Review: We contracted J[redacted], to work on our New home backyard. Major pieces are Pavers, Firepit, Patiocover, Planter bed, Irrigation, Lighting. We started work on 6/28/2015, work is still in progress. The contractor was a smooth talker and was always on time to collect checks. One unwise decision we made was to give him most of the contract money ahead of time, unlike what was initially agreed upon. Before the work started it was agreed that appropriate money would be paid as each piece of work got completed. But we ended up paying the due amount before the promised work got completed, as the contractor would insist on being paid. Since we have full time jobs and pretty busy schedule, we could not spend too much time reasoning with him. He needs to be micro-managed, he never completes a job on committed dates. We are delayed by more than a month from the initially agreed upon date. It is a lot of stress and mental pressure to work with him. He never answers his phone. He never gives you a call back. The only communication is text messages. He would only reply when he cho[redacted]s to. He postpones the work beyond reason. We have proofs of texts on how many times we asked him if his men were going to show up for work today or tomorrow or next week. He would just reply with "will be there Tuesday and Wednesday of next week. Sorry." No explanations given. And that is the final word from him, until he cho[redacted]s to reschedule again on Tuesday. He has been putting us on the back burner since the time we paid most the money (94% of the money). He has been working on other contracts in the community that were started after ours (as its money yet to come and nobody has been fool enough to handover most money prior to getting the work done. We inquired.) He ordered wrong dimensions on the valori precast, which takes 4 weeks to arrive from the date ordered, he dint know about this and ordered too late. Now they need to be reordered, which he was reluctant to. He has been postponing for weeks now. Tiered of waiting.Desired Settlement: First we just wanted the job done. But now we do not trust this contractor to finish our job in a stress free, hassle free manor. So we want a refund ($1600) on the wrongly ordered Valori Precast caps and the labor/material charges to finish fitting them, provided rest of the correctly ordered precast caps remain with us. Want to use remaining $1425 for incomplete work- Fountain auto-fill, lighting, irrigation, silica for pavers, Drain caps, seating wall ledger stone, complete fire pit, cleaning

Response:

Below is my response to the complaint filed against me:Yes, it was taking a little longer to complete the project but there were many factors that caused the delay. One being from both parties not wanting to understand that things happen. I texted R[redacted] on September 22, 2015 to pick up the material after no response I tried calling her but was unable to leave a voicemail. This has happened more than once.At this point I have the legal right to complete the project but I am willing to settle out with the customer for $1,000.00. I have to return the fire pit caps, the vendor has agreed to accept them back because they sent me the wrong size ring. That credit will be given in the customers name on the receipt from Thompson's Building Materials. That credit is only to be used towards the purchase of the 2' radius fire pit ring that is needed to complete the fire pit. The customer needs to place all 9 pieces in their driveway undamaged because I don't want to enter their property. I have pictures of the condition they were in before I was run off the property.I will return the merchandise and forward the receipt and the difference of the settlement of $1,000.00 to the Revdex.com. I will need a release of liability on the contract from R[redacted] sent to the Revdex.com.If this is not acceptable I will return to finish the job.J[redacted]

Response:

I accept the conditions, but would like to state a few things clearly for the records.
