In Oct.2019 I contacted Silvertree logging ( Brain ) after seeing a posting for firewood for sale. The owner, Brian, agreed to sell me 6 cords of firewood for a set amount. He delivered one load promptly. Weeks following I would text to see when he would deliver the remaining even offering to pay extra delivery fee if it would make a difference. There were many excuses as to why he couldn't deliver or short answers but no commitment. Texted at least once a week to check on delivery, finally committed to delivering by January 31st 2020 almost 4 months later. When He delivered I separated the loads. Stacking them to get an understanding of how many cords I was receiving. I paid for 6 and once stacked, I only received 4. Texted with no response from the owner Brian.
I am holding his 2 cords of wood because that would cover the extra expense of trucking that was never taken care of. The extra expense of trucking expense was agreed before delivery but he never paid.

I have all the details saved in text. Silver tree did not deliver or agree to delivery expenses. Payment was in full, at the delivery of the first load minus $30 that was paid after the 4th load. I never received the 5th or 6th load. I offered to pay additional $30 a load if he would deliver the remaining product. He did not. According to his response he is holding two loads that were not delivered in the first place. He originally told me his trailer held 1 and 1/3 cord. but when I stacked it in a bin it only equaled 1 cord. I messaged silver tree and he changed his message to his trailer equal to 1 1/2 cord. again stacked only equaled 1 cord. This entire process with silver tree is unethical and immoral. a unit of measure for a cord of wood is 4x4x8. I did not receive the product I paid for. I am short Two cords of wood period. The fact is he states that he is holding them because of an extra charge that I offered to pay ( if ) I received the full amount. He just admitted to being at fault and should be penalized accordingly.
TO resolve this issue now , I would now like to be paid for the missing 2 cords of firewood for the original agreed upon price of $110 a cord equaling $220.

The money that is owed is the trucking expense that he agreed to pay. He offered to even pay more for trucking.

I did offer to pay additional $30 per load for trucking if the entire load was delivered. Silver tree admitted to not delivering two loads as he felt it fitting to hold them ( stated in his original response ). At the end of the day I agreed to pay an additional $30 per load, he delivered 4, equaling 30x4 =120.
Each load he is holding cost $110 (1st agreement ) and now charge me the additional $30 from the original agreement then they are still responsible for $100 reimbursement. I will accept $100 reimbursement as I did offer to pay the additional $30 for each delivered load.
