Initial Business Response / [redacted] (1000, 10, 2016/04/11) */ Dear Mr***, I'm sorry for the obvious misunderstanding that has taken placeAfter the conversation we had with you on April 3, 2015, a little over a year ago, we assured you that we would not be able to perform any more services on your property until you had paid for all outstanding services until that point At that time you disputed that services had been rendered as well as stated that you never signed a contract to have us do your workWe sent you copies of the signed contract and each of the outstanding statementsI'd be happy to send them again for your records At Simple Pest Solutions we never service a property without entering into a contractBecause we need your signature to even apply chemicals on the property, it would be illegal for us to do it otherwise Upon signing up for our service on 6/24/2014, you indicated that you were experiencing problems with ants, spiders, roaches outside, and snailsWe explained that pest control is similar to brushing your teeth or mowing your lawn in that the only way to eradicate pests and prevent them from coming back is through a continued maintenance programWe indicated that you would be given a discount off of our regular Initial Clean-Out service if you agreed to have us treat your home over the course of yearYou agreed to this by initialing right next to the words "This agreement is effective for an original period of one year" and then again by printing and signing your name at the bottom of the contract On the contract, we indicated which months we would be coming and how much money would be due each serviceWe also credited $toward your account because you signed the year agreement Our technicians then proceeded to treat your property both inside the home and outside on the propertyWe set up follow up services to check rodent problems that were noted during our initial visit, and these were done at no additional charge We also proceeded with our regularly scheduled service appointments per the indicated months on the contract you signedBecause you opted out of the auto-pay option, we left the bill with you each service in which you claimed you would mail it in After regular services in which you hadn't paid, and multiple statements having been sent to you, we went to your property and indicated that we would not be able to do any more servicing until at least one of the outstanding invoices was paidIt was at this point you got angry and wanted to dispute the statements(Even though each service you had been home and allow us entry.) When you called us claiming that you didn't sign a contract and that you would take us to court if we came out anymore, we sent you a copy of the signed contract and also indicated where on the contract you initialed next to the year agreement which stated that in the event you cancelled prior to your year agreement being completed, that you would be required to return a portion of the original discount you were given upon signing upThe cancellation amount was $of the original $you were credited We indicated that the full amount of outstanding services owed and the cancellation fee would need to be paid to avoid further collection action We attempted to collect in house from you for more than a year before ultimately sending your account to a collection agency While I understand your frustration of being in collections, in order to have your name removed as quickly as possible, you will need to call and pay the collection agency the amount owedAfter we turn the account over to them they take over all future collection activity We hope that the services we did render surpassed [redacted] expectationsAs a company we will bend over backwards to fulfill our side of the contract Sincerely, The Simple Pest Solutions Team Initial Consumer Rebuttal / [redacted] (3000, 12, 2016/04/22) */ (The consumer indicated he/she DID NOT accept the response from the business.) After 2 regular services in which you hadn't paid, and multiple statements having been sent to you, we went to your property and indicated that we would not be able to do any more servicing until at least one of the outstanding invoices was paid. It was at this point you got angry and wanted to dispute the statements. (Even though each service you had been home and allow us entry.)

The company is lying about any SIGNED Contract. This company is notorious for such tactics. I noticed that they have used these tactics on other customers.(View RIP OFF REPORT. It more than coincidence that more than myself have experienced this. Even neighbor has had issue with this company.

I am sorry you feel you were taken advantage of by our company. I can assure you we go to great lengths to ensure our customers have a good experience with us, and am sad that wasn't the case with you.
As a policy, when...

contracted by a customer to help them with their pest control, we will always fulfill our end of the contract, even if it means losing a significant amount of money on certain customers. The only thing we ask in return is that you fulfill the contract terms you agreed to.
When you contracted us to start work on May 8, 2014, you agreed to a 1 year contract in which we as a company would come out on regularly scheduled "pre-set" visits over the course of 1 year. You were given a $75 discount off of our regular Initial Clean Out Service because you signed a 1 year contract. As part of the contract you were told, and initialed next to; an exit clause that stated, "I understand that early termination will result in a cancellation fee of $75, which is a refund of the original discount given." The service you signed up for was custom fit for your specific needs. This allows us to kill the initial infestation, break up the various egg cycles and then strategically rotate products during specific months of the year to best prevent future problems from entering your home or property. In the event problems persist or arise, a quick phone call or email to the company will have one of our state licensed technicians out free of charge, either that day (depending on the time) or at the latest the next morning.
You specifically requested that we send you an email "pre-notification letter" prior to our coming each service to serve as a reminder. These were sent every time, including the disputed services.
We are very happy to work with specific customer needs and requests as long as we have open communication. When communication becomes 1 sided, then we are put in a difficult situation.
Upon signing up, you paid for the discounted 1st month Initial Clean Out Service as is required. You then opted to have our company bill for all future services with 30 day terms.
Our software program keeps track of all the interaction we have with each customer, this allowed me to see that you did make a past-due payment to us for $150.00 on 10/23/2014. This payment covered your regular services and any problems that may have arisen in between for the months of June, July, Aug and Sept. I also see that the office staff that took the payment opted to waive the late fees because you were still a new customer and likely weren't accustomed to making the payments on time.
Our notes also indicate that you did not call in to cancel, but just wanted to give us the payment with a credit card as well as ask us to push back the service and give you a call prior to servicing your home the next time.
Per your request, we pushed the service back to the very last day of the month and then sent you and email reminder as well as called you on the phone number you had requested and left you a voicemail reminder also.
Service continued as planned through January 2, 2015 when you called - claiming that we had not done any servicing??? We checked our records. We have the exact times the technician arrived, the exact time he left, the amount of chemical he used as well as the areas he treated. We also have the records of the notification emails and calls made to you prior to going to your home. In addition statements were mailed to you- reminding you to make a payment so as to not get behind again.
It was during your January 2nd phone call in which you became angry and stated that you wanted to cancel the service. We passed ** your cancellation request to a supervisor and then cancelled all future services for you. He called the number you gave us and left a voice message. We then mailed you a final statement.
We did not hear anything back from you until February 13th stating you were not going to pay for the services just the cancellation fee. And that we could try to send you to collections but if we did you would send us to court.
We continued to send you statements reminding you to send in a payment, which never happened. After 6 more months of no response or communication, we finally decided that our only option was to send you to collections, which we definitely don't like doing, as the collection agency keeps a good portion of the money.

Had you kept in contact with us and responded, I'm sure your experience could have been like many other customers who have struggled to pay their bills but allowed us to work and help them through the difficult times.
