The house at *** was for rent and our move date was pushed back days due to the house not being painted and readyWhen we arrived at the house the house smelled of pet urine and the house was extremely dirty and could NOT be moved intoWe did not move anything into the home and immediately contacted the realtor, no one came over to see what the issues wereI have over pictures showing the state of the home when we arrived and Mr*** was of NO assistance but rather had a bad attitude due to his staff not ensuring the home was ready to be occupied

I am rejecting this response because:1-It has no bearing on the situation that a friend of ours looked at the propertyThe house was NOT clean and made ready for move-in! *** was called on when we walked the house along with *** *** and *** and NO ONE offered or came over to view the siteWe DID NOT move anything into this house at *** *** *** and therefore what was stated is incorrect that we moved inI have over pictures to show that the house was not in move in conditionThere was dog feces in the backyard, the entire house had not been cleaned, the garage was dirty as well as doors, walls, old sponges had been left, stove was filthy, etc.2-As far as the house being rented within days, that's because you had a contractor over there repairing everything that we pointed out in the email we sent youBasically you STOLE our $1400!3-Also, on the original paperwork work my husband did not sign the authorization for Simmonds Realty to run his credit or to get any of his personal information, as I have attached a copy4-According to Texas law you did not hold up your end of the lease and have the product ready for move in and you (*** ***) should pay the Lowe's their $and reimburse us for the mess you and your staff madeNO one from your office inspected the property or made sure it was cleaned and ready to goAll the information we were told including in the lease it had patio furniture it didn't it was the house down the street

It does have bearing that your best friend viewed the property and advised you to apply for the propertyThat and we have video proof that the property was move in ready prior to your arrival. 2- We did not steal your $In fact, all proceeds of the termination agreement you signed were sent to the home ownerThe only thing you caused our company was lose of time and money from having a good tenant in the property.3- We have proof that you applied online via www.SAleases.comAll IP addresses are tracked via the software processing company. 4- The property was inspected and we performed a video walk-through prior to your arrival Saying that a light bulb was out or there was dog poop in the back yard does not constitute termination of the lease agreementAgain, this is what your inventory and condition form are used for. You will not be getting any funds back after agreeing to the termination paperwork

The tenants moved into the property on [redacted] in Cibolo, TX 78108 on July 17th, 2016. The [redacted] family had one of their best friends view the home with a Realtor prior to submitting an application on the home. Our application process at www.SAleases.com specifically goes over the process...

with leasing a property sight unseen. Ultimately the [redacted] family was unhappy with the condition of the home even though it was move in ready. In fact, the entire home was professionally painted prior to their move in. Like any rental home or apartment, there may have been a small punch list for the handyman to complete but this process is handled via their inventory and condition form. Something of which the [redacted] family wanted nothing to do with. The lease agreement is between the home owner and [redacted] family with Simmonds Real Estate, Inc. handling the property management. Both the home owner and [redacted] family agreed to terminate the lease early for a $1400 fee. The [redacted] family was reimbursed their prorated rent and security deposit minus the $1400 charge upon move out. It is pretty clear that the [redacted] family had remorse with leasing this property but there is nothing I can do when they sign legal documents that bind them to lease the property.I have attached all needed documents for your review and I a bit surprised by their complaint as I was in daily talks with both the husband and wife. I never once avoided these tenants phone calls or emails. Please keep in mind the following:1) Our company did not force the [redacted] family to apply for the property. Our company was in constant communication with the [redacted] family throughout their termination process and we did release their deposit back once the termination paperwork was signed.2) This property re-leased out in exactly 3 business day after re-listing with zero complaints from the new tenant. Keep in mind that absolutely no repairs were made before re-listing the property as it was move in ready. (per the San Antonio MLS and our records)3) The home owner of this property did not have to terminate the lease and could have held the [redacted] family accountable up until their lease termination date of July 16, 2017. The home owner did not have to reimburse the pro-rated rent back but did so to simply get the [redacted] family out so that we could re-lease to family who wanted to lease the property.
