I bid this project over a year agoHe had to get some kind of ordinance from the city of Kirkwood before the project could get doneI told him it was fine and to contact me whenever he got what he needed and I would schedule him when I couldHe contacted me in May and I expressed to him multiple times how busy we wereI apologized and I told him we did not have an open slotI gave him a couple dates, but didn’t work out because of weatherI told him we were on other projects before him and I would do my best to get out there as soon as possibleI totally understand his frustration, but I cannot control the weatherAlso there were major heat warningsI didn’t want my employees to get sickHe gave me a deposit and we came out August and started the workI was out there multiple timesWe laid out property line and marked everythingWe removed a fence and the retaining wallWe have been in constant communication the entire process and was surprised when I saw he filed a complaintI will be more than happy to write him a check back for some of the deposit he gave me deducting the work he did

Mr [redacted] 's bid for the project was $2860, and I provided him a 50% deposit ($1430) in April 2016.? The bid included the following main work events to be performed:-? Remove existing concrete curb securing existing fence.? (Completed, on or around 8/22/16)-? Haul off fence/concrete curb removed from east side of property (Completed, on or around 8/24/2016)-? Excavate sod/dirt for new wall (Not completed)-? Install new landscape wall (Not Completed)-? Install drain tile behind wall (Not completed)-? Backfill wall with dirt (Not completed) Given the aforementioned work performed, I am proposing a refund of $from Mr [redacted] .? ? I believe $is more than equitable for the amount of time (4-hours total) spent on the work performed to date and the significant inconvenience he caused our family by the constant delays in fulfilling? the contract.? I fully understand? he had other jobs? in the queue before ours when the contract was signed, but? I believe that the 3+ month delay was excessive? ? Given the aforementioned work performed, I am proposing a refund of $900 from Mr. [redacted].  I believe $530 is more than equitable for the amount of time (4-5 hours total) spent on the work performed to date and the significant inconvenience he caused our family by the constant delays in fulfilling the contract.  I fully understand he had other jobs in the queue before ours when the contract was signed, but I believe that the 3+ month delay was excessive.
