Simpkins Construction

The owner of this company will not issue me a refund even though he has not performed any repair work on my property.I hired Simpkins Construction to perform work on my damaged patio roof. An inspection and estimated was provided and a contract was fully executed the same day on 6/5/2015 for $800 to (1) replace shingles and rotten wood, (2) hang gutters, and (3) add to support beams. [redacted] Simpkins said he would provide a start date no later than 6/7, as he finalizes his weekly schedule on Sundays. Mr. Simpkins agreed that work would be performed promptly the next week as the roof was severely damaged and I did not want further damage caused due to delay. Mr. Simpkins was paid $800 in full the day the contract was executed as he said he would need the funds to purchase materials. Mr. Simpkins did not start work the next week and for almost two months he continually pushed back the start date of the work. The delays caused further damage to my property. At the time of the initial inspection on 6/5, Mr. Simpkins removed the gutters. He did not secure them properly and they subsequently fell off. The plywood on the roof continued to rot and larger holes appeared. Water began falling into the patio and flooded the area. The electricity on the patio has now stopped working due to water damage and I am going to have to pay additional costs for this repair.I continued to call and email Mr. Simpkins with my concerns, but he would not respond (sometimes for over a week at a time) and would not set a start date for repairs. Mr. Simpkins finally visited my property again on 7/25/2015. He said that the damage to the roof was now more severe and he would require an additional $800 in order to repair the entire roof. I told Mr. Simpkins that I would prefer to contract another company/individual to perform this work. I do not trust that he will complete the work in a timely fashion and feel his delays are the cause for the additional repairs to the roof and electric which are now required. I have requested that Mr. Simpkins provide me with a refund of the $800 paid to him as he has not performed any work on my roof to date. He has the refund request in writing. Mr. Simpkins has not responded to my request for a return of funds to date.Desired SettlementI would like the timely return of my $800 so that I can use it to pay another contractor to repair my roof.Business Response the original work to be preformed was 1 facial board, and to remove 2' across where wood was rotted, previous contractor replaced roof and didnt use the correct materials and in this finding and looking at the entire roof, I discovered that the whole roof needed to be replaced not a partial part of the roof, and that would be additional cost for which customer chose to decline and seek other estimates, the whole roof needs to be replaced not part of the roof, the damage and leakage of the roof has nothing to do with Simpkins Construction, the previous contractor used all the wrong material in repairing the roof this roof was recently done within the last year and should not be damaged or leaking at all.Good morning [redacted], I am out of town and when I get back I have to process the payment back to the card, I would need the information from the card again as well as the name, and there was a charge to process the transaction, and all monies that are taken by credit card payments are reported to the IRS. for which I have to pay taxes on so if it is sent back through the service I use then that will be good for me, I will be back in Raleigh, on the 12th of this month and at that time I can get the transaction information and begin the processI dont have a contract with her, and I dont have a problem refunding the money, I need to speak with the person that paid with the credit card, so the money can be refunded back to the credit card, I will be back in town on the 12th of this month and will be glad to take care of this matter.

I sent an email informing him that I was not please with his lack performance and would seek whatever means available to resolve my issues with him. In reply he said that his phone was found and that he would begin work on 5/16/16 around 12pm. He called on 5/16/16 @ 9am to say that he had an emergency and would arrive around 1pm on 5/16/16. I phoned him @ 1:30pm, only to be told that he would begin on 5/17/16. I told him that I was tired of hearing his list of excuses and would pursue whatever legal mean I needed to resolve this issue. However, his receiving the contract was based on the estimate I received from him. Although the cost for his labor remained firm,his estimate of the materials was off by more than $300.00 which pushed the cost of the project up as much as 20%.
