Complaint:
I am rejecting this response because:
This is a follto a previous complaint that I filed with the Revdex.comIn the course of filing and working through the original complaint, I was contacted by Sierrascapes and informed that the previously agreed upon work would be done within daysI accepted that guarantee of future work and am now filing a new complaint because the promised work has NOT been completed nor have I been contacted by the vendor to schedule a new date(Previous completion date should have been in May 2016.) I therefore would request that the original complaint related to warranty work be revisited by the Revdex.comThe original complaint relates to vendor promised work to revisit my home and professionally "sweep" and add new Zeolite crystals to the artificial turf the vendor installed last yearI have attached documentation related to the original complaint whereby the vendor promised to perform work by a dateI am requesting that the vendor return to the job site and perform the promised work; 1) Use a professional-grade, OEM recommended sweeper on installed artificial turf 2) Install / infill Zeolite crystals into / onto installed artificial turf according to manufacturer specifications

Complaint:
I am rejecting this response because:
I reject and dismiss the response and would point out that should I desire to do so, I could file a BREACH OF CONTRACT law suit against MrGarcia for failure to comply to with the previously agreed upon contract agreement (attached for public evidence and record)For the record, I reserve the legal right to still do soI find it interesting and laughable that the response is worded as if every call is returned in a timely manner To any reading this, know that this contractor will be eager to have you sign a contract and accept a deposit check but when it comes to starting or completing your project, I hope you have LOTS of patience for excuses and time to wait for a completed project I should have known from the very beginning that this would have been the case when I called MrGarcia to the proverbial carpet in mid-August after returning from my honeymoon only to find the promise that the project would have started to be broken and replaced with excuses as to why he and his crew of undocumented workers would not start my project for another week+ This same behavior continued throughout the job and while it is correct that I watched nearly every action, I am not a professional contractor and am unable to proactively identify when shortcuts are being taken.
In response to the comment that I accepted the verbal offer to have my turf raked and I would pay for the ZeoLite...I do acknowledge that conversation and agreement but would add that shortly afterwards I had a memory of the signed document and SIGNED CONTRACT to revisit my job site and 1) drain and refill the waterfall reservoir 2) Rake turf and re-apply ZeoLite...BOTH AT NO COST TO ME
In order to rectify and remove this complaint, I seek fulfillment of the two items indicated above...both a no cost to meRegards,

Below is my response to the complaint filed against me:
Yes, it was taking a little longer to complete the project but there were many factors that caused the delay. One being from both parties not wanting to understand...

that things happen. I texted R[redacted] on September 22, 2015 to pick up the material after no response I tried calling her but was unable to leave a voicemail. This has happened more than once.At this point I have the legal right to complete the project but I am willing to settle out with the customer for $1,000.00. I have to return the fire pit caps, the vendor has agreed to accept them back because they sent me the wrong size ring. That credit will be given in the customers name on the receipt from Thompson's Building Materials. That credit is only to be used towards the purchase of the 2' radius fire pit ring that is needed to complete the fire pit.  The customer needs to place all 9 pieces in their driveway undamaged because I don't want to enter their property. I have pictures of the condition they were in before I was run off the property.
I will return the merchandise and forward the receipt and the difference of the settlement of $1,000.00 to the Revdex.com. I will need a release of liability on the contract from R[redacted] sent to the Revdex.com.
If this is not acceptable I will return to finish the job.

Its funny how a person can accuse somebody of not using the right materials. Mr. S[redacted] was present when I used Zeo-fill on his artificial grass back around October 2015.Then 6 months later fill a complaint. I have prof of communicating with Mr. W[redacted] from 4-15-2016 to 5-09-2016.Mr...

W[redacted] called me on a irrigation problem 4-28-2016.I went to him on June 4 and found a leak behind the wall. It was repaired that day. I then mentioned that I would be happy to come back and comb the grass again out of the kindness of my hart if he would supply the Zeo-fill. He was very happy and said absalulty thank you very much to my face. I then told Mr. W[redacted] to turn on water on Monday to let the C[redacted]'s glue set properly. Mr. W[redacted] Sent me a txt  5-09-2016 at 9ish and said there was another leak. How does someone know there are 2 leaks when the water is off. I was out of town and did not get his txt until  Monday until 5-11-2016.How can he say that he sent me numerous txt and calls me with no response .That is so not true. When ever a consumer calls another person in it give there opinion of someone else's work never comes out good. Is this person even licensed? Because they are out for them self's and to get more work for them self's. Mr. W[redacted] paid me in full over 6 months ago. I can only imagine what the other person said about me witch made Mr. W[redacted] freak out. Mr.W[redacted] is a type of individual that shoots first then asks questions later. Revdex.com:
I accept the conditions, but would like to state a few things clearly for the records.
The reason for not answering the contractor's last text was because, in previous text exchanges, when I informed him about the complaint against him, he asked me not to talk to him anymore and he wanted to only talk when the board contacts him. He also, used the word "Harassment" in his text. Hence, I did not want to directly communicate with him anymore. I have the text to prove it.
I never got a call from him, call records can prove it. And I never got a complaint that people could not leave a voice message on my phone. The contractor is working in my housing community currently and could have just stopped by and discussed matters if wanted to.
The above statements are just for the records.
I am willing to take refund of $1000 and receive the receipt in my name from Thompson's Building Material. However, I want to know the exact date and time when the contractor would come and collect the material. Also, I do need communication on the exact date when the $1000 and the receipt will be sent by the contractor to Revdex.com.  I want the $1000 and the receipt sent to Revdex.com within 7 days of collecting the material from my property. Upon receiving the refund of $1000 and the receipt for the returned material in my name, I will release the contractor from the liability of the contract.
I will make sure that the Precast Caps forming the fire pit ring are available in the drive way for the contractor to pick up. I will make sure that they are in the same condition as delivered. I will take pictures of the caps once placed in the drive-way.
Regards,
R[redacted]
