Sims-Lohman is certainly sorry for any confusion or misunderstanding that Ms [redacted] had over her project While we can sympathize with her concerns we do not believe we did anything wrong and were certainly not dishonest with her It is very common for initial budget numbers to increase significantly as the project moves forward and customers make changes Our Sales Manager had begun the process of itemizing those changes for Ms***, but it became apparent that the relationship had become less than productive We suggested to Ms [redacted] that we cancel the order and issue a refund check of her deposit which we are in the process of doing A check for $8,will be mailed by the end of this week We consider the matter closed[redacted] Sims-Lohman

Although our
counter top install team did run behind schedule, our customers order was
received, processed into our system, measured and installed all within
expectations set prior to accepting the order
The expectation
set for a plumbing reconnection is hours after the countertop is
installed,
allowing the adhesive proper time to cureIn this case the reconnection was
scheduled for the same dayHad reconnection of the plumbing been scheduled for
the following day a return trip would not have been required
It is our
sincere hope that our customers family continues to enjoy their new countertop
for many years to come, however, respectfully Sims-Lohman declines to issue a
billing adjustment for added expenses

They did send the $check, however, they are refusing to send the check for the credit memo they issued in December.They used this as a negotiating tool and now claim we can’t have it

September 12, 2016 Complaint ID #  [redacted] Dear Ms. [redacted]: This letter responds to the most recent letter from the Revdex.com dated 9/10/16 regarding [redacted]’s complaint #[redacted].   It is our understanding that Mr. [redacted] and his fiancée own or are buying the property located at [redacted].  That is the property where our company delivered and installed granite countertops at the request of the builder [redacted].  That is also the same property against which we lawfully filed a mechanic’s lien in order to secure our right to payment for the goods delivered to and incorporated into the home under construction at that address.   We are not familiar with Mr. [redacted]’s reference to another property that he apparently owns and that is located at [redacted].  To be clear: we did not record any lien against that property.  Therefore, while we understand why Mr. [redacted] is concerned, we cannot explain how or why a lender or title company did whatever they did in connection with Mr. [redacted]’s closing at [redacted].  We agree that the two properties have nothing to do with each other.  We thought the issue was resolved when we advised Mr. [redacted]’s real estate agent that no lien had been filed against 1[redacted] so we are equally confused how or why Mr. [redacted] would be encountering problems trying to close on a different piece of property.   We also have no information regarding payments made by Mr. [redacted] and/or his fiancée to [redacted].  While we further agree that no homeowner should have to pay twice for the same goods or services, we do not know that happened here.  Mr. [redacted] has never provided any contract or payment information to our company, but we certainly are willing to consider whatever information he wishes to submit in that regard.  Both Mr. [redacted] and our company were treated poorly by the builder.  However, based on all information known to our company before we recorded the lien and to this day, we stand by our decision to record a mechanic’s lien against the property located at [redacted].    Please do not hesitate to contact me at [redacted] if you have additional questions.   Respectfully,

It is not acceptable for a business to communicate unreasonably low costs and insist over a period of 3 months of cooperation that those costs will hold. There were no substantial enough changes to the design to justify a cost increase of 50%, which nets to an additional $8000. I have added all the itemized design additions based on itemized costs communicated by Sims, and they add up to an additional $4000 at most, though a few items were removed, so the real addition would likely be lower. Even on the high side, using Sims-provided itemized cost numbers, only half of the cost increase is attributable to changes.Over the 3 months we worked together, I had asked the designer on multiple occasions in person and via email for an updated cost, and that was never provided, instead I was led to believe that we would be close to the initial cost. All the Sims designer needed to do was tell me much earlier that the cost was going up substantially (due to an initial error that must have been made), and I would have not wasted my time or my paid designers' time any longer.  This renovation project is large, and I am working with multiple contractors, and a few have had to raise their costs mid-project, but each time they were able to pinpoint why and take responsibility of either errors they made in their initial estimate or clear reasons for the additional charges. Unfortunately, this has not happened with Sims Lohman. And if how I was treated is typical for Sims Lohman, Mr.Beiersdorfer, that is sad, and other homeowners need to know of this. [redacted]
