Sierra Nevada Body and Frame did not fulfill a verbal and written contract agreement. I dropped my car off in April of 2015 to have it repaired and painted. They were to fix and repair body work that was done incorrectly by their body shop and then paint my vehicle. We left a list of things that needed to be repaired due to the in correct welding and cracking of paint that they had previously done on car in 2014. When we dropped the car off to them in April, we asked if it was a reasonable request to get the car fixed and painted by July 1st, 2015. Allowing 3 months for them to repair their mistakes. They agreed it would be a reasonable amount of time to finish. We(my girlfriend and I)checked in with the owner via text and walk in on several occasions over the 3 months to find out what the status of the car and get a better idea when the car would be done. The owner would tell us to check back in a week or so. No changes were ever made to the work order over this period of time and final paint was to be determined when the body work was fixed and completed. Today 8/7/15 I received a text to come to the body shop at 11:30am for final parts to be hung on car. When I arrived at 1:30pm August 7th, one month and 7 days past the agreed upon deadline, the car parts were still unfinished and they demanded final payment for unfinished work.In order to get the parts that belong to car I was forced to pay an extra $723.00. They refused to give me the unfinished parts that I originally brought to them unless I paid. The car is still unfinished and now I will need to pay another shop to fix and repair what I have already over paid Sierra Nevada Body and Frame to do. They also said they will be claiming bankruptcy in near future to get out from all the debt on their business.Desired SettlementTo be reimbursed for another shop to repair and finish what was not finished by this shop. To have owner pay for brand new bumper to be re chromed due our new rear bumper being damaged in the shop while in their care. And a reimbursement of $723.00 of over payment. I can submit estimates to finish and repair car at later time.Business Response Customer was attempting to pick up his parts without paying what was owed. Customer was in possession of his car since 08/03/2015. Only 2 doors, 2 fenders and hood were in our possession after that date. Doors were released to customer on 08/05/2015. When customer came on 08/07/2015 he tried to pick up parts (fenders) without making a payment. When asked, first he said he would be able to pay his balance following Tuesday. We could not release those to him since the only part that was unpainted (and we would have possession of as of that time)was his hood and the balance owed was still $1150. There was not enough value in the collateral(hood) to justify releasing parts without any payment. Customer got very angry (screaming). He was asked to leave but declined stating to call Police if we want to remove him from our business premises. Finally we reached agreement and he paid $723 and received his fenders (painted and polished) and his hood (unpainted). It was customer decision not to proceed with painting the hood. Customer and his girlfriend ware informed on multiple occasion on the status of his balance as they were making payments. Customer verbally authorized on 08/02/2015 during phone conversation additional $1000 for cut and polish of paint work (That was Sunday). On Monday he stop by to pick up his car and that amount was reconfirmed. He made a payment on 08/05/2015 in amount of $1500. At that time he was reminded that his balance was still $1150, to which he said "Yes, something like that". On Friday after he picked up his pars he said he should not owe us anything because it took us longer to finish his car than anticipated. We put additional work into customers car which we did not charge customer for. As far as the bumper we were never informed about any damages to the bumper. Moreover, customer was in possession the car. Customer was assembling car himself as per his request. Customer installed rear bumper himself at his property without our assistance after car was painted. There is absolutely no way the bumper is responsibility of Sierra Nevada Body and Frame.
