previous title company, (*** *** *** *** ***), no longer being in businessDue to these discrepancies, we could no longer move forward with the currently scheduled closing, so it was cancelled in hopes to be rescheduled very soon, once the lien was taken care of.After several phone calls and email to the previous home owner, his personal attorney, the *** ** *** ***, *** *** *** ***, and the *** ***'s law office that handles collections on liens, *** *** Informed me that she had hit a dead end and passed alf of her findings along to the seller, she had exhausted all of her resources and informed the seller that there was nothing more she could doHer findings revealed that the lien was for $120,from a *** *** Clairm filed to the previous owner and it appeared that the lien was placed on the home during the same time frame that he was purchasing the home, (back in March, 2010)This was very difficult for the seller to swallow, because when he purchased the home, he paid $to the title company (*** *** *** *** ***) to insure a clear title, only to discover that a lien has now been placed on his property and the title company he paid is no longer in businessHe felt he was an innocent victim and proceeded to contact the previous owner's attorney as well as the Ohio State *** ***'s law office in an attempt to resolve this matter and have this lien removed from his property that he feels was placed erroneously, in order to move forward with the saleIn an honest noteworthy attempt to move forward with the sale, the seller even offered to pay a portion of the lien, however was being told different amounts from different individuals that would be considered acceptable, and at the same time make sense financiallyDuring these negotiations, when the seller first had hopes that this matter was going to be resolved, I took the initiative and contacted *** *** explaining what was happening and advised her that we were hoping to have this matter resolved soon and were hoping to be able to finally close on the property on November 5, At no time was this ever a confirmed and scheduled closing, but rather a tentative date based on the information I had been providedUnfortunately, the conversations the seller was having turned south and the Seller was unable to get definitive answers from any of the agencies or individuals previously mentioned to determine a clear course of action to get this matter resolved and get the title clear.With regards to the errors mentioned on the *** report, I forwarded the buyer's concerns to *** *** and she explained that details on the *** reports change regularly and she would acknowledge any concerns at the time of closing.This is a very unfortunate situation, one where the seller does not want to back out of the sale of the house, nor do I want this deal to fall through as the realtorI have many hours of my time invested in this transaction and only upon completion and finalization do I receive any compensationEver at this late juncture, the seller is still pursuing every opportunity in an attempt to get this lien issue resolved.I understand the frustration of not having definitive answers, but I have done everything in my power to keep all parties informed and have gone above and beyond to satisfy the needs of all parties to the best of my abilitiesI was always honest and forthcoming and shared the findings with all parties in a timely fashion.Sincerely,Robert *** W*** Sibcy Cline Realtor

