Mr [redacted] I had a chance to review your email more thoroughly and look at what has transpired with the [redacted] I wanted to address your primary concerns we discussed yesterday in this email.1) Repairs to ***--You did not pay the electric or there was an overisght by the electric company regarding the pmt which resulted in the electric being turned off during a freezeThe freeze resulted in a burst pipe [redacted] was sent to the property to turn off water to property after we learned a pipe/line burst from the freeze on 1-5- [redacted] was hired to cap/fix the line that had burst 1-9- [redacted] was hired to fix/repair Sheetrock/carpet from the burst pipe before the new tenant moved inYou approved the installation of a dehumidifier and garbage disposal on 1-8-in an email to [redacted] ** [redacted] approved the property for tenancy prior to tenant move inA representative from our company also walked the property prior to tenant move in, and did not notice any non latent issuesThe new tenant moved in around 2-2-We received a complaint of increased moisture shortly after the tenant moved inThe City of [redacted] later inspected the property after the tenant moved in and determined that the moisture was due to poorly insulated windowsYou since hired a new contractor, and I am unaware of whether the moisture issue has been resolvedYou allege that [redacted] and [redacted] may have been negligent in their repairs and that somehow a representative from our company could have foreseen the moisture issue related to the windows prior to tenant move inI do not have any opinion about the contractor negligence, but if you believe you have claims against those contractors, we can provide you their contact infoI disagree with your assertion that our or company did anything negligent regarding this matter2) Security Deposit for [redacted] Tenant--I understand that you agreed to disburse the deposit of $1,and terminate the tenant's lease for the previous tenant in ***Additionally, you authorized the tenant to receive a $reimbursement to the tenant for a hotel stayWe entered the credit to the tenant as requested, but we can only refund to the tenant the amount we have on file for youCurrently you want us to disburse 1,811.41, but we only have 1,available as of todayWe are going to disbure what we have on file to the tenant, and note on the disbursement to contact you for the balanceIf you are unwilling to fund the difference, I do not have any other solutions.3) Termination of Management For Both Properties--you are obviously not happy with our services, and I apologize for thatYesterday you had made some threats of filing a lawsuit against our company, which you are entited to do if you likeHowever, those threats make it clear that it is impossible to continue any productive relationship togatherI will be closing out out your files for both of your properties and refunding any monies we have on file for you I did find that you were incorrectly charged for a Jan management fee for [redacted] in the amount of $85, and we are refunding that amountI am sorry things did not work out with our management company and wish you well

I did not approve a dehumidifier on Jan 8,2018, one day before you hired anyone to address the damage I did approve at your request a dehumidifier in Feb that your contractor admitted would not work, but recommend anyway That is documented in Jill's email ofThe mixed approvals of *** inspections are totally misrepresented The frivolous cost of a useless dehumidifier is the cause of one of my complaintsOne *** inspection was before the water damage and the second was after I had my contractor make repairsThere was approximately two months between the two inspections You hired all other contractors and paid themI paid you as the invoices will note I had no contact with either contractors; never hired them and never paid them All contracts and guidance was through you The contractor I hired fixed the problems left by your contractors, and I paid hm directly There was never any indication by *** inspections that the windows were the source of the water damage to separated bedrooms on opposite sides of the house Your contractors overlooked the water; your people allowed the house to be rented with soaked carpet pads and the costs subsequent to that were totally a result of negligence on you and your contractor's part. Additionally, although you have acknowledged over charging me in January, you have failed to give an accounting of the refunded tenant deposit You should have noted that there was a $deduct from the tenants refund for damage to the commode in one bath That amount should be additionally refunded to the tenants or me You are again negligent in a full and proper accounting of funds due the tenant or me.Regarding the other property you referenced in your termination notice As you are aware, my wife already cancelled your services due again to poor repair/maintenance response by your companyYou were cancelled due to poor performanceSince you have now also cancelled your services and closing out the accounts, then you should immediately refund all deposits to her as well as management fees for this month and next month since a proration is no longer required I estimate that will be approximately $for March and no fees for AprilAgain, any delay will be unacceptable since you feel "threatened." Regarding a threat of a law suit I don't make threats and did notIn the phone call you referenced, I suggested I had business in Dallas and had some decisions to make in the next hours I made no mention of a law suit We left a long conversation with your promise to call me this morning to further discuss this issue in hopes of finding an amicable solution, but instead I am forwarded a poorly researched, erroneous ultimatum on what you are going to do. I am afraid you have greatly narrowed my options going forward. At a minimum, I expect the following: Immediate tenant deposit refund Full accounting of the withholding from the tenants deposit Immediate refund of deposits and fees from the ** *** property
