I joined this gym for their pool. was lead to believe it was open, been there 7-8 months, never seen the pool even have water in it..I had decided to join this gym several months ago for only the use of their great new pool. I need this type of exercise for my Sciatica. I am also paying for the use of the pool and all I see or have seen was nothing but an empty hole..It is now mid summer and well over 100 degrees and I would love to drive to my new local gym and do some exercises and jump in the pool,but instead I get to walk by the pool and just peek in threw all the cardboard taped to the windows so no one can see in.. I had asked several times about this and the only response I get from the front desk clerks is " I really dont know". I would like to go somewhere else but I am tied into a contract here and not sure what my next steps are? The pool has been closed officially to all members back on November 12,2012. On the date [redacted] enrolled the pool was still closed. Sims Premier Fitness does not advertise nor sell "pool only memberships". The membership contract cleary states the ability for members to use all amenities. To date [redacted] has utilized the club and its ammenities thirty six times (that are documented)in the last five months. [redacted] does have the option of cancelling her 12 month contract by paying an Early Termination Fee. If I can be of any further assistance please feel free to contact me at your convience. I was never contacted about payments being missed. The Credit card number they had on file was changed when a large department store had information breech issues. Instead of contacting me via mail, phone, or email to attempt to change the number they filed with a collection company when I had no knowledge of any issue. I called to speak with the bill department and refused to talk with me or take a complaint because it was now in collections.Desired SettlementWish to have my account canceled if not already done.Business Response To whom it may concern,I am very sorry that this issue has not been resolved sooner. Before sending anyone to collections we always send out return emails and letters in the mail. I completely understand that it would be frustrating to be sent to collections with no knowledge of a problem. We always strive to make sure we have accurate information in our computer systems like up to date email addresses and phone numbers. Your account has been cancelled here at Sims Premier Fitness as of 2/12/15.

Contract ended in August 2014. Cancellation papers say last billing date 11/1/2014. Continue to withdraw membership fee from credit card.I started a one year membership At Sim's Premiere fitness on 8/7/2013. Member #XXXXXX with an automatic $39.99 monthly withdrawal from my [redacted] credit card. In August of 2014, I mailed a letter to terminate any further membership at the gym. Sim's continued to withdraw membership fees from my credit card. I called Sims on 10/22/2014 to ask why they continued to withdraw money. The clerk on the phone had no idea because according to the computer I did not have a membership. I went to the facility with a copy of my contract. The clerk was able to find my membership and notified me it was under, "[redacted] and he had no record of a cancellation. I requested a cancellation policy request form and filled it out. I also requested he make me a copy of the completed form, and he did. He told me I could call and talk to a manager, but no mangers were in the building at that moment. The next day, I called and spoke to a manager. I was very frustrated that sims continued to withdraw money from my account. I notified her that I had sent a letter cancelling my membership, but she had no record of that. I told her that the day before I had completed a cancellation form. I expected no further withdrawals past Nov 1st, as the cancellation form stated, should be made on my credit card. Sims continues, at the beginning of each month, to withdraw membership fees from my credit card. I have spoken to my credit card company and they have denied the charges each month. [redacted] also blocked Sims from withdrawing on my credit card. However, Sims continues to override the block and attempt to steal my money. As far as I am concerned, Sims behavior is criminal theft!Desired SettlementI am seeking Sims to stop their criminal behavior! The membership has now been cancelled twice and they continue to withdraw from my credit card. To date we do not have a cancellation form or letter via certified mail. If Miss. [redacted] is able to produce a copy of such cancellation form that she is referencing in her complaint we will be more than happy to refund the payments retroactive to the date on the cancellation form. Do to the nature of this situation we have cancelled this membership effective 2/18/15.