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint This entire reply is nothing more than liesAnessa H*** contacted me via phone in which I have a copy of her calls, texts from my phone providerThe fabricated contract that was rewritten to cover Tom, Teresa has conflicting times based on when I was told that the offer was accepted by the sellers in which, Anessa told me to proceed with an inspectionAnessa also told me on the phone that Teresa and Tom influenced the sellers to back out by secretly going behind her back after she left the officeThere is absolutely no excuse that the 2nd contract that provided additional paid documentation we bought for a flood recert along with the same offer wouldn't had been approved by the same sellersIt was and I was told by Anessa that the sellers signed the conteact in front of herIt was Anessa whom told me and my wife that she wanted to be present at the offer being presented because she along with fellow employees had seen Tom and Teresa sabotage deals before, she also admitted to having problems with both Tom and TeresaShe told me if she gave us that signed copy that she did have on her when she left the office she would be firedShe admitted to Teresa, Tom having a close relationship in and out of the officeShe also told us that Tom said to tip Teresa because she would not be getting dual commissionThere are quite a few issues, legal contracts being forged, rewritten, disposed ,etcMy wife was told by another Sibcy Cline realtor this week in Indiana that they could not show her a property because I filed numerous complaintsThat is also a form of retailation from Sibcy ClineIf they are OK to do such a thing, then clearly they are more than OK to sabotage a deal due to Teresa not getting dual commissionAnessa H*** added 4% closing costs in which she text me, I kept this along with phone calls in which I told her that was her decision to add 4% and I would pay the difference therefore it was the same contract as the first one that was acceptedAnessa H*** added a one year warranty, Teresa D*** told me with the first offer that I wouldn't need a warranty therefore never presented it to the sellersAs of this week, I approached another realty group to write a back up offerThe offer is at full price, with earnest moneyI was told that Teresa D*** advised the sellers not to take the offer if the current contract does not work outI also attached a copy of my bank pre approval for $148,since Teresa stated in front of a fellow employee that I would never find a home as she made light if a serious buyer trying to find a home for his family*** took us almost a year to find because we needed to find a home that would be handicap accessible for my wife whom has cancerTeresa and Tom also did not take my offer seriously nor myself as a consumerThere is absoloutely no valid reason but lies from Tom, Teresa on covering up a contract that they influenced and disposed of signed agreed documents by the sellers.I am not happy with Tom's response, in fact, I was also advised the *** *** *** to approach another avenue regarding Fair Housing.Sibcy Cline had more than over weeks to make matters right for me, the seller and also the buyers whom they mislead on what should been a very easy contractSince Teresa did not get dual commusiion, Anessa warned us she would sabotage the contractAnessa also gave us information on filing a complaint before she even presented the offer because as she stared, Teresa and Tom will sabotage the dealThey have done this before, in which, I am still shocked that an acting manager would do such a thingTom also as the manager told the sellers it would take days to close in which, I already told Anessa it woukd take days for closingThis was just another poor excuse to cover Tom, Teresa destroying legal documentsTom as an acting manager told me on the phone that he did not even understand how a VA loan worksThat is a disgrace to any Veteran when a company has a manager representing a company that is not fully educated on a topic he or she should know by hand.This, along with other complaints will or are have already been filedThe only way Sibcy Cline could had turned around what they did to me the consumer was to make matters rightInstead, they brushed me off as Anessa said they do to others, now as well of this week they are keep me from viewing other properties as they just dig themselves deeper into a very serious matter

Sibcy Cline was who I was dealing with. They indicated things to me. I never dealt with the sellers. It's Sibcy Cline who is the point of contact. I am unhappy, as it was represented to me that I was getting a real working microwave, represented as part of the appliances included. When she pushed the button in, she just drove off with it still running, a fire hazard. It wasn't just the microwave, it was how the whole thing was handled, lack of key and walking off saying "it's your house now."

leave several appliances, including the microwave. Never did the sellers mention an issue with the microwave to [redacted].After the contract was executed by buyer and sellers, buyer had a home inspection performed, [redacted], nor anyone from Sibcy Cline, was present at the home inspection, but its purpose is for a licensed inspector to check the home for hidden defects.After the home closed, and the occupancy period was up, [redacted] obtained the keys from the seller. She met [redacted] at the home to give her the keys. The front door key didnt work. [redacted] and [redacted] were able to enter the house and [redacted] pushed the light button on the microwave to See the keys, she did also push the fan button while she was looking for the light button. Both the light and the fan appeared to be broken and neither would turn off.[redacted] asked [redacted] to check with the sellers about the key and the microwave. [redacted] called the sellers, who informed her they would not pay for anything else regarding the sale of this home, and that the keys they gave [redacted] were the only keys they had and they believed them to include the same key as was in the lockbox that worked for the front door, [redacted] relayed this information to [redacted], who then told [redacted] she should pay for the microwave and to purchase a key, [redacted] reminded her that she paid for the reinspection of the house after the repairs were made on her behalf since neither her nor the sellers would agree to. [redacted] did this as an option to facilitate the transaction since buyer and seller were at a standstill over the costs.[redacted] called me, as office manager. I explained to [redacted] that I would speak to [redacted] and get back to her. I called to inform her that [redacted] spoke to the sellers and they will not agree to any repairs or any costs of repairs as they felt theyd given enough. I also explained that [redacted] never lived in the house, never used the microwave and obviously had no knowledge of whether or not it worked or was broken. I also informed [redacted] that it would always be a recommendation to replace house keys after transferring ownership as buyer has no idea who sellers have given keys to and how many are out there,[redacted] proceeded to call [redacted], General Sales Manager at Sibcy Cline. [redacted] called me to inquire about [redacted]s complaint. I updated [redacted] as to exactly what was discussed and that the Sellers would not agree to any repairs.This is an unfortunate occurrence, but the purchase contract is between the seller and the buyer. Neither the Realtor, nor the real estate company has any knowledge of whats broken or operating in a sellers home.
