I am rejecting this response because: I am rejecting this response because: That is informationI spoke to [redacted] on Feb 26,asking for her to hold an upstairs unit for meI dropped off a NEW check for my holding deposit because they did (or I hope they did) shred my first check for when I was thinking about Renting from them first time aroundI do have a copy of those checks so I don't see how [redacted] can say she used the same holding deposit because these are different incidencesI was able to have my brother drop the NEW check off on Feb 27,I did make an appointment with [redacted] to see this apartment I'm holding on Mar 1,at 11am but had to change the time to 1pmI did come in to view the apartment with my daughter and my boyfriend to find out the apartment they were going to rent out to me was a downstairs unit and the location was not to my liking and on top of that they disclosed to me that there was a death in that apartment so definitely I wouldn't fee comfortable in the apartmentI was disappointed they didn't deliver what they promised and did tell Nic that same day that I was not interested in the apartmentI was well aware of the hours withdrawal timeline and I followed that policyUnfortunately the company did not follow their own policy because I found out that they actually deposited my check on Feb 28,one day after I dropped off my check and didn't wait on whether or not I want to rent the apartment Also the fact that after I discovered they deposited my check, and after repeatedly trying to get a hold of [redacted] to resolve the issue, to no avail and when I finally got a chance to speak to [redacted] on Mar 21, 2014, she did promise me I will get my refund with the approval of a " [redacted] " from their corporate office, and I should get my check within a weekIt's now May 14, and still nothingI was able to obtain the phone number to the corporate office from [redacted] herself and when I didn't get my check as she promised I called to speak to [redacted] at the corporate office to be told by [redacted] that she does not oversee Siena Vilas I was constantly being misled and given information and to be "stolen" from and don't feel this is how a company should operateI want my holding deposit back because it was not for the company to take, just to hold, and they weren't given the authorized to deposit my check when there is a hour policy in effect of which I KNOW I withdrew from the hold in time

Company states that the consumer made a deposit and we held an apartment for herThe consumer never came in for that apartmentWe let her know that we would hold the deposit ( deposits are refundable but in this case the consumer left us holding an empty apartment so the damages exceeded the
amount of the holding deposit) despite the fact that she owed us for not occupying the apartment that was reservedAbout a couple months later the consumer came in again and wanted to rent an apartment so we applied the old holding towards this new apartmentOnce again the consumer did not show and left us holding an apartmentReally the consumer owes us money for holding an apartment for weeks that she never showed up for but we are not charging herWill we not be refunding the holding deposit

Unfortunately the company did not follow their own policy because I found out that they actually deposited my check on Feb 28,2014 one day after I dropped off my check and didn't  wait on whether or not I want to rent the apartment.  Also the fact that after I discovered they deposited my check, and after repeatedly trying to get a hold of [redacted] to resolve the issue, to no avail and when I finally got a chance to speak to  [redacted] on Mar 21, 2014, she did promise me I will get my refund with the approval of a "[redacted]" from their corporate office, and I should get my check within a week. It's now May 14, 2014 and still nothing. I was able to obtain the phone number to the corporate office from [redacted] herself and when I didn't get my check as she promised I called to speak to [redacted] at the corporate office to be told by [redacted] that she does not oversee Siena Vilas.  
I was constantly being misled and given false information and to be "stolen" from and don't feel this is how a company should operate. I want my holding deposit back because it was not for the company to take, just to hold, and they weren't given the authorized to deposit my check when there is a 72 hour policy in effect of which I KNOW I withdrew from the hold in time.

Review: On Thu Feb 27 I dropped off a $200 holding deposit check for an "upstairs" unit promised by [redacted] . I went in, by appt with [redacted], Mar 1, 2014 to view this apt unit, to make sure it is a unit I want and to find out that it was a lower unit and just wasn't to my liking, so I told Nic I was not interested in the apartment, therefore take me off the hold.A week after, I noticed my check was actually cashed on February 28, which was confusing to me as to why Siena Villas cashed my check the very next day after I dropped it off, when there is a 72 hour withdrawal policy in effect and I made it clear to Nic to cancel the hold way before the 72 hour deadline. That check should've been shredded or mailed back to me.So I called and spoke to Nic on Fri Mar 7 regarding refund of the holding deposit. He told me I have to speak to Teresa and to call back Mon Mar 10 because she was gone for the day.Mar 10, I called Teresa and explained to her the situation. She told me I exceeded the 72 hour deadline so I won't get my deposit back which I don't understand how from Thursday to Saturday is pass 72 hours? The math doesn't add up. She then told to talk to [redacted] because she makes the decision on refunds. A few days later I called [redacted], who said she'll research into it and get back to me. A week went by, and I never heard from [redacted].Mar 20 I called [redacted] again to check status and again was told I didn't withdraw the hold within 72 hours but there was a "[redacted]" from corporate office at the property giving authorization for refund and per [redacted] I should get the refund mailed within 7 days. As of April 14 still no check arrived. I attempted 2 days in a row to get a hold of [redacted] to see what's going on. I left repeated messages to have her call me back since she was either "too busy","left for lunch" or "gone for the day" yet no returned phone calls from her but spoke to Teresa on April 15 who said [redacted] denied ever telling me a refund was going to be issued yet she indeed did tell me differently.Desired Settlement: I would like my holding deposit refunded to me. I followed Siena Villas' policy and withdrew my hold within the 72 hour period and expect them to follow their own policy. It was very unprofessional and extremely poor customer service of [redacted] to mislead me and tell me one thing and later denied that she ever said it and never even returning any of my phone calls to give me the status of the situation. She should be reprimanded.
