Defendant StatementCase # [redacted] November 18, [redacted] contacted Silverado Auto Sales to purchase and have our shop install a used Allison transmission in his Chevy Duramax Pickup These services were performed on 1/28/16.Before removing [redacted] transmission, Silverado Auto Sales technician test drove [redacted] truck to verify transmission problems [redacted] noted no problems shifting or driving upon initial test drive.Upon further inspection, [redacted] found the transfer case had a pinhole in the rear case half and only a teaspoon of fluid came out after drain plug was removed [redacted] was notified that the transfer case needed to be replaced because of this issue He declined replacing transfer case because he didn't have the money and asked that we refill it with fluid and to only replace the transmission at this timeAt [redacted] request technician removed the transmission and replaced it with our used Allison transmission as agreed Technician performed the recommended transmission service and installed a new internal and external filter as well as new automatic transmission fluid as discussed with [redacted] ***After installation and service, Technician test drove [redacted] truck to check drivability and performance Technician noted no problems or issues shifting, driving, or performing Technician did note that [redacted] truck had an aftermarket high performance ‘Chip’ or tune on his vehicle This ‘Chip’ changes factory recommended settings and tolerances and increases torque and horsepower Under certain driving conditions, this settings can exceed factory recommended settings and tolerances.When [redacted] picked up his truck, Technician discussed with him the work performed and what services were done to his truck He also discussed the bad transfer case with [redacted] indicating that it will need to be replaced/and or rebuilt soon because of the hole in case half and fluid was going to continue to leak out Technician also discussed with [redacted] his performance Chip Total charges for transmission, parts and labor for work came to $2,- Invoice #1084.Two weeks after [redacted] picked up his truck he brought it back in again saying he was having transmission problems Technician test drove truck and found no problems shifting or driving [redacted] then stated the transmission doesnt act up until he hooks a trailer up to the truck and goes up a hill [redacted] left his truck at our shop for Technician to diagnose Technician spent many hours researching and troubleshooting what could be causing such an issue Technician took [redacted] ***s truck on several test drives under different driving conditions to duplicate the complaint by [redacted] but never was able to duplicate the shifting issues he claimed to be experiencing.Technicians research did reveal that aftermarket, high performance chips/programmers change factory recommended settings and tolerances Changing these settings and adding performance chips like the one on [redacted] truck can often exceed the torque specifications and cause irregular and/or internal damages.Technician contacted [redacted] and advised the chip/tune was potentially causing the issues, and invited [redacted] to come with him on a test drive [redacted] agreed and brought his chip/tuner programmer with him To accurately determine whether the chip/programmer was at fault, [redacted] removed the chip/tune from the truck's engine computer and set it back to factory settings Technician and [redacted] then went on a test drive together with [redacted] driving and this time towing a trailer.They planned a route that allowed them to properly duplicate [redacted] concerns about going up a hill [redacted] truck performed perfectly with no shifting problems in or out of tow/haul mode as originally stated from [redacted] *** [redacted] then re-installed his chip/program with the hand held programming device so the high performance settings were functioning [redacted] and Technician then went on the very same route towing the same trailer to duplicate the same driving conditions a second time From a dead stop [redacted] then floored the vehicle with trailer hooked to it and spun both tires while going uphill This test drive revealed an irregular jerk in transmission shifting while in tow/haul mode Also while going down the hill [redacted] ***s truck in tow/haul mode revealed that the factory deceleration shifting was different from stockIt was apparent to both Technician and [redacted] during this test drive with chip/program off and back on again that [redacted] performance chip was causing the irregular shift pattern, not the transmission Technician advised [redacted] that with his high performance chip/program installed, [redacted] needed a custom build high performance transmission The used stock transmission we installed would not continue to hold up to the torque and horsepower [redacted] was demanding[redacted] was never charged for Technicians time or research which equalled almost hours[redacted] later picked up his truck Technician provided [redacted] with detailed information on Factory recommended torque specs and tolerances for his truck.Silverado Auto Sales then recommended [redacted] to [redacted] - who specializes in custom built high performance transmissions [redacted] advised [redacted] with the performance chip/tune on his truck and his driving conditions, a custom built transmission is what his truck