He told Mr. [redacted] that he would give him $2,500 for the 2002 dodge intrepid. Mr. [redacted] told Mr. [redacted] that the price of the vehicle had already been agreed on at $3995 and would not accept $2500. Mr. [redacted] told Mr. [redacted] that if he changed his mind he could call him at the phone number listed on the receipt. Mr. [redacted] declined and told Mr. [redacted], no thank you and to have a nice day.
On Wednesday, April 29, 2015 Mrs. [redacted] returned to Jett's Auto Sales and requested her deposit back. Mrs. [redacted] was present and stated to her that the deposit was non refundable as per the receipt copy.
Additional Facts:
1. Both [redacted] and [redacted] were present when the car was test driven and the receipt was issued for the deposit and clearly states on the receipt non refundable.
2. It would be absolutely pointless for a deposit to be refundable when a dealership is holding the vehicle for a specific customer. The deposit ensured Mr. and Mrs. [redacted] that the vehicle would be here on Monday, April 27, 2015 for them to pay the balance of the previous agreed price of $3995 and take possession of the vehicle.
