*** and her husband came into my store on a Friday evening with a large silverware setThey mention they had called our X (XXX) number a few days earlier and presented me with a 30% coupon from our websiteMy response was "
great, let me see what we have here" I weighed out there items twice to ensure I was giving them a proper priceAs I was going over the pricing the husband stood up and said he was unclear of how I was pricing things outHe then went on to explain that they had gotten it appraised a few days earlier as a silverware setI explained to both *** and her husband that I would only be paying them based on the silver weight Our company is not a retailer and that I could only pay them based on the metal value ( silver price )At that time I offered them $(which is over 80% of the metal value)After I offered them the price they said they wanted 30% moreI explained to them that the 30% was included in my initial offer of $and in fact I was the paying more then the coupon offered due to the large amount of silver they had brought inAt that point *** became very angry and said I was misleading her and that I owed her an extra 30% on top of the $I already offered herI explained to her, that at no time was I misleading her or not honoring our coupon and that my initial offer of $included her coupon as promisedAt this point I turned my computer to both *** and her husband hoping they would get some understandingBased on their silver weight and only paying them 30% more there price would of been $( Again my offer was $which I the owner increased based on the large amount of silver they brought in)*** then demanded her $plus her her extra $or she would file a complaint against the Revdex.com and in her words " take our company down"Seeing that both sides couldn't come to an agreement I handed back the items to ***'s husband

He is not telling the truth about the metal value, nor our position regarding his refusal to honor his couponWe had it appraised for both possible auction AND just for the silver weight prior to deciding to just sell it for the silver weighThe appraisal for weight was approx$The $offered was NOT over 80% of the metal valueIn fact, after we left his establishment we went to as shop in *** *** that gave us $for the weight of the silver - which was approx80% of the total amount the silver alone was worth -per both the shop AND the appraisal
When we questioned about the misleading and coupon he flat out said that it didn't apply at all, not that he had included itHis initial position was that he would not honor it because it would cost him too muchWhen we pointed out that silver was not excluded on the coupon, he then indicated that his computer program was programmed to give LESS than 80% and only he, the owner, could authorize more than what the computer program indicatedNote that this contradicts his advertising that his shop 'gives top dollar'Per his own admission, the computer program used to calculate what will be paid is designed to offer less than 80%, when most places will give you 80% of the value
We did not insist on the additional 30% promised by the couponWe offered to take the $IF he corrected the and misleading adHis response was that he wouldn't because that's how he got customers to come into the shopsOur position is that he is engaging in illegal bait and switch advertisingWe have reported this behavior to the Contra Costa County Consumer protection unit of the D.A.'s office as well as the California Department of Consumer AffairsWe are also seeking to engage legal counsel and to contact the owner of the *** us uses to conduct businessWe believe he engages in predatory practices designed to lure consumers who need money fast into his shops and then refuses to honor the coupon, and we are looking to prove this allegation through the legal and regulatory systemsIf he is worried that we plan to "take his business down" (I said that he was "going down" for this) he should only be worried if he believes that his practices will stand up to the legal and regulatory scrutiny we seek to focus on him and his practicesIf he is so confident that he is not engaging in predatory practices, he has nothing to fearMy sense of the matter is that he should be concerned that his business practices will be exposed to the proper legal authoritiesI would also note that he can make this all go away if he just honors the commitments made by his advertising, or changes his advertising to fit to his practicesWe strongly allege that this is NOT a honest business and this is NOT an honest owner - and are confident that the legal process will bear this out

tri valley cash for gold apologizes for any misunderstandingThe coupon was included in the proposal that we gave to the customersThe potential customers wanted more than what the item was worth and sold it to another company for around the same amount that we offeredI will adjust the verbiage on future coupons so these situations do not happen againIn terms of monetary reimbursement the potential customer never sold us the item so its not a point of contention

The misleading advertising is still in place, including the coupon in question as well as a claim to "price matching" and "highest payout" His offer to "adjust the verbiage on future coupons" has no weight since he continues to use the misleading coupon todayThere is no sign or indication that he ever intends to change the coupon - there may not be a "future" coupon
The $$ promised by the coupon was NOT included in the proposalRather the gentleman we were dealing with flat out told us our sale was excluded with respect to the coupon, and then he DROPPED the offer down to a lower amount so he "wouldn't lose money."
I am not satisfied and will not be satisfied until we receive the 30% cash promised in the advertisementHe is not released from his obligation to honor promises made in his advertising simply because he refused to do so and therefore we took our business elsewhereHad he honored the promise made in the coupon (highest payout AND 30% above that) we would have gladly given him our businessI will continue to pursue this complaint through all available channels until a satisfactory resolution is reached

In response to *** *** complaint I understand she is frustrated with the situation but we handled everything according to policyfirst, the pendant we purchased from the individual(your family member) who had stolen the item was
the same pendant we handed back to *** *** the stones were very tiny and if they were diamonds the value would be minimal and we would never attempt to change the diamonds outwe are required to hold all gold for days per state law but we are not required to hold on premises as *** states if he have documented another storage facility on our secondhand dealers license as we do for all locationsSecondly, I agree we could of handed this in a quicker time frame but we had to follow policies once the police report was filedlastly, Any items that are returned back to victims of theft reimburse the establishment for the cost the company paid out this is a law and not an unfair practiceWe are sorry that *** had to go through this but we have handled every step in professional manner and followed all state and company policies
