Failure to honor a contract to rebuild my home following catastrophic fire damage having received monies without providing contractual services.Contract date June 24, 2014,completion date on or before December 2014. Sigma General contracting received monies without providing contractual services; and failed to provide licensed services in connection with the rebuild of my home. Checks in the amount of $66.000 has been paid. My home has not been completed as date Jan 10,2015. The company worked on my home June 25-July 1, 2014 until the city of Durham shut the job down because they were working without a permit. A permit dated 9/8/2014 was posted. As to date electrical,plumbing, heating has not been completed. According to our contract the company has failed to perform the contracted agreement.Desired SettlementThe amount to complete my home for the electrical, heating, plumbing. The company received $46,000 before a permit was issued. I would like to received that money. If not that amount I would like to receive monies for my living arrangement and food, since not having a home to return to.Business Response Contact Name and Title: [redacted] project mgrContact Phone:[redacted]Contact Email: [redacted]To whom it may concern,in regard to answering the complaint that were filed against [redacted] and Sigma general contracting company. I entered into a contract or agreement with Mrs[redacted] on June 24, 2014 I received a deposit in the amount of $26,000 at that point I contacted the structural engineer and he began the process of developing drawing of repair that would need to be submitted to Durham County planning Department meanwhile,we began the task of stabilizing and drying in the roof system so that no further damage would occur to the dwelling. There was a misunderstanding between the structural engineer and the Durham inspections department as to what was happening. On July 1, 2014 the city of Durham allowed me to finish the roof system through a special permit and was permitted The same day , because it is customary for the inspection dept. to allow a contractor to dry in a dwelling. (Roof was completed at this point under the special guidance of engineer and Durham inspection dept. we have supporting docs.) Interior walls and decks were not included in this contract ,during the approval process of the drawings it was discovered that the exterior decks were unpermitted additions. Planning dept. stopped the approval process until the issue was resolved. We continued to work along with city officials and our hired engineering company to resolve this issue. The drawings had to be resubmitted once all of the comments were addressed(this sends you to the back of the line) all of this was communicated to the owner ( she indicated that her late husband had built the decks). At this point the roof was dried in, clean up was done. A building permit was issued on 9/8/2014 We have workers and subs that are and have been consistently working on the project. There have been unforeseen issues that caused delays in the completion date of the project such as ; 1. We discovered that the entire sub floor had to be replaced only after the finish floor was removed,owner was made aware of it. 2. At owners request interior Sheetrock was removed this was not in contract, and once removed during framing inspection, inspector required wall Insolation to be bought up to current code ( [redacted]) 3. The finish flooring that the owner chose they did not have enough in stock so it had to be ordered,these are just some of the delays.The owner and our staff met recently and the owner and us all agree that this situation is big misunderstanding due to communication issues, we are committed to completing this project.
