Simmon's Paving

Review: We contacted Simmons Paving to get a quote on replacing our driveway. Simmons came out and wrote a formal quote. We paid the deposit to begin work and paid the balance once complete.[redacted], Owner; told us to wait three days to let the driveway settle before we drive on it. We waited 1.5 months because it was obvious the drive wasn't hardening.After SEVERAl email exchanges with pictures showing the contractor that the driveway was exhibiting divots, movement, and breaking apart upon simple touches, we were informed that the contractor would take care of this either way regardless if the manufacturer of the product was willing to prepare a new batch of asphalt. He (herein noted as "[redacted], the Contractor) mentioned that the mix has a 1 in 5 chance of being too oily and it appeared as if we got the bad mix. He contacted the manufacturer via email and carbon copied us. Never receiving a response from the manufacturer, we attempted to email directly two times but to no avail.When we contracted Simmons Paving, we explained that we were looking for the most durable material so we could count on this drive lasting 20 - 30 years. Simmons Paving, as the expert, recommended the material that is used to pave the roads however informed us that we will not see the asthetically pleasing "shiny black" drive evident in the less durable grade that is traditionally used for residential driveways.We advised that we would prefer the more durable, less shiny and agreed.The driveway was redone in early June, it is now mid July and you can literally pull chunks by hand out of the driveway. Upon numerous emails (which we possess and will forward if required) to reach the contractor, it took several attempts for him to respond. Again, he mentioned he would "take care of this either way because it was his business's name that was in jeopardy". Last night we received an email indicating that Simmons Paving was blaming us for choosing the asphalt we chose.Desired Settlement: We would like the driveway redone with a mix that "isn't bad and too oily" as indicated by the contractor Simmons Paving. Or we would like our money paid in the amount of $6,500 returned immediately. Simmons Paving will receive poor reviews and will be published in papers, news channels, etc that he is fraudulant and doesn't stand behind his business. I would like his license provoked. Simultaneously we are trying to put a lien on his business. Extremely disgusted and worst contractor ever!