needed to hold up to the torque and load demanded.Even though the transmission provided by Silverado Auto Sales was not at fault, Silverado Auto Sales agreed with [redacted] to provide a $2,credit to [redacted] ***l towards the custom built transmission and even provided a rebuildable core transmission for [redacted] to rebuild so [redacted] could continue to drive his vehicle while repairs on his new transmission were being made$2,was credited by [redacted] to [redacted] as shown in invoice # [redacted] (Copy Attached) Even though a $2,credit/refund was given to [redacted] ***, he opened a small claims court hearing against Silverado Auto Sales on 10/17/and claimed we owed him $3,020.89.The Judge dismissed the case on 11/18/small claims court hearing (See attached document) [redacted] complaint against Silverado Auto Sales with the Revdex.com and claiming we owe him $is preposterous I firmly believe Silverado Auto Sales has made every effort to help [redacted] resolve his issues and even gone beyond what most repair shops would do

Response from Silverado Auto Sales:Customer: "I bought a used vehicle that was advertised as well as, verbally described as having no problems or issues."Silverado: CorrectPrior to customer purchasing the vehicle, our in house GM technician performed a safety and mechanical inspection
Inspecting all major components to ensure proper function, as well as making sure fluids are topped off, brakes are good, and there are no safety concerns The vehicle passed the inspectionThe technician noted no DTC’s (Diagnostic Trouble Codes), or driveability issues Inspection notes from our GM technician were available for this pickup prior to purchase, and were provided to the customer on June 6th, via email, along with the Vehicle History Report, the NADA Book Value sheet, a Brochure with Warranty options, and misc pictures of the undercarriage and bed On June 16th, a link to a Video-Walk-Around for the vehicle (via YouTube) was provided via email to the customerThe video was intended to help the customer get a better feel for the vehicle, and have an opportunity to hear it run It is important to note that Silverado Auto Sales takes our vehicle inspections seriously We take pride in doing our ‘Due Diligence’ by performing safety and mechanical inspections to ensure vehicle safety and being road worthy and communicating what we know of the vehicle to customers as stated above Vehicles are sold ‘Used’ and in ‘Used’ Condition and are sold as is with no warranties expressed or implied Silverado does offer warranty protection plans available through outside sources for purchase to customers with nationwide warranties.Customer: "The vehicle showed obvious signs of engine and transmission problems within 3hrs of delivery."Silverado: This statement by customer leads those reading this to believe there were serious engine and transmission problems right after he purchased the vehicle The owner of Silverado personally drove this truck for weeks prior to customer purchase and noted no engine or transmission performance problems or issues as stated Customer: "Dealer has not responded to emails or phone calls to resolve the issues."Silverado: Communication was established a few days following the customer's purchase The customer inquired about Warranty Plans, and brought up a concern with what he thought may be an irregular noise in the turbo Customer did not mention "The vehicle showed obvious signs of engine and transmission problems within 3hrs of delivery." Silverado personnel discussed warranty plan options with customer at that time and presented what was available and costs Customer declined available warranty protection plans that were presentedCustomer: Dealer said the vehicle had been checked and cleared by a certified mechanic, but when I had it checked the next day, there was a "high transmission pressure" code & the trans oil showed unusually high contaminationThe air intake was also making a whistling noise which was due to a poorly installed aftermarket shut-off valve that did not have gaskets to seal air leaksThe other issue was that the speedometer was off by 10%, so speed and mileage indications are also off by 10%.Silverado: As stated above, in weeks of driving the vehicle prior to customer purchase, there were no transmission, air intake, or speedometer problems noted Also as stated above, customer was aware of Silverado GM technicians notes and what was/was not inspected at time of purchase Removing an aftermarket accessory like a air intake or shut off valve is an individual preference, not necessarily a dealership responsibility Customer: This is either fraud or incompetence by the dealer in representing this vehicle as being in "excellent condition and needing nothing"Silverado: Silverado Auto Sales specializes in GM trucks and SUV’s Claiming we are fraudulent or incompetent with many years of combined experience by our staff and technicians is nothing more than an attempt to discredit and slander our business name As stated above, we take our vehicle inspections and quality seriously and communicate those inspections with customers in the form of vehicle inspection/summary forms provided We also offer extended nationwide warranties as stated above It seems preposterous to try to discredit and slander a reputable business over something as simple as the removal of an aftermarket accessory or other individual preference Tell us why here
