I am rejecting this response because: No the install location was [redacted] Albuquerque NM Office address is [redacted] Albuquerque NM Paypal even verified this address as our ship to addressIn my years in this business I have never had this much of an issue with a vendorI did go to the address you listed and asked the property owner a Mr [redacted] for the sign and he declared there was never any such package deliveredAll the delays have now caused the customer to go to another company and so we have not only wasted $here but also had to refund $to the clientAlso on two occasions you have emailed me with a status update showing refunded as attached aboveJust return the money and a little business advice, when shipping a sign to a client ship it with a signature required

Review: This complaint is against [redacted], owner of Sign Factory; located at [redacted]. (Phone number: ###-###-####) We received a permit from the town for a street sign; stating the sign must be 17 feet from the property line. I had given [redacted] the permit for the sign and he made a mistake and placed the sign 12 feet from the property line. He made the wrong measurements; he measured from the curb instead of the property line. The town will not give me the C.O. because the sign is located too close to the street. I had complained about the sign itself from the first day it was installed. The sign is bowing and has a lot of dents because he used a cheap material; the letters on sign are too heavy. I was given this information by two other sign companies. [redacted] has refused to fix the sign and wants more money. I refused to pay him more and sent him a letter on August **, 2013. He received the letter on August **, 2013. In the letter I asked him to fix and removed the sign 4.5 feet, so it would be 17 feet from the property line. If he doesnt comply; I am requesting for my deposit of $3,500 back. [redacted] does not call or communicate with me, so I have no option but to ask for my deposit back. I believe based on [redacted] errors, he does not have a license to install signs in Suffolk County.Desired Settlement: I would like them to fix the sign and move the sign to the proper footage from the property line. This is a requirement from the town in order to receive a C.O. for the sign.

Response:

The sign was installed on preexisting poles that were not installed by Sign Factory. Site plans were provided with measurements which [redacted] submitted to the town before the sign was installed on to those existing poles. After [redacted] was approved for his permit the sign was installed. [redacted] still owes a balance of aprox $4800.00. No further work will be entertained or performed until this balance is paid. Yes there would be an extra charge to move the poles. We were approved to install the sign in the said location. All said work, materials and labors are listed in a detailed invoice signed by [redacted]. There is much more to this transaction that will have to be handled in court.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[Your Answer Here]

The premit that I have obtained for the sign specifically stated that the sign must be set back from the property line 17ft. Sign Factory made the wrong measurement. They had measured from the curb which was 22ft. The town had stated the sign needs to be 17ft and I gave all the paperwork and premit requirements to Sign Factory. I had told [redacted] of Sign Factory that the sign needed to be 17ft. They had stated that the sign was 22 ft and that it would be fine. Yesterday ,September *,2013 [redacted] (a representative of consumer affairs),came to examine the sign. [redacted] informed me that [redacted] does not have licenses to install signs. [redacted] stated that he will issue [redacted] a violation and a summons. [redacted] witnessed the dents and damage that are noticeable on my sign. I now have a damaged sign in the wrong location and [redacted] still has another sign; total 2 signs. That is why I can't give him any money until he fixes my sign and putting it in the proper location. It is not my fault that [redacted] does not have a license and does not know how to read surveys; to set the sign certain footage from property line not the curb. The contract states using existing poles but it should be in the proper location based on premits. I believe if he had a license to install the sign this mistake could have been avoided. I know that Sign Factory is a new business; that's why in my opinion the sign is poor quality. To other sign companies have confirmed that the sign is poor quality and damaged. I request for my sign to be fixed and moved in the proper location or I want my deposit of $3,700 returned. If you have any questions please feel free to contact me at ###-###-####.
