we rent an apartment with this company and each apartment has a washer and dryer as part of each unit, when our washer broke down they said we would have to pay to get it fixed which I have been told by other people (landlords) that we should not have to because its part of the apartment, and by the way we are not the only person to complain about the washer not working properly. I feel that they are trying to take advantage of their tenants because they are elderly and won't complain due to possibility of getting evicted

leases an apartment from us here at Silver Crest Apartments. The Community Rules and Regulations are an addendum to the Lease, and are a legal document, that both he and his wife signed upon move in and lease renewal and they got a copy of. Per these documents, they are responsible for any damage to the apartment or facilities. Paragraph 3 in the Community Rules states the following, "We expect you and your guests to be careful in using your apartment and the community facilities. If we have to make repairs because of misuse, neglect, or vandalism, you will be responsible, and we will bill you for the repair costs.". The apartments are furnished with a front loading washer and dryer. On a front loading washer there is a lock that engages once the washer is turned on. This prevents the door from being opened in the middle of the cycle, which would empty the entire washer full of water onto the floor. The lock on the washer was broken due to pulling on it while engaged. The code we received told us this, along with a professional appliance repairman. We also have pictures documenting where the water was leaking from the bottom of the door, due to the lock being broken. The ***'s are not the first resident we have charged due to damage to the washers or other appliances.

They state that they have talked to other landlords who have told them that they don't charge residents for damages. Damages that are above normal wear and tear are always the residents responsibility. We do not and have not evicted anyone ever for reporting a work order or damage to their apartment or appliances, even when it was due to misuse.

We have always allowed our residents to use their own appliances if they would like to. We have many residents who have purchased their own refrigerators, stoves, and even washer/dryer units. If that is what the ***'s would like to do, all they have to do is ask.

We have attached a copy of the lease and our Community Rules.
