The boat evaluation was told to myself by Sarah that the eval was NOT completed and you admit to that. Therefore, I picked the boat up before work was performed. It is not my fault that Sarah was not informed - she told me it wasnt completed and I did advise her that I wanted it listed before the 4th of July weekend (or I would have done it myself on iboats.com - its not that hard)The engine was never changed. It was always a (135HP) boat which I told JerryThe retail value of the boat is $29k with trailer - Of course im going to list it for that amount to see what I can get out of it (on craigslist). Im not sure what this has to do with the consignment of the boat. Here is the email from Jerry: ***,Looks like a very nice boatThe only negative is the h.p.engine and the price you are askingWhat would be your bottom line price for a cash buyer? Jerry Paul(740) 549-1999 (office)*** *** (cell)Also on June 19th at 9:24am, the following email was sent to me from Jerry: ***,Our consignment is very simpleWe will sell your boat for you and when it sells we write you a check for 17kWe require that the boat be ran thru our shop where we evaluate the engine, trailer and boat systemsthat way we can represent it to the buyer with confidence that all is ok This is an up front charge of $285.plus tax and we check out approxcomponents on the unit.Once done we take several pics and post on our website and also on a national site (I Boats.com)Do you have a bank loan on the boat?Once sold, allow 3-weeks for pytas it takes time for titles to process and bank papers to be completedJerry Paul(740) 549-1999 (office)*** *** (cell)1) I was charged $2) I stated if the boat evaluation was really completed as you said, where is the point inspection report (requested in an email - and you sent me a receipt - not the inspection report)3) You never took pictures or listed the boat 4) Again, I was told by Sarah that the boat was not evaluated - so I picked it up directly after the call. I was told that the boat was not evaluated over a week of having the boat and nothing was done (not listed), why would I keep it at your facility to just sit around during buying season? If the boat was evaluated, why wasnt it listed (and you say there were other boats ahead of mine?). Im not sure what POP Yachts has to do with the consignment through Pauls Marine, POP Yachts did contact me from my ad that was posted on craigslist way before I reached out to Pauls Marine inquiring if they could list my boat. I did send them all of my information way before coming to Pauls Marine. I never did approve the ad - and they are still trying til this date to get me to approve. Here is the last email from POP Yachts trying to get me to approve the ad (so if you think that I had other interest with the boat other than your company, you do not have your facts)From: *** *** Date: Sunday, July 26, at 2:PMTo: *** *** Subject: Approval ReminderHi ***,This is *** with POP YachtsThis is just a friendly reminder that we need approval for your advertisement.Your ad isn't completely up and running as of yet because we need you to approve it first! Please check for errors or omissionsEven perfect people make mistakes some times...Review/ApproveThe bottom line is, I was told the evaluation was not completed (and you admit that)Therefore the contractual agreement was not fulfilled - so the agreement became null and void. And I still have no proof of the evaluation/inspection after I asked for the report. This is no different than a home inspector telling a client that they did NOT perform an inspection, and then charging them for it, and when asked for a report they have no proof

On June 23, *** *** brought his Mariah in for brokerage. As is customary when a boat, motor etcis brought in for us to sell a Trade Evaluation must be done to check for any issues and to be certain the boat is in sellable condition. These charges are outlined in our
Brokerage Agreement. *** dropped his boat off, signed the brokerage agreement, handed us the titles and paid for the trade evaluation all was handled by Sarah. *** did not say anything to Sarah about wanting the boat listed prior to the July 4th holiday, which had he said that, Sarah as well as anyone of our sales and service personnel would have informed him that there were several boats ahead of his and it would be through our service department as soon as possible. *** also failed to inform us that the motor in the boat had been replaced which would have been very helpful to know. A copy of the signed brokerage Agreement is attached *** did call Sarah on July 2, to inquire if the trade evaluation had been completed. She stated she would check but did not believe it was as she is given the paperwork when they are complete so she can put the listing on the internet. This is where the confusion started as Dan explained in his emails. Our technician did complete the trade evaluation on June 27th and then left for a week vacation. Sales was not notified of the completion so Sarah was not aware. *** told Sarah he was coming to pick up the boat and showed up soon after his call on July 2, 2015. Dan received an email from *** on July 3rd and checked on the information *** gave him and found the inspection was completed and informed *** of that fact and that no refund was due to him. Per the attached email you will see where he and Jerry Paul the owner of Paul's Marine talked about getting it sold during the boating season and the fact we do the Trade evaluations to ensure there are no issues with the boat. *** again did not mention the July 4th holiday at all. Those emails were done on June 18, 2015. Again we received the boat on June 23rd. Which anyone in the marine business will tell you customers who have already purchased boats or have boats already in service want theirs prior to the holiday and are first in line. Also attached is the listing *** posted on Craigslist on June 13, for $23K. In Jerry's email he was very honest with *** and told him the fact that the motor is only a 3,0L (which is small for this boat) is why the price would have to be lower than what he currently had it listed for on Craigslist and *** agreed.He currently has the boat listed on Pop Yachts an online boat seller from Florida for $25,which according to pop.yachts it was listed the first of July. Paul's Marine steadfastly rejects *** response for the following reasons:The trade evaluation was completed as per our policyThe evaluation paperwork has all the pertinent information. Additional information would only have been included if issues were found,

1.  I asked Pauls Maine to list this boat before the 4th of July weekend.  I understand they are denying this,  but I don't know what else to say.  I would have left the boat in my front yard to sell over the Holiday weekend if they said it wouldn't be listed by then.  I spoke to Sarah in person about this.  View your surveillance cameras and you will hear this. 2.  Pauls Marine advised us when we called that the boat had not been evaluated and nothing has been done (as of July 2nd).  They stated they would evaluate and list the boat when they returned from the 4th of July weekend.  This is unacceptable.    We cancelled the service and got our boat.   Then after we picked up the boat they said the boat HAD been evaluated.    I wouldn't have cancelled the service if the  boat was evaluated/listed. **I have nothing further to say about this unfair, unprofessional business.
